WELL,THANKS TO THE WEBMASTER MENTIONING THAT KEYWORD SEARCH,I LOOKED UP BRIAN MILLER AND FOUND HIS REPLY TO THOSE OF US HE STIFFED.HE SAYS HE NEVER GOT OUR MONEY ORDERS AND CALLED US FOOLS.WELL,I PUT A TRACE ON MINE AND NOT ONLY DID YOU TELL ME BRIAN THAT YOU GOT THE M.O.BUT I HAVE A PHOTO COPY OF IT WITH YOUR SIGNATURE ON THE BACK.AHHH-SWEET EVIDENCE.I ALSO STILL HAVE THE E-MAIL YOU SENT TO ME TELLING ME YOU GOT IT.IN FACT-I HAVE EVERYTHING IN HARD COPY NOW WITH COPIES AT MY ATTORNEYS OFFICE BEING PROCESSED.I HAVE NO PROBLEM TAKING A TRIP TO K.Y.GOT SOME OLD FRIENDS THERE ANYWAY.SEE YA SOON BRIAN. TO EVERYONE ELSE...I HAVE ALL COPIES OF TRANSACTIONS WITH THIS GUY.IF YOU SEND YOUR ADDRESS MY WAY I WILL SEND YOU COPIES AND MAYBE IT WILL HELP IN YOUR LAWSUITS AGAINST HIM AS WELL. |

Posted At 11:30:32 02/08/2001 Brian, I just want you to know that my wife just gave birth to our first child Sunday and she's been laid up in the hospital since then with complications. I'm in no mood to get in some kind of fight with you. I'll just say this: I will pursue this with every last once left in me. I hate dishonesty. HATE it. The evidence is now pilling up. Money orders don't get lost so easily. Your scheme has failed you. Please consider this: if you drag this out, this matter *will be* pursued. And the people involved are going to be extremely angry and want the worst possible (legal) punishment for you. Or, you could send us back our money and probably get away with just a bad reputation. Please don't make me worry about this while my wife and baby lay in the hospital. Imagine how I'm going to feel if you keep this up. Just send back the money, I beg of you with all sincerity. And if you decide to keep this up, don't even bother telling me about how you never got the money order. Its plainly obvious that you did get our money orders and I just don't need the knife turned in me another time with more lies. |

Posted At 11:37:54 02/08/2001 Vic, I think you should prosecute him to the fullest extent of the law. Obviously he is a crook and alleges NO ONE sends their money (See Exhibit A, posts below.) It would seem hard to believe that two or more people would come on here saying he is a bad person because he doesn't send reptiles when they don't send money. Seems very disbelievable on his part. I think you should file criminal charges; mail fraud, theft by deception, larceny by trick, and whatever else your jurisdiction allows. I normally do not get involved in other people's business, but the fact that he typed "LOL" infuriated me. He is obviously some little punk kid that figures he can't get in trouble. PLEASE prosecute him, make sure he goes to jail. The mail fraud is felony and, coupled with other complaints, will show a pattern that will definately land him in jail. Then let's see if the 150 dollars from you and 190 dollars from the other guy (if that is all) is worth being someone's prag. (See Exhibit B, 11th Episode of Oz). Forget getting your money back and make this kid go to jail. Just my two cents. |

Posted At 13:02:51 02/08/2001 I'm not prosecuting him just to get my money back.In fact I'll most likely lose more then the $200.00 he stole unless the courts rule that he pays for all the other expenses it's going to take to prosecute.I'm mainly pursuing this because of the blaitant dishonesty and corruption these "bad guys"are putting into the herpetology field.Of course there will always be bad guys,but this extends further then someone just sending a sick animal.When I first got into herping,it was one of the few things you could do to get out of the mainstream of every day life and feel safe dealing with almost anyone that shared that same interest.I don't ever remember having to look up who's good and who's bad.We all shared the same respect for eachother.I guess we should have seen this coming with the internet.The other reason I'm doing this of course,is so he does'nt get any more money from any other honest people in the herp community.So with this,I would ask anyone who has been ripped off in this way to do the same-pursue it.And my hats off to the webmaster for this forum.-----I WOULD NOT WASTE MY TIME OR ANYONE ELSES IF I DID NOT HAVE THE EVIDENCE THAT I DO.And I appologize to anyone out there that is getting tired of hearing about this guy...but it needs to be heard. |

Posted At 19:45:01 02/11/2001 Vic, I live in Kentucky and I'm only 20 minutes from Lexington, where I own a store. If you'd like to come here I can put you up for a few days to get this idiot. I doubt the last post was really from him, but I think if you investigate the Lexington area, including universities, you'll be able to find him. He had to cash the money order somewhere. Was it his bank?? There are ways to find him and you've got plenty of evidence to have him arrested. If I can be of any assistance please contact me. |

Posted At 12:45:23 02/12/2001 To All, I am 100% dedicated to pursuing this individual personally as well as soon as I have time. I have a case open with an Internet fraud division of the FBI. I encourage anyone having problems with Brian Miller to open a complaint there (http://www.ifccfbi.gov) and reference my complaint #: I01013017391131. Vic has been keeping me in the loop with respect to what he's been up to. But please include me in any e-mails going around about this behind the scenes as I'm compiling this data to add to my complaint. Thanks... PS - Brian Miller, even if you are not "Brian Miller" as I'm starting to suspect, we will find you. You had access to the PO Box you used. Bottom line, that gives us a trail. Enjoy being free while you can. |

Posted At 16:00:52 02/12/2001 Update: I put a stop on the money order sent to Brian Miller through my credit union (where the money order was purchased). I just received a check for the full amount as a result. Not sure at this point what this means. I'm pretty sure my credit union protects me so that the money order could have been cashed and I still receive a refund as the result of my stop request. However, I need to follow this up. If the money order was not cashed, I'll have to assume that Brian Miller was not lying to me. This does not mean I will not be pursuing the case I opened. Brian has still refused to give me a home address or a phone number, nor would he call me. At some point he stopped answering my e-mails. Why? Also, like I said, I don't know yet that the money order was not cashed. It very well may have been. All this means is that one way or another he was not able to screw me out of my money. He may have my credit union to deal with though at this point. More to come... PS - Vic, did you try to put a stop on your money order? |

Posted At 17:06:12 02/12/2001 I have verfication that mine was cashed on the 10th of jan.The stop is ongoing with the money order I got.I'm assuming you have some type of insurance through your credit union. |
