Got stuck in the same situation. I resolved it by changing my contract and purchase policy. but since I had nothing in writing with my problem child (same situation with a former Marine) I just refunded the money and was done with it.
In court its been my misfortune to find out if its not written down a judge will almost always side with the purchaser and tell the seller to pay up plus costs.
