I have never had to do this till now but I believe I got scammed out of my money so here it goes.

In the fall of 2012 I had seen Protean Terrarium Design at the White Plains, NY expo. There I got there card and talked to them briefly.
On July 21, 2013 I contacted Protean Terrarium inquiring about their tanks
On July 22, 2013 I continued talking with them placing an order with them for a new tank for my crested geckos. The total came out to $168 which I sent the same day.
On August 29th I contacted them via email again to see how it was going. It had been almost a month but that was the allotted time that it had said on their web site under the section provided in the URL.

Thats when Jason Perillo the owner had told me he was going for neck surgery in early September and that his orders were going to be delayed.
I found this suspicious because why did he wait till I emailed him to tell me my order wouldn't be ready? My order should have been done by September 9th anyway so why did this affect me.
Anyway me being me I wished him well figuring life is tough and to give him the benefit of the doubt.
On September 29th I wrote to him wishing he was well and asking when the eta was on my tank considering he had over 20 days after his surgery I figured it was enough time to get his stuff in order.
No reply from him
I sent another email on October 3rd just asking if he got my email
He replied October 4th saying he had only been to the shop one other time and he was going down the next day to take a look at the orders and such.
The same day I replied for him to let me know as soon as possible when they were going to be ready. If it wasn't going to be ready in the next two weeks I wanted a refund so I could purchase another tank.
No reply
Oct 9th I sent another email asking when it was going to be ready
No reply
Oct 16th I made a phone call to Jason and he told me that he believed it was boxed and ready to be shipped. I said okay and asked that a tracking number be sent to my email as soon as possible.
No tracking number sent.
I got fed up and decided to contact paypal to let them know what was going on. They opened up a claim on October 24th
October 28th Jason sent me a tracking number via fedex 845712115000077 the tracking number has not been updated since.
October 30th paypal closed the claim in his favor because "based on our definition of significantly not-as-described, this claim does not qualify for a refund"
Novemeber 3rd 12pm: I called Jason. No answer
November 3rd early afternoon I called paypal explaining that I never received the item. They reopened the case
November 3rd later that day. "Unfortunately, we are unable to take any action on this claim because it is not covered under Paypal purchase protection"
Today Nov 4th 10:17am called an no answer again.
So there we have it. I'm frustrated by this to no end and I just either want my tank or refund.
