Ed Clark, again

Here are my dealings with Ed Clark. Oh how I wish I knew of this Board before I purchased from him!

Back on 12/28/09 I told Ed I wanted to purchase his Black Pastel Male Ball Python, advertised at 440 grams. I wanted this snake for my first breeding project this season.

The snake and one companion (female ball python – normal CH, she was thrown in because of an accidental overcharge for the original snake), arrived on 12/30 via FedEx.

When I opened the package and retrieved the snakes, I thought both were deceased. Limp and lifeless.
Felt like they had been in the refrigerator. I took them to their cages to place them on their heating pads just in case (I wasn’t optimistic), and started to take pictures for proof of DOA. While doing so I noticed a muscle contraction from the male so I put them in a container with hot water bottles and towels. Both have survived thus far.

I bumped up both snakes heat to 95 degrees on the hot side and 78-80 on the cool side.
This precaution didn’t help the male and he developed a URI on 1/9/09 (heard wheezing late Sat afternoon). Which is not surprising due to the condition on arrival.

Upon bringing the animal to the vet (1/11/09), we also did a fecal since the snake provided one for us on the spot. This was positive for Strongyles.

At the second visit it was discovered that this snake was a FEMALE and not a Male. As mentioned above I was looking to purchase a male to breed with my female and this female was not what I had thought I purchased. This was confirmed by a reptile vet via probing.

I notified Mr. Clark of this on 1/14/09, also sending him receipts and a copy of the records indicating the snake is a female.

I have spent $305.60 as of today (1/18/09), and have one more visit scheduled bringing the total to: $375 on vet bills. I realize this isn’t a huge amount, but it is when you are treating an animal that you did not want in the first place.

I would like to be compensated for the cost of the snake since it was mis-sexed and I am now spending $675 on a snake that does me no good this year.
If Ed would refund me the $300 that I paid for the “male” then I will be satisfied.
If he refuses to refund the money then he needs to replace the animal per his advertisements on Kingsnake.com where I found his original ad for the ball python.

While I strive to be 100% accurate on sexing thats not always the case. I will guarantee correct sexing for 30 days after you recieve it. If there is a sexing mistake that is brought to my attention within 30 days I will replace the missexed animal.


I have to say he was very quick to respond to my emails, even when I notified him on the snakes conditions upon arrival and the URI. Once I stated that the snake was a female, I have received one brief email that was not helpful and have yet to hear back.

These are pertaining more to the current situation and lack of communication. I just wanted to include everything...I am an honest person and won't deny my errors in this matter (such as throwing out the packaging the snakes came in before the URI surfaced).

I'm alerting you now that I will be posting our dealings on fauna classifieds BOI, I know you are familiar with it.

I also will be going to the court house on tuesday morning to file paperwork for small claims court.

I do not appreciate being put in this situation or the lack of attention you have shown me in resolving this matter.

You were attentive to my emails before this situation and for that I thank you, I do hope that your silence means you are working on a resolution that will appease us both.



I have another vet visit in the morning and will be having them confirm the gender of the other snake shipped to me as well.



Please get back to me as soon as possible and let's save both of us a lot of headache.

Hello again Ed.

I would appreciate you letting me know how you plan to proceed in this situation. I had a female cooling in anticipation of this "male". If you are going to refund me, I would appreciate this asap so that I can try to acquire a male ready for this season.

If you are planning on replacing this animal, please let me know exactly how you plan to do this. I do not want this to drag out for weeks, I want his done and behind me as it has caused a lot of stress and inconvenience to me and my family.

Just one other question. If a fecal exam is something that should be done when keeping and receiving new reptiles, why did YOU not have this animal tested while it was in your posession? If parasites had been the ONLY thing wrong with this animal, you never would have heard from me as I do understand parasites can occur with any animal.

Hi Nicole, I used 40 hour heat packs in the box that I sent to you not hand warmers. look in the box and you will find the heat pack wrappers.

I will exchange the BP if indeed it was missexed. if you deciede to keep it after you are finished treating it we can work something out. internal parasites can be introduced to a Bp many ways including feeding rodents.fecal exams are a regular precaution when keeping and recieving new snakes. keep me posted Ed

There has been a lot to take in this week in regard to the male black pastel.



The black pastel went to the vet on Monday. He has a URI. The vet prescribed antibiotics as you suspected he would. We are to go back in every 3 days for 4 more injections (the first was given yesterday). The costs associated with the visits will total approximately $$520 – I have a receipt thus far for the money I spent Monday and today and have attached those receipts. Total as of today $236.20 and we still have 2-3 more visits to go.



We also ran a fecal and it was positive for intestinal parasites. You can see this on the receipts and records.



I am not happy about this situation and feel that it could have been avoided regardless of how the shipping company treated the package. It is not the shipping companies responsibility to know or care what is in each box regardless of labeling and warnings when shipping. It is the responsibility of the shipping party to take proper precautions with a live animal shipment. In this instance accounting for proper warmth and duration of travel were top priority. I cannot fathom that 2 hand warmers were going to sufficiently keep 2 ball pythons warm as they were dropped at a FEDEX shipping building/warehouse that aren’t normally heated, then traveled either by freight or air overnight unheated again. Not to mention the destination point warehouse and then delivery truck. The hand warmers last max 8 to 12 hours and slowly lose their oomph as things go. There are other more industrial ones and I am wondering why that type wasn’t chosen as the temps in NJ aren’t much milder than here and we had talked about the arrival point temp. In speaking with other breeders they would have chosen a 40 hour heat pack and would also have waited for less severe lows before shipping.



A real surprise was to find out that the male was in fact a female…I had my suspicion when he arrived, but my vet seconded my thought and then probing confirmed our suspicions. I know that you guarantee the sex of your animals for 30 days. This is a real issue for me as I planned on pairing this male with a female for this season. That was my purpose for purchasing him.

Now, even if he was healthy, this snake would be useless to me this season. Now I am out a male along with a lot of money in nursing him back to health only to find out now that I have a huge investment into another female.



At this point I feel that there should be some form of compensation for the cost of the vet bills as well as a substitute animal for the missexing as stated in your ads. This is not a situation that had to happen and I thank God that the other snake has pulled through thus far. I will also be taking a fecal of this snake in and sexing her myself and have the vet double check.

Just wanted to update you. Both snakes have eaten, the female seems fine, but the male is now wheezing. I've bumped up his heat even more and if not improved by Monday morning I'll be bringing him into the vet.
Sigh...I hate that this happened because of poor shipping (ie. FEDEX). Poor boy.

The sad thing is that fedex is the best service out there right now, keep them warm and dont feed for 4-5 days. they can handle a short cool down with no problems if its not an extended cold. let me know if you have any problems with them. both are strong feeders. Ed

They arrived, barely alive, but they are here. The stupid fedex driver carried them up to me sideways, and I mentioned that there are arrows pointing up for a reason and that there were live animals inside. He then says, oh, I guess I should have had them in the front instead of by the door. Unpacked and they were ice cold, limp and lifeless. Thought for sure they were gone, I put them on hot water bottles just to be sure, and I've got movement, so I'm hoping that they will turn out okay, but wanted to know if you had any suggestions as to care since they arrived so cold. Obviously I'm going to keep them extra warm and not feed right away, or handle, but didn't know if anything else should be done to help them stay healthy?

I saw you ask about the parents genetics, was this question ever addressed?

The way his email responses are pasted here are a little confusing to me. It appears there's a reply to your email 1/16 about the parasites, and working with you about the missexed one. But on the 17th which is the very next day, you threaten him with small claims court. While I understand you're frustration, that's a little hasty. I try to give folks 24-48 hours to respond especially on the weekends.
It doesn't sound like he did anything innappropriate in the way he shipped them, just a shipping mishap. I personally would probably offer a partial refund, but you both should've known the risks to shipping in the winter even with a reputable carrier. The resulting URI should definitely fall under a health guarantee, if there was one. Did you send him copies of the receipts/bills from the vet for that? As far as parasites are concerned, they don't always shed, so even if he did routine fecals on his collection he may not have found them. Also like he stated, they can come from rodents being fed to them, which means they may not have even been present until that last meal. However, I think parasites should also fall under a health guarantee if the animals was born in his facility and wasn't sold as wild caught. Just my opinion on that one.
I hope you can come to some resolution... he sounded like he wanted to make right on the replies you got up until the 16th. He will probably want the animal returned before offering a full refund though.

I just checked weather.com and it shows that on December 30th (day the package was delivered) your low temp was -1 and your high was only 25. Does that sound about right?

It also shows that at the location the snake was picked up at (Ed's location) the low on the 29th was 21 and the high was 32.

Why in the world are people shipping in those temperatures???

though the shipping temps were far from ideal. I do have to say that the animal being miss-sexed does seem to be the only true gripe you can push back onto ed. if you chose to get him to ship on a day where the weather was that cold you can not blame issues that may have arrised from those temps on the shipper.

What you can blame on ed is the animal being miss-sexed. and from the emails i read he offered to rectify that situation upon the animal being given a clean bill of health.

The 2 ball pythons were 1 cb male black pastel and ch female. both were feeding well on mostly live rodents and at times were fed frozen thawed. both had good body weight with no problems.

As requested by the customer I shipped on the day she wanted me to, it was extremely cold. if I recall correctly it was in the 20's at all locations, I used an insulated box and added an extra layer of flex insulation with 2- 40 hour heat packs inside to keep both ball pythons warm on their journey.

Fedex did a good job getting them there on time, the customer was upset by the way the fedex driver carried the box. the box had 8 red arrows pointing up and was labeled with the common name and scientific name for ball pythons.

Right so per your TOS the only thing that is in question is the animal supposedly been miss-sexed. and you are willing to correct this issue with the customer correct? That is how i understood your email responses posted above. So essentially this BOI thread was highly premature as it does not appear you have been given a chance to correct the situation on sex. But you do plan to compensate the customer one way or the other for the animal being a female when it was purchased as a male.

If I did not sex either of the ball pythons correctly I sincerely apologize for that and will replace the miss sexed BP with the correct sex and refund any shipping costs involved.
