These are the facts about our dealings with Joseph Hernandez. My wife, Angelia, and I bought a 1.1 pair of captive born 2002 anerythristic boas from him with a written guarantee that they would arrive to us alive and healthy. Although the info he provided us with about their history was quite sketchy and almost non-exisent, we bought them anyway. The male was obviously not healthy, and soon died from still uncertain causes.

He and his sister arrived cold(very cold) on Friday, twelve days before he died. They were warmed, and inspected a bit, and put into their new cages(Temps 82-84 room temp, 91-92 degree hot spot). We figured that he was in the latter stages of a shed..... He skin was kinda saggy, he was kinda lethargic, and his sis had  just shed prior to being shipped. They were fed on the second day we had them. He took his rat, but not immediately, and once he got it he just did not seem to know exactly what to do with it(could not manipulate his body to help him get the rat down, but appeared to be desperately trying). He did finally eat it though. Once again we figured it was the shed thing. He went poo in his bowl four days later, so we were never able to get a fecal on him, but, her sample came up clean. Very soon after this his tongue stopped flicking right(moving VERY slowly and not much) and he began to rest with his head propped up,  and became MUCH more lethargic. So we raised his low end Temp to 86-88 degrees, and anxiously awaited Monday when we could take him to the vet.  By the time we made it to there on 4/15 he wasn't flicking his tongue at all, and would only move when rubbed. Our vet's guess was that the little guy was a "runt" for lack of a better word... probably passed over several times in his short life when feeding time came around. He gave him a tiny tiny shot of antibiotic, and sent three more home to be given orally(each dose a liitle more than a tiny drop out of the end of a needle). And he said that the guy desperately needed a meal. So we took him home and attempted to feed him a mouse pinkie. Angelia finally got him to take it amazingly by rubbing his cheek with it the way a mother gets a reluctant child to feed. But it just layed there with it for hours, and finally just put it down. The next day we put him in a completely new, different cage with heat from above, which he seemed to respond to better. He found his hide sometime early that morning, crawled in and died.

Joseph first opted to replace him with another anery he was "supposed" to be receiving on the day I told him of the male's demise. After about a week of ZERO contact from him I called to see what was up. He said that he did not get the anery he was supposed to, and that it took him a bit of effort to find one, also costing him much more than expected.  

This is where things went from BAD to WORSE! He told me I would have to absorb some of the cost for this replacement Anery to the sum of $100. After recovering from this I let him know that the only way I would be agreeable was if he answered a very long list of questions regarding the history of the snake, original breeder, health, and also got a clean bill from a vet for proof. I requested this info several times with ZERO replies to my emails, until they became VERY insistent.

All I got was B.S. and a bunch of excuse.... virtually NO answers. I finally told him that he was a cheat and a liar and to keep his snake and that we would keep our self respect, to which he replied that he would reconsider charging us the $100, and that he would send it to us if we just covered the cost of shipping(still no REAL answers to my questions). Thoroughly disgusted, I never replied. Here are some of the emails:


"Hello Jesse,  I know that I promised you all the information by last sunday, and I did not comply. As I told you I had a very big problem with a virus on my computer.  As a matter of fact I had three viruses. The person that was
supposed to come over last weekend did not.  I had to hire someone from the next town over which is about one hour away.  The problem was finally resolved on Wednesday May 22. In case I did not tell you I own a couple of
pizzeria's in this area and I have been extremely busy with this being the last week of school and little league. I know that sound like a bunch of crap, but it is the truth.  I really do not appreciate you calling me a liar and a cheat because that I am not.  I am not in the reptile business for the
money. I have two very profitable businesses for that.  I am very sorry that I was not able to send you that email. I have been burned myself by a reputable breeder that advertises on kingsnake and believe me I would not do that to anyone. I do have your animal here and he is doing great.  I can tell you that this animal was born at the end of February he has been eating rat pinkies one a week for the past four weeks and has not regurged. He is approximately 21" long but I do not know how much he weighs. He is not as girthy as the female that I sent you. But he is a very aggressive feeder. I have not sent for a fecal sample yet but I plan to do so this week. As for
my source he is no longer in the trade. He has screwed over a few people including myself. All I can tell you is that this animal is healthy and thriving. If you give me one more opportunity I will prove to you that I am not the person that you have described in your earlier email. I have been
thinking over the past week about the hundred dollars for the replacement and I have come to the conclusion that you should not have to pay that much. If you would just accept the shipping charges I will call it even and take the loss. I would rather lose a couple of hundred dollars than lose a
customer and my reputation. I am truly sorry that all this has happened. Let me know If you are still interested.

Right now we are only guessing why you will not reply to our emails...We will see.... But one thing is for certain. No info no money... You told me I was your first customer... Now I am telling you that businesses large and small are usually made or broken with the choices taken very early on. What you are doing is bad business.

If this is all too much to ask at least let me know, keep your anery to try to sell it to someone else. I am better off without the headache.

Sorry to hear about your lose.

Can you post all his info email address, phone number, mail address and any other info you may have so others will know. So If he tries to put his animals under a differnt name we will all know it's still him. Frank

I have dealt with Joe and he seems like a real nice guy to me. From reading the posts here, it seems to me like he is trying to work with you. He may not know who the breeder is. I do not know the breeders on all my animals and frankly I do not care. You had the animal longer then most people would guarentee it for before it died. I think his offer to replace after almost 2 weeks, and you pay the shipping, was a very fair deal. If the animal looks healthy and nice, then take it. This may all come back to bite me in the butt, but from dealing with and talking to Joe, he seems like a alright guy to me. It is possible the little snake may have got too cold and got sick, or something just went wrong inside. Things do happen. I think you should accept his offer and not make such a big fuss. Be smart and keep new animals away from others and you should feel safe in accepting it.

Ok,

   Roberta if this joeseph is such a decent man, why does he not return his e-mails?  That is a crucial factor in good costumer service?  Or are you now the mouthpiece for him?
 A buyer has the right to know all the information about a snake if they want it, and if the seller doesn't know he should be upfront about that, not play stalling games.   Also, there is no reason in the world a snake should arrive in such horrible shape, the packager should take into consideration such cercumstances when packaging the animal.  
 I also think that a seller should replace a deceased or unheathy animal with proper evidence and not make the customer repay shipping charges, BAD customer service.

  My opinion, take any way you want!

Joseph sent you a snake that according to you was sick (And I would probably have to concurr with you as a healthy snake will not very likely die in 12 days because of a recently contracted ailment). Did you tell him right away about your concerns? Please consider I'm not taking sides I just want to know all the facts.

Most dealers will give a live arrival guarantee only, some will extend it up to a week which I consider extremely risky for the seller (I am mostly a buyer so I'm shooting myself in the foot here).

Joseph offered you to replace the animal (for an additional $100) even though the snake had died 12 d after arrival. You decide you don't want to pay a dime more (and you are in your right) and so you tell him. He offers you then to just pay shipment. So far so good and we were close to settling the issue.

Now you ask him the following:

This list of questions will turn off some of the most well known sellers in kingsnake.com (believe me I have tried it). If Jesse is as busy as he claims to be (and I don't have grounds to doubt him) he will be turned off by these.

Questions:

1. Age/date of birth: He did not produce them himself so he doesn't have that info.

2. Accurate description of his health plus provide a clean vet fecal sample. I don't know how much you paid for the snakes (the amount is relevant to how much money you can afford to pay for vet services), but how many of those animals sold in kingsnake.com that are sold as vet checked, dewormed, etc. do you think are really? Most dealers deworm themselves (when they do).

3. Size/weight. He should have a scale. These are the first snakes he is selling, how much do you think a good scale (to the gram) costs?

4. Feeding regime. These were not his animals, he obtained them from a thrid party.

5. (MOST IMPORTANT) your source & his/her phone number. Ask again any "new" seller in kingsnake.com to provide with the name of his supplier and let me know how it goes.

Again I am not taking sides, but Joseph offered to replace your snake. You can take it or leave it. Whatever your decision I hope this turns out for the best.

I will leave it..... For a number of reasons, most are opinions and I will keep them to myself....

...And first, his original offer was for me to pay another $100 to replace the first snake, after he said he would replace it for FREE...

I did this to possibly keep this from happening to someone else. You can make your own decisions from your direct dealings with him as to what kind of person he is. This was my experience.

I have a number of boas from some of the top breeders in the U.S., and they were all ready and willing to provide every bit of info they had on the ones I purchased from them..... Then again, they were the breeders....

Joseph offered to have a fecal sample checked from the replacement over the phone the day I told him the first male died. I only reiterated it to him after his lack of response, because by that point, we were ready to be done with the whole situation. It's not something I generally expect to be done.... Although, some of the better brokers out there will do this and document it for you.

I took a chance with someone I was not sure of right from the start.... and to talk to him he did seem nice enough... but nice does not mean truthful, and I found out the hard way.

Think of me what you will for this. My integrity stands firm. I want people to be careful and informed before they buy a snake from Joseph Hernandez.(Joseph H.)

And I will say this. I plan on selling babies from my boas that I will breed in the future. I will be willing to provide ANY of the things I asked of him and MORE to anyone purchasing a snake from me. I don't see why my questions would make a breeder OR broker squirm, unless they had something to hide.

i dont know either here, below is just my opinion on what has been posted so far

</td></tr></table><span id='postcolor'> its easy to give a history when it starts and ends right there, it sounds to me like he was trying to work with ya and you got feed up with him and ended all contact, you were upset because he wasnt responding to you in a timely fashion so you did the same thing to him, its hard being in our(the sellers) shoes when you have work, families, animals, buisnesses etc etc to deal with, youll find out when you start selling yours on a larger scale, I am not by any means saying that blowing someone off is acceptable, it sounds to me like he made some mistakes then you made the same he did

its sounds to me like the animals died of RI in extreme cases they will lay with their heads up like you descride and sometimes drown themselves, they lay like that to let the mucous run down and clear the airway, that could have come from what ever conditions the aniamls had to deal with during shipping that made him so cold as you described also it could have come if you warmed him to fast you may have shocked him

in any event the guy didnt rip you off, he made a few mistakes and is trying to work with you, if he was a real cheat you would not hear from him period, Matt Martin is a real cheat go read his thread, after 12 or 14 days most my self included wont do anything, i had people kill animals with windex while cleaning cages 3 days after buying the animal etc etc, so for him to try and work with you after that time shows me hes not a bad guy even though he made some mistakes and could have been faster on the responces etc,

You did what you thought was best for your interests and there is nothing wrong with that. We appreciate the heads-up. Now it is up to those who read this thread if they want to take their chances with Joseph. A while ago I was burnt by a dealer REALLY badly with a VERY expensive snake. The animal died in 10 days after an unsuccesful veterinary treatment. The only difference is that in my case the animal was never replaced. Believe me, I know how you feel.

So you say that because he put forth some effort, then he's not all bad. I can agree to that. And from the facts and evidence that I have provided, it seem that way. So make up your own minds about it.

...R.I was our guess ,too, but our vet said if it was, then it was in the very beginning stages. There was no mucus. His best guess was that it was just a weaker snake from the clutch, and probably passed over when feeding time came around more than a few times. It was not necropsied, so we will never know. But the fact that it arrived in this condition leads to the conclusion that it wa sold to us under the false pretenses that it WAS healthy. It definately WAS NOT. It did arrive as cold as I stated, but as far as warming it up, the was no aparent "going into shock" that we could tell. And it did eat the next day, although not normally. His real downward spiral began after his urination/defacation a few days later.... Ultimately it doesn't matter now.

I stopped contact because he continued to give excuses with NO real effort to provide us with the info we requested for the replacement, until we let him know it was too late(After he missed a deadline he had set for himself&#33<img src="http://www.faunaclassifieds.com/iB_html/non-cgi/emoticons/wink.gif" border="0" valign="absmiddle" alt=';)'>. And then he decided to give us some of the info, a bunch more excuses, and all of a sudden decides not to charge us the extra $100 for the replacemant.

...I could have done without the excuses, and really, to my wife and I, it was too little, too late. Maybe you would have given him another chance. Not us. Our lesson was learned. We will not take another risk with a snake we can not be sure about, or be sure about who they are coming from. Period.

Ther's a saying that goes something like this...

"Fool me once, shame on you....
Fool me twice, shame on me."

Thank you for your insight, but we know not to touch that hot coffee pot again, and hope this might help other from making the same mistakes we did.
