Here is the timeline of my dealings with Michael Simonelli and his business MAS WholeSale.
August 2001: Ordered 1.1 Spider Tortoises ($800), Received them, Good Transaction.
September 2001 Ordered 1.1 Spider Tortoises($800) AND 1.1 Adult Redfoot Tortoise ($400), Spider Tortoises arrive, one dies two days later, says he will replace it no probelm and that Redfoots will be there later in week with the replacement.
ENTER SEP 11th. Nuf Said
Come December I still have not received the replacement tortoise or the 1.1 redfoots. This is after many promises of "They'll be there Friday" and "I'm on my way to the airport" etc. Many promises, no results.
I finally gave him an ultimatim, refund my money or ship me tortoises or suffer the legal consequences. At this point all communication stops with him and I am forced to report him to the Consumer Affairs Agency in his county in NJ.
An investigation is started in January and the agency sends letters to him to which he does not respond. Finally the investigator actually gets a hold of Michael on the phone and Michael indicated that he wants to work things out and that he will provide written response within 15 days. He never does, next letter goes out from the agency and is returned as "undelieverable" with no address left. Cell phone is shut off, there is no way for me to contact him at this point. The only think that works is his e-mail to which he does not respond to and/or check. So I am faced with trying to find any contact information about him so the courts can serve him with paperwork.
