Yes I understand that. But you don't have written authorization from his mother to have used the card. It doesn't matter that what you say is true. The mother can claim that her son stole the card.
In my opinion this is the one thing you did wrong that will come back to bite you... pardon the pun.
You took a deposit over the phone and you took complete payment with the card at time of sale from the son. You have nothing proving that the mother authorized the purchase in any way! It will all come down to how honest the mother wants to be and if she's suing you she's not about to claim any degree of responsibility if she can avoid it.
