I sit here and I read all these posts about Jerry Tubbs and it really makes me wish I had researched him a little better before dealing with him. I read all these post about how horrible this guy is and all he can do is post childish responses. He accuses other people of being childish, yet he calls people names IE: BRAT-NEY... he tells people to "GO FILL YOUR PIEHOLE WITH CRAWFISH". Now, you tell me, who is being childish? For those of you who don't know who I am, just read some of the posts Jerry put up about shipping a Woma to the wrong person. I am the person who should have received the Woma... and as of yet have received NOTHING!!!!!!!!!!!!!!!!!!!! Jerry seems to be a big fan of saying "Prove it"... Well, I can! I have every email received from Jerry and copies of every email I sent him. How about lets just start with some of the facts. FACT-- I purchased 2 Womas and 1 Albino Burm FACT-- To date I have received 1 Woma FACT-- After waiting for a few weeks Jerry finally shipped... but only 1 Woma FACT-- His excuse was the other 2 just ate. (Sound familiar??) FACT-- What I received was 2 albino corns FACT-- I then shipped the corns to the rightful owner.. the same day I might add as requested by Jerry! FACT-- I am a reasonable person and understand that mistakes are made FACT-- After waiting ...again... the day comes to ship the other Woma and the Burm FACT-- I received 1 Woma and a check for the Burm FACT-- His excuse this time is that he forgot to take the Burm with him FACT-- The Woma I received was healthy and a beautiful animal FACT-- I told Jerry I did not want his check that I wanted the Burm FACT-- After waiting over a week and not getting a response I deposited the check FACT-- IT BOUNCED!!!! FACT-- After speaking to his wife I get an email saying he didn't have the money in his BUSINESS account because I said I wanted the burm...(funny how now I get a response from him) FACT-- After speaking to his wife on his cell phone and her telling me he was home his child tells me... (after being on hold for a few minutes)... that he just left... (who's watching the kids??) FACT-- The check was sent back through by the bank and this time it cleared FACT-- I have now received 4 bills from Airborne Express because of all of this... of course the bills from airborne are more than the check was for... and all charges have been reversed back to Jerry FACT-- I offered to accept other animals from him as replacements for the prices he posted on Kingsnake FACT-- He said he could not give them a way like that and he would be losing too much money FACT-- I posted a complaint with Paypal... after all it had been 28 days and you only have 30 to file the complaint FACT-- I suddenly get an email from Jerry wanting to work out a payment plan FACT-- Almost a month had gone by and still no payment FACT-- It's now more than 2 weeks from the date he said he would send a small payment FACT-- Getting VERY VERY frustrated FACT-- Have sent several emails..and no response (imagine my surprise) FACT-- I will be at the Tampa show this weekend and unable to respond FACT-- If I do not have a payment in my mailbox/paypal (or at least some form of response from Jerry) when I get home I will be talking with the fraud department of the credit card company and I will have an appointment with a lawyer FACT-- I may have left a few things out... but you get the idea FACT-- This has gone on WAY too long and I'm tired of it Now, to all of those Jerry has done wrong in the past and he still has not made it right... please email me all of the details as I am going to pursue fraud charges against Jerry. I could use all of the information available to help form the case, if necessary. |

I placed a complaint with his internet server and it was apparently strike 2. If you need the place to file a complaint go to: WWW.IFCCFBI.GOV They are handling my fraud case against Michael Wright/Joey Wright. I received a letter from the State Attorney General in Kentucky who was turning all of it over to the local District Attorney to pursue. So it does work. I should be hearing from them in about a week when I'll send them all of my emails from him and the posts here about him from others. Go for it if you got ripped off and the deal occured over the internet. Even if it's $5.00 it's a felony because it happened on the internet. |

As I stated before, I have every email sent from Jerry and NOT ONCE have I ever agreed to tell paypal anything. NOT ONCE has it ever been brought up. You claim you don't have long distance on your phone, so you can't say you called me and asked me to send paypal an email. As for the replacement animals... tell me this... why would I pay you for a Woma... not get it, then pay you again for other animals that are to be used as replacements. No one is dumb enough to think that is the way it should work. Now to the bad check. It was the bank that said it wouldn't clear... not me. It was also the bank that ran it through a second time...not me. I went to the bank to pick up your bad check and was told that it had already been sent through. Airborne Express has billed me the following. 1st bill $33.58 for the corn snakes I received from Jerry 2nd bill $29.21 for the Woma that Jerry sent to the wrong person 3rd bill $39.51 for the shipment of corn snakes that I sent at Jerry's request to the person that should have received them 4th bill $66.41 for the Woma and the check we received Now...do you want the invoice numbers too??? I have them as well. Total = $168.71... sounds like more than $115 to me. Jerry, how can you send me an email asking what the total is when I've sent you email before stating what the total is? Would you like me to send you a copy of the original email??? You are such a "PROOF" person... send me any info you have stating that I agreed to tell paypal we worked something out. I agreed to work with you. I never agreed to wait until you got money from Frank. Why would I? You screwed up... not me. If I had made the mistake I would have taken care of it like any honest person would. |

I just have seen lots of posts about Mr. Tubbs, both good and bad(bad outweighing good though) and this one really caught my attention. And as a person in the business, I just had to remark. I agree with Don 100% on this, WHY should he tell paypal you guys settled up, when you haven't? I sure as hell wouldn't do that. Because then Jerry never has to come up with the money AND he can say, "Well, geez, I have this statement from Mr. Graves that says we are good, so I don't owe him anything." Who in their right minds would zip along a message to that effect? And Jerry is REALLY showing his poor business skills and poor morals by saying he WON'T come up with money until Don tells paypal to get off of his back?! The reason that the complaint was filed was so he could get his money out of you! And one last note... I understand mistakes happen, but COME ON Jerry, if you are selling something as high dollar as womas, you should damn well know who and where you are sending them. I make sure I check, double check, and triple check the contents of ALL of my packages and the shipping labels to be sure everyone is going to the right place. Oh well, enough ranting. Good luck getting your money Don and I hope this Jerry guy learns a thing or two. |

He's done everything in an ethical way and you're whining about him contacting PayPal for his own protection and the fact that he wanted REPLACEMENT animals without paying you AGAIN!!! Talk about unethical! Don, it's a shame, it seems like IF you can manage to get what you ordered from Jerry he sends decent animals, but with his business practices, or LACK of, it's not worth the risk. I hope you get full reimbursement soon. |

His deal is independent of the other. If it's true, and you plan on going to court with Frank, what happens if you lose the case??? Don sounds like a really great guy.. He receives the wrong snakes and out of his own pocket (and in good faith) sends them to the rightful buyer. Pretty decent in my book. Sounds as though Don would have taken some substitutions also in lieu of the Burm. How would your substituting make it a raw deal for you when you'll still have to compensate him with cash for a short order??? Do the right thing and agree to anything Don asks for. In this case, you should put financial gain behind courtesy and cut him a real good deal on something. He seems very reasonable and patient and you don't want to lose customers like Don over something as petty as making them wait eons of time to consumate a deal.. Since you shipped the wrong snake to the wrong person, whether you called and warned them or not, YOU, Jerry Tubbs, put their name on the box and shipped it to the wrong house and are ultimately responsible. And the people that were expecting a couple of cornsnakes got a BIG surprise, as well as their cornsnakes later on. Now, although I think it was unethical for them to keep/lose/kill/sell the woma, since it was addressed to them, it was in essence theirs. They don't have to pay you a dime for it, even though I think they should. But there is no sense waiting on these people to send you money or take the mto court while Don is left sitting on the fence. Just eat the cost, pay up, and just chalk it all up as a loss. As far as the issue with MM goes, yes, maybe he could have contacted you when he was supposed to. BUT, noone should have to tell you when to send out a refund. And you shouldn't give someone a set schedule to ask for it. That would be like me saying..."Okay, I screwed up your order and wasn't able to send your geckos out. Call me up between the hours of 12-3 pm on Sunday the 25th of August so we can work this out. If I don't hear from you, then you get no money and you get no animals." Is that what I am reading or was that rock I smoked this morning a little too good? j/k That is pretty damn shady, b/c jeez, all you have to do is not answer your phone, or not check your e-mails for a day or two and magically, they aren't on time. It just seems like your business practices work in this order: 1. Set up everything and get money. 2. All of a sudden, you can't come up with the animals, they become sick, or you feed them the day before you ship(WTF is that?!). Or you send them to the wrong place. 3. Jerk the buyer around for a while until they get tired of it and start lodging formal complaints against you. 4. When the complaints come in from paypal, fed, etc. you tell the people that you will send them payments(gee, if you have the payment in the bank already, why should you have to send them payments?) if they tell whichever agency that you guys have made arrangements they will get their money. 5. Sit back at home and not bother refunding or paying money because you made a mistake, but of course, it was someone else's fault. And Jerry, I am sure that deep down you are not actually a bad PERSON, but as far as business goes, well, I don't think I need to finish this sentence... |

There was some talk in Daytona about the benefit raffle many of us contributed to (myself included)for your son's health care. Understand that I don't accuse you of using the money for anything other than your son, but still would have appreciated an update, progress reports etc. on his condition. You seem to have the time to run reptile postings and defend your reputation, but I donated money over a year ago and still have not heard a thing other than having someone contact me to get more money out of me for the raffle.. Were the snakes ever won by anyone?? Did your son get better?? How much money was collected to help offset medical bills?? Curiousity is my motive for writing this post, as I meant to do it after Daytona yet lost track of the thought.
