I never thought I would have to post on here until I had a recent situation w/ Dr. Alan Po (Alexandroff Progrebnoj) of Staten Island, NY. Earlier this month, Alan Po inquired about a group of RETF from me - after exchanging a few e-mails he decided he wanted to purchase a group of 15 baby frogs. I sent him the invoice and he paid on 7/3. Of course that was the Thursday before Independence Day so I was not able to ship. I informed Alan that I would ship them on Monday 7/7 for Tuesday 7/8 delivery. By the time I was ready to ship on Monday I realized that I ran out of cold packs and I told him that I would send them on Tuesday, which I did. When I e-mailed Alan the tracking number, I apparently made a typo and he wasn't able to find the information. As soon as I got home from work I gave him the correct tracking number and checked the status and found that it was delivered and signed for on 7/9.

Later that evening, he informed me that he did not get the package and he wanted an immediate refund as he wished to cancel his order. I informed him that I will not give him a refund, I shipped the frogs and they were signed for. I requested proof of signature and found that it was delivered to his next door neighbor. I e-mailed him the proof of signature where it showed the address where it was at and informed him that he should pick up the package as it seems like he was not there to sign for the package so it was left with the neighbor.

Alan became extremely upset stating that he gave no one permission to ship to anyone other than him and he wanted a refund. I informed him that he will not get a refund, I shipped it to the correct address and it was delivered to and signed for by his neighbor. I didn't hear from him afterwards so I assumed that he picked it up - especially since they are frogs and they needed to be set up ASAP.

On 7/15 I recieved notification from PayPal that he filed a chargeback with his credit card company and I immediately provided them with the tracking information. I e-mailed Alan Po about this and he stated that he wished to cancel the transaction since he did not get the frogs and they were sent to an address that he did not give permission for them to be sent to. Apparently he had no care about the frogs and I am not sure if he is even speaking the truth because when I asked him if he thought about the safety of the frogs he did not answer, he just continued to send e-mails trying to insult me and insisting he was right in the whole situation. It was honestly very hard to understand every word that was typed in his responses to me as his native language is Russian and his English is extremely broken. He stated that he sent the package back, and I should have gotten it by now, and that he didn't get delivery notification until 7/18 which I doubt because the only thing that was on the tracking page was that it was delivered on 7/9. At this point it is my loss, and I am sure that the credit card company will give him his money back.

I just want to warn everyone not to deal with this person, as he obviously does not understand how to communicate clearly, and he does not care about the safety of the animals.

Has he sent any tracking info that proves he sent the package back?
I agree that I would not deal with him; especially since the fact that the neighbor signing for the package had nothing to do with you.

Thanks for your response. He did not provide any tracking information about sending the frogs back - he simply stated that I should have gotten them by now, and he just finally got delivery notification on 7-18 which I doubt because they were delivered on 7-9.

His e-mail mentioning that he sent the package back to you is a clear indication that he actually is or was in possesion of it. He is a scammer. It is common practice in neighborhoods all around the US that one neighbor signs for a package for another neighbor. Keep up the fight. Don't let the scumbag take your money that easy. Next time send the animals with a "signature Required" and pass on the cost.

I did actually send the package with a signature required and I'm disputing the claim with PayPal, and I also reported this to IC3, but I'm really not sure if they'll do anything about it. I know that this is complete fraud but I'm at a loss, I really don't know what else to do.
My boyfriend is completely convinced that this person is no stranger to scamming people because he knew that going through PayPal would be useless... especially since I shipped to a confirmed address and provided them the proof. This guy completely bypassed PayPal and went straight to his Credit Card Company.

I would let him know of the existence of this thread. I also would email him with a request for a tracking number of the return shipment just for the record.

I'm not going to even try and decipher that mess. If this is an example of how he communicated with you in his e-mails before the deal I think I would have just passed on even selling to him.
 
He is not as clueless as he wants to make out, he has a very good grasp of how to file complaints and how credit card chargebacks work. I would not let my guard down not even for a minute.
 
actually, his previous communications were short, stating that he simply wanted the frogs after I gave him the information that he needed - even though it was in very broken English it was clear what he wanted.
A lot of my customers just want the frogs and that is all - so I didn't think he would be any different. I've communicated with plenty of people who don't speak fluent English, and have never had any issues. It wasn't until I responded to his chargeback that he started sending these crazy drawn out e-mails.

Do you know which credit card he used? Wait until you know for sure he has taken action with them, and then they should get a copy of this thread.

Oh yes, I believe he is a lot smarter than he wants me to believe. I don't wish to communicate with him any longer, but he still insists that the package was sent back to me.

From what I understand, you have not been charged back yet. And you said you did email him with a request for a tracking number.
I would not respond to him at all any more unless he is sending credible information, or unless you get third party info like a chargeback.
At this point, he has provided not proof and could be lying about everything in an attempt to buffalo you into a refund.
Just sit tight and wait for real information.
 
Lucille, thanks for the info. I don't want to communicate with him further, and I am continuing to sit tight. I spoke w/ a PayPal rep who states that the cc company can take up to 75 days to make their decision. In the meanwhile I wanted to warn anyone else who would be solicited by him.

Also- if I wasn't there to sign for it and the neighbor did... of course I would be wrong! This is a person who thinks he is right no matter what argument is given to prove he is not.

On this business of the chargeback

As a general rule, the credit card that was used to make the purchase was payable to Paypal and not the seller. So once this person agreed to use that service to pay you, he basically gave up his right to deal with the credit card company directly . There maybe some situations that involve fraud where the credit card company comes into the picture, but its basically between Paypal the buyer and the seller.

What I dont understand is why the postal delivery was given to a neighbor in the first place. Usually its one of 2 choices. Signature required or No Signature required. If the person is not there to accept delivery , a notice is left. From my understanding if NO Signature required is checked off , then the post office may under their discretion leave the box with someone else as is the case here. But under what circumstances was the box left?

Also, dont deal with this person any longer and keep your information between Paypal and yourself. Lets see if his bank wants to get involved, and who the chargeback ends up against you or Paypal. That will be your starting point.
