Turtlesandtortoises inc did me wrong

I bought a tortoise (Hermann's Tortoise) supposedly was sold with shell deformity, was told he was born that wayfor $99 plus shipping $45? Or 49. For overnight delivery. It took two days to arrive.
Ray the seller will not answer my text concerning a refund or at least credit on future purchase. Turtoise looks like it was involved in a Dog attack. Clearly not a congenital defect. Two holes on either side of shell. See photo tortoise was sold by Turtlesandtortoises inc.
