Cliff notes: Congress gave the agencies under the executive branch the power to write their own regulations, called the Code of Federal Regulations, or CFR's, in order to implement laws that were passed. ATF is using the same power, granted by Congress, that they have to regulate guns that the USFWS has to implement regulations like CatX.
