I'm not a legal expert, but I believe Ryan has it backwards. He has to arrange to have papers served on the defendant where the defendant lives. You can't just go into court and say "I want to bring legal action against this person", and when they don't show up, you win the case. Also, this would be a civil case, and not a criminal case. There wouldn't be any fines. The most that there would be would be a judgement against the defendant that he would have to pay to the plaintiff. And this would be after determining that the defendant caused a financial loss to the plaintiff by his "slander", and then quantitating the loss. After reviewing the "slanderous" statements in this situation, I don't think a judge would stop laughing long enough to proceed with this case.
 Of course this is just my opinion, and if you're not entertained by it, at least I am!
 I agree with you Rob. It seems that the people the most in the wrong are the first ones to cry foul and threaten to sue. Why is that????!!!!

thanks for bringing that up, it was another point I forgot to mention. &nbsp;All of the people in the wrong claim to be due to housing/transportation/Jimmy John-John ate my shoes/whatever, but always can scrounge up enough for legal council to sue people online? &nbsp;How does that work?

Also, Ryan, it is obvious that you have come here due to your BRILLIANT post directly below this one(again, BRILLIANT), but I will ask again, why are you still adamant about sending Ben those Candoia when he has said he just wants his Rosy Boas back? &nbsp;Sold them already and CAN'T send them back to Ben??? &nbsp;And Ben, if Ryan DOES send you the Candoia, judged on his character so far shown, have plenty of frogs handy because some strange feeling says they aren't gonna be feeding on rodents yet, but I could be wrong. &nbsp;

Despite the the headache of dealing with this guy practically for Ben and &nbsp;getting these vulgar responses to my E-mail I'm also grateful to Ben for giving us the "heads up". Its very rare for Ben to say anything negative which was another reason I looked into it, that and he's helped me before.

WOW !!!!!!

This guy is something else. I logged on this morning to find the
same threats of lawsuits that Ralph had. And in Ryans email to
me last night he said he tried to ship yesterday (candoia) but
that ups wouldnt let him "bill to reciever". He said he is sending
the candoia, not the rosies. Dont know exactly why but then
again there are alot of things about this guy that are boggling
my mind! He said he was going to come here to post right after emailing me but I guess he changed his mind, wonder why? Anyone have any suggestions on how else to handle
this guy ??

Well, if you ask me he won't send you the Rosies back because he has already sold them and therefore CAN'T return them to you. &nbsp;But that's just my opinion. &nbsp;And as far as I know, you should be able to send a package "bill to receiver" at any UPS location. &nbsp;But of course that is assuming that you have a UPS account that can be billed. &nbsp;My suggestion would be to tell him to go ahead and ship the snakes at HIS cost, and upon receipt of them in good condition, you will reimburse his shipping expense. &nbsp;
Sorry to see this happen to you Ben, but this guy has apparently been out to bend you over from the get go. &nbsp;Apparently your Rosies were good enough for him to get, hold and feed for a while, and sell. &nbsp;But as I said, based on his actions in this situation thus far, be prepared to deal with some non-feeding WC Candoia. &nbsp;And I am sure he is more than happy to receive 3 nice Rosies from you that he could sell for what, $100/ea(think that is what adult Rosies go for right?)in trade for a couple of Candoia that he likely paid somewhere between $25-50/ea from a wholesaler. &nbsp;

I hope that in the end you get the Candoia and are happy with them.

Don't know if I have an idea how to handle him, but here is my two cents worth. &nbsp;I would like to sue a man who ripped me off in Alaska. &nbsp;~ I commisioned some non-reptile related items (hand forged swords) over 2 years ago and he is STILL trying to finish them!~ and I spoke to a lawyer. &nbsp;Now this is FREE legal advise I got, but my understanding is that I can sue this fellow in small claims if I like, but if I do I must return to Alaska for the hearing. (AND unfortunatly this fellow is also a friend of my husbands, and my husband actually beleives I will get those swords someday&#33<img src="http://www.faunaclassifieds.com/iB_html/non-cgi/emoticons/wink.gif" border="0" valign="absmiddle" alt=''>
