I received your voice mail message last evening and was about to return the call when I found your email concerning your investigation of the matter.

Mr. Lerer is a very creative individual. At no time in the history of this animal was it "in his possession" or his property. The animal was purchased directly from the importer, Albert Montejo and at no time was Mr. Lerer in possession, own or control the animal. Furthermore although the photograph may or may not have been taken by Mr. Lerer (a fact not in evidence and one that is at best complete conjecture. His offer of proof, an email and his assurance of authenticity, would hardly be admissible as even vaguely circumstantial on an evidentiary level.), images of individuals, their personal property and or work product are protected under Federal law. No extensive knowledge of the law is necessary for one to be aware of this as one merely has to see the number of suits argued and lost each year by entities such as "The National Enquirer" to be aware that this is true.

Although I have no intention of filing suit against Matt Lerer (and certainly not your company) for this violation, a blatant piracy of my work product, I feel compelled to bring to your attention the fact that your site is in fact vulnerable and has been put at risk through the actions of this individual. My intent was to inform in an effort to enlist your help in having the picture removed, although doing such will in no way stop Mr. Lerer's <a href="http://www.printroom.com/ViewAlbumPhoto.asp?userid=ghireptiles&album_id=523 60&image_id=11" target='_blank'>http://www.printroom.com/ViewAlb....e_id=11</a> antics which are quite well and widely documented accoss the net (the above is only one of the many accounts he holds) and whom I have already proved that only under the serious threat of legal action will he alter his behavior. (another story for another time perhaps)

I certainly appreciate your position in this matter. The prompt, eager and courteous manner in which you have dealt with the issue is admirable and I'm am gratified that there still exist such individuals "in the hobby". After 39 years traces of integrity have become much harder to find and each is a breath of fresh air harkening back to a day when this was a much more amiable pursuit.

The snake was never my property! It was offered to me on a few occasions in it's short stay at Al's house, including the day I took the pictures. But I wasn't interested because it was thin. The snake belonged to Al Montejo. He said I could photograph it. He even helped me by maneuvering the snake into position.

What about the CD that has about thirty other images of the same animal, taken at the same time? It is right here in my cd collection.

What about MY pictures on your sites that to this day you still refuse to take off. Let me see, you said to me you put them there because you know it pisses me off. You even talked to Tony Nicoli the other day and as he put it, gloated about having my redtail account shut down. Tony even said you snickered as you told him this. Incredible!

Actually, last week you told me you never filed suit because, I think I am close here, lawyers in Ohio are so f#*king greedy. And if you remember I told you I already knew they cost money because the two I retained cost a good bit and I didn't even have to go there. At that point I believe you started laughing because I had spent money for no reason or something like that.

People in the business have been told I served time in jail (which is an outright lie). My pictures have been used without my permission(which is wrong). My privelidges had been shut down for an evening on Redtailboa (for no reason). All of this and I still love my job!!!
