James Skinny or Jennifer Skinny or Jesse Fricker -Where are my 2 Crested Geckos?

On March fourth I was browsing the Gecko Classifieds here and I found "The Crestie Of My Dreams" so I bought it
Later that same day the same seller listed another absolutely beautiful Crestie and I also bought it
The prices on both geckos were too good to be true-but I have recently purchased some awesome leopard geckos at some fantastic prices so I wasn't too concerned at the time
The sellers name in the ad was Jesse Fricker and that was the account that I PayPal-ed my monies to
I used a green Dot Visa card as the funding which is a pre-paid Visa card
The correspondence back and forth between us was extremely amiable and we both agreed that since the weather turned extremely cold shortly after my purchases-that we would wait on shipping

This past week the weather was finally going to be perfect for shipping n both of our locations and the day was set for Wednesday March 28th and we both agreed that USPS overnight would be acceptable since the temps would be well above freezing and both of us have had very positive experiences using them in the past

The last e-mail that I received from James Skinny that mentioned shipping the 2 Cresteds was on 3/26/2007 1:06:47 PM
I say "that mentioned the cresteds" because we had covered a lot of other subjects in our extremely pleasant emails

Wednesday night came and went with no email and no tracking number from James and I have yet to receive any other correspondence with an explanation of what might have happened this time to prevent him from shipping them despite 3 more e-mails from myself to his addy

I have been buying reptiles online for my private collection for around 4 years now and I have been extremely fortunate with dealing with 100% honest people

When Wednesday came and went without a tracking number and no word what-so ever from James-I was at a loss as what to think
I had come here to the BOI to check on his name and see if it might have been mentioned in an inquiry and I found a negative post about him
I wasn't real comfortable with reading what had happened to Jerry because I was in pretty much the same situation and I figured at that point that I was never going to see those 2 Geckos
But I waited on posting here and contacting PayPal for a claims dispute-I guess that I was still hoping for that email with an explanation from James
I did PM Jerry to ask him if he had ever received either the gecko or a refund of his money and he replied that he had not


Today-I put in a resolution dispute with PayPal and so far I have received nothing from James Skinny etc. and although I feel very awkward posting this I really do not know what to think except that I am not ever going to see those 2 Geckos or my money if I do not do something

I am extremely stressed due to other things going on in my life and some of it is mentioned in the correspondence and I hope that I am not jumping the gun on this-so to speak
I am just so very confused after the great communication that went back and forth between us and still no geckos and now nothing in the way of communication from him

Here is EVERY PIECE of correspondence between myself and him
Some of it is a bit personal and i would rather not post it here but for it all to make sense I will post every e-mail between Jesse Fricker-James Skinny and Jennifer Skinny in it's entirety

At this point I would just like to receive a refund for the total price of $225.00 for both Geckos

Sorry it took so long to get back to you. Well, when I cross reference
Your forcast with my local forcast, it seems that Wednesday is the day to
Ship. The night time temps in your area are going to be right at freezing
Though, which makes me a little nervous only because when the heat packs
That they will be packed in start to cool down, the external temp could be a
Problem. As it is right now, I think I will most likely be shipping on
Wednesday, but lets see how the forcast changes over the next few days. I
Have never seen a forcast that was correct five days in advance so I'll

Actually, I was going to say it was up to you. With the given temperatures
I can guarantee live arrival, but If it were me receiving them, I would

And even a mild respiratory infection in a gecko can turn out to be quite

Oh, and they are doing great. They just filled there bellies with crickets.
I give my geckos their fill crickets three times a week and they always
Have a fresh cap ful of baby food (apricots and peaches are their favorite)
To lap up at their leisure.

Im actually sorry to here that their are people that don't feed them
Crickets. I know that their are commericail diets out there but I have
Never known anybody to use them. I feel it is cruel to deny them the
Opportunity to hunt. Its something that they need to do. Besides, animals
That have their food handed to them, requiring no exertion on their part,
Tend to develop obescity and other health problems. Its the only exercise
That they get. Its a sin not to allow them to hunt. Anyway, Im glad you

Drugs are never ok to give to your dog, but that's mostly because they make a

Also, you said that your vet is waiting for you to decide when to put her

Sandra, I am so sorry to hear that Jesse has apparently ripped you off as well, have you seen the other thread about him? You have been more than patient with him.

I wonder if these are the same geckos that he sold to someone else and then refused to send to him, and kept his money as well?

PayPal should find in your favor if he has no tracking number.
If he sends something to you, please ask the carrier or a neighbor to be present when the box is opened as a witness to the contents.

That way if he sends you a dummy item to make PayPal happy - you can take him to court for interstate fraud. I'm not sure if it is technically mail fraud if he uses FedEx instead of USPS but it may be.

Hopefully he does the right thing and sends you the same geckos you paid for, but have a witness when you open the package he does send that can testify to the contents of the package he did send - because PayPal only cares about wether or not a tracking number exists when a dispute is filed.

I've even known of one case where someone had to fight with PayPal because a tracking number for a delivery to a completely different address was submitted.

At this point I am just so sick of the whole deal and I feel that I have waited long enough
Cathy-Yes-thank you-I saw Jerry's thread unfortunately when it was already too late
Ironically I had read that thread when it was first started and the name never clicked when I started to do business with him

At this point -I just want the money that I paid him refunded into my account
Do I have that option with PayPal or do I have to agree with having him ship the Cresties on the slim chance that he even responds with that option on this matter
I am also wondering how long is considered long enough by PayPal to move this from a resolution dispute to a full claim?

PayPal states there there is a limit of 20 days from the time that the resolution dispute is filed -to up the status of the resolution dispute to a claim with them and that is when they get involved but I don't see a minimum of time mentioned in waiting for the other person to respond

Also- Do I just stay with dealing with PayPal on this matter or should I also contact Green Dot Visa too??

I know that it sounds like I am in a hurry but since it has been since March 4th when payment was received by James/Jesse and in the past 2 weeks there was at least 2 days per week when the weather would have been warm enough to ship IMO
I feel that I have been passive long enough
I always wanted the animals safety to be first and foremost so I went along every time that he put me of with saying that it was too cold to ship despite the fact that I had safely received other geckos during the same or similar weather conditions on the other buyers end

I have never had to deal with a situation such as this one in over 25 online reptile purchases and I just want it to be over and done with

The only thing Paypal can do is refund your money IF Jesse has it in his Paypal account, which I'm guessing he doesn't. I would file a claim through Paypal, AND contact Visa. You have a limited amount of time to file such claims, and many a scammer is good at dragging things out until after that time has come and gone.

Jesse has shown himself to be a thief already, admitting to keeping Jerry's money AND geckos....I would get what you can now before it's too late.

File a theft report with your local police department and ask them to forward the report to the appropriate agency that has jurisdiction in Slatington. One report they will probably just file away. Two reports shows a trend emerging and they will take notice. Even if he is never prosecuted for your's and Jerry's transactions, it starts a paper trail. He will eventually get prosecuted if enough people stand up and file reports.

Also, file your dispute with VISA right away, do not wait. VISA is the only way you will recover your money. Continue with PayPal also and escalate your dispute to a claim immediately. PayPal probably will not be able to recover your money but an unresolved claim will shut down his account, taking one avenue away for him to rip someone else off.

Sandra, so sorry to see that Jesse has racked up another victim.

Its very important to check out the person you are sending money to, I almost jumped on those geckos also but something was not right about the seller.

Best of luck recovering your money from him , but he probably took the money out of his paypal acct. as soon as you sent it.
