Scott Gelsomino and I came to a successful conclusion on our deal and I would like to apologize to him for the nasty post. Because Scott had a serious family emergency and because he was lead to believe that I was somone whom I was not, the situation got out of hand. However, he did take care of his end of the deal after dealing with the problems the arose. I take back any comments made that may have shed bad light on him. The deal is a success and he has more than taken care of his end of the deal. Ben Martin |

Who would sell a CB gila monster for $600? I can't belive you are still posting on this forum. You both already killed your legitimacy with the exchange a few days ago. What happened to the lawsuit? Did he pay you off? It would seem so. I thought you had four people with legitimate claims against him. I thought you were wanted by Fish and Wildlife. There were some tough accusations to all of a sudden just disappear. You two are amazing, you both should have just walked into Fish and Game and said here, listen to this arguement. And For Tom Simpson, if thats your real name, The animal was not a Gila nor was a Gila ever mentioned.Your out of line and way off base! I had ordered some snakes from Ben. And since he is in Nevada, for a fee he can purchase a commercial collectors permit and can legaly collect and sell native reptiles. After ordering the snakes, I was told he didn't have a commercial permit and therefore I was under the impression the animals I ordered were illegaly collected and sold. Later I found out I was wrong, but I had refused to pay for them because of this not to mention I had a close family member die and was realy in no position to deal with the problems. I found out that he was not who I was told he was and was infact legal and the snakes were legaly collected. So I took care of my end of the bargain and his apology was to correct a post that was up for a limited time insinuating that I had stole the snakes because I refused to pay for them. All of the insults and accusations thrown back and forth between us were unfounded and mere attempts to prove that one or the other was in the right. So as you can see, you are way off base..Thanks for your inaccurate analogy though.. |

I'm sorry Mr. Gelsomino, but I may have been confused. Let me quote a bit of the thread below to rehash. Gelsomino: "The Feds As well As Fish & Wildlife. Mark was just caught by a sting in Bagdad Az. for catching a Gila Monster and had to go to court over it. When I found out about all of this, I refused to deal with them. Yes, I owe them $600. But since I now know they are animals wich were not legally obtained, I refused to deal with them or pay them. I told them they have no right to expect money for animals they illegally collected as well as now that I know they are doing it, I want nothing further to do with them. And so this where we end up. Anyone who has anything to do with BEN MARTIN & his friend Mark Will be brought down with them when Fish and wildlife and the feds catch them. You ask why the Feds also? For violations of the Lacey act. How can they expect to rieceve payment for illegal activites? " Martin: "In response to the above post. That is admissable in court according to my lawyers. You told me how to trick Airborne Express, and to label the package as Hissing Cockroaches, stated July 9, 2001. You are quoted as saying ... "Dont worry i've done it over a hundred times".. I do not think I need to go any further regarding additional comments you made. A group of people who have been ripped off by your scams and myself are filing multiple lawsuits vs. you. Mr. Gelsomino actually proposed the deal to me and i have the documented evidence to back that! Yes, he ripped me off and he will be summoned to court. As you can see by his postings, we are not exactly dealing with Albert Einstein. Scott actually possesses 6 gila monsters all obtained illegaly and so stated via documentation by myself on July 9, 2001. All this evidence is admissable in a court of law and will be used against Mr. Scott Gelsomino." Yessir, you are exactly right. It was very clear indeed.
