WEST CHESTER TWP. - A reptile rescue service is riling neighbors, who are worried about possible threats to the safety of their children and pets from the iguanas, turtles and other animals being cared for.

Damien Oxier has spent the past 10 years caring for sick, injured, and unwanted animals. A veterinary technician by trade and the director of the nonprofit Arrowhead Reptile Rescue, Oxier says he helped 230 animals in 2003 and by June had worked with 150 more.

But the state-licensed wildlife rehabilitator must defend what he's doing at the township's Board of Zoning Appeals meeting tonight.

Several residents of the Knottingwood Estates subdivision, which sits behind his 2-acre property on Hamilton-Mason Road, filed complaints saying they are concerned for the safety of the 15 children in the neighborhood.

The township agreed and cited Oxier for a zone code violation - operating a business in a residential-zoned area. Oxier appealed, denying that his service constitutes a business or a public threat.

Nicole Allison believes they are.

"I'm not against what he does, but you cannot do that in a residential setting," said Nicole Allison, a Knottingwood Estates resident.

Allison says her 9-year-old Scottish terrier suffered from sudden convulsions, vomiting, and paralysis in September and died.

"That my dog died the way he did, it just seems so obvious that he probably got bit by something," she said.

Her three children, ages 3, 5, and 7 are no longer allowed in the family's backyard.

Barb Kley, also a Knottingwood Estates resident, said neighbors have seen iguanas in her yard.

"I just don't want to live next to it," Kley said.

Oxier says the fears are unfounded. He is required to keep detailed records and adequate cages. He says any poisonous snakes he receives go to a researcher.

"We're not the type of people who would have animals running amok. We're trying to prevent that," Oxier said. "If people meet me and take a good look at what we do, they'll realize that we're professionals; we're not idiots, we know what we're doing."

Carolyn Caldwell, program administrator in wildlife management and research for the Ohio Department of Natural Resources, said rehabilitators are required to work with a veterinarian and go through an annual renewal process. Facilities are inspected at a minimum of every two years. There are 87 licensed home-based rehabilitation centers in Ohio.

Oxier says he hopes the Board of Zoning Appeals will realize that he provides an important service to the community. Otherwise, he could no longer take in orphaned animals.

He has worked with local organizations such as the West Chester Police Department, the Cincinnati Zoo and Botanical Garden, and the Newport Aquarium.

The Board of Zoning Appeals will meet at 7 p.m. at 9100 Centre Pointe Drive, Suite 150.

And they ruled against him, what a surprise. If he were rescuing ferrets and cute little bunnies they would have thought he was wonderful for taking in the poor unwanted pets.

It was a victory for some West Chester Township residents -- and a loss for an animal rescue shelter after a zoning appeals board ruled Wednesday night that Arrowhead Reptile Rescue does not belong in a residential area.

More than two dozen residents of the Knottingwood Estates subdivision, which sits behind the rescue shelter on hamilton mason road, came to the meeting.

They say they're afraid to let their children play outside after finding lizards and snakes slithering through their neighborhood.

"We do have small children," said Amy Warrix, a resident of the subdivision. "There are 16-children under eight and they should be able to play outside without fear of being bitten or even surprised by a reptile."

Damien Oxier, who operates the Arrowhead Reptile Rescue, says he feels, "a little hurtful that you put 10 years of your life into helping animals and this is the thanks that you get."

Oxier, who is a veterinary technician, says he's providing a necessary service.

He rehabilitates and finds homes for injured and unwanted lizards, snakes and turtles.

His reptilian roommates may not have to move out just yet though.

Oxier may qualify for a "conditional use certificate" which may allow him to continue his non-profit work out of his home.

its freaking crazy that one neighbor is going to argue and say that his dog died as a result of the reptile shelter.

i hope this guy gets johnny cochran for a lawer and sues his own township :)
 
Wow, a little ignorance sure goes a long way :*(...I hope he gets his conditional permit...I'm sure the lady who's dog was "bitten" had it thoroughly examined to find the cause of death, too *sarcasm*...So when the kids find a "dangerous" garter snake he will be blamed and lose his temp . permit anyway...

This seems rather a short sighted approach to me, would it really not do a lot of good for Reptile & Amphibian owners? I tend to think all of the publicity would make it look rather bad for us, especially with a lawyer like Cochran involved who is, in my opinion, quite a controversial media attention hound to say the least. I would think that before suing the township, the man should attempt an appeal of his case.

If he would actually want to sue; he may also want to have someone investigate the claims of his neighbor about her dog dying, and also try to get more statements from her. If she flat out claims it was a venomous herp from his collection that bit her dog, that could be viewed rather seriously in court if she has no proof. That would be a decent law suit, he could sue her and maybe get her home. This would shut up a lot of his other detractors as they would be scared to death of him. This would also be easier than trying to sue the township which could probably claim sovereign immunity. Not nice, but if you are suing the whole process is usually not nice.
 
It doesn't surprise me at how uneducated and ignorant the general public is about reptiles.

Just this week, WED., I got a call from a guy who wanted to give me two green anoles and a corn snake. He said his wife just had a baby and the reptiles "HAD TO GO TODAY". If I wouldn't take them, he was going to kill them.

He was adamant that the reptiles would kill his new baby. I'm sorry but I did chuckle a little bit when he said that. When I asked him why, he said that his wife's OB doctor said that reptiles carry salmonella in the slime on their skin and simply touching one and then touching the baby will kill the baby. His wife was having a hissy fit and would not bring the new baby in the house until the reptiles were gone.

Yes, folks it's true, an M.D. said this and since it was an M.D. the man would not believe a word I said about salmonella.

There are even well known ' so called herp experts' who claim such is essentially the case with Salmonella. I hope you took the herps.
 
Wow, That lady with the dog, She's is such an idiot she should not be allowed to have a pet. I'm quite sure the chances of contracting Salmonella poisoning from a reptile are a million times less than that persons child being bitten by a dog and becoming infected. I'm really confused as to what these iguanas are going to do to these children in the neighborhood. Run away from them?

Yes, I took the poor animals, I mean I didn't want their kid to die... LOL

The animals were obviously well taken care of.

The corn is a subadult red albino and came with a 20 L tank with UTH, nice faux rock water dish, enough aspen for at least 10 cage cleanings, and a small colony of breeder mice.

The anoles came with a 20T tank with 100 watt UV bulb, nice light fixture, bed-a-beast bedding with extra unused bed-a-beast, live plants, nice faux rock water dish, background on tank, half a can of Miner-All, and about 24 crix.

There in ohio, its a great rescue really. They are very knowledgable and plus they have 12 different locations for their reptiles. As for the lady with the dog, I'm sure she's not smart enough to realize that most small dogs are hypoglicemic (sp) and must be fed properly..or they will have seizures. :sigh:
