I agree based on the back-and-forth conversation in the OP.

That said, he did send pictures of the one male he had available before buyer sent funds, and the deal he offered was $425 shipped for that particular male plus a female. If there were a problem the buyer should have noticed at that time.

At the moment we have two bad guy BOI threads from two people who really should have known better.
But worse still all we really have so far is a case of "he said, she said"
Can we have actual email screenshots posted by somebody or both BOI threads are pretty meaningless

The hesitation says more to both sides of this deal in my mind. Both parties are potentially intentionally withholding information. The emails likely shed poor light on both parties at one time or another.

I don't believe the OP was intentionally being deceiving, but feel the buyer is probably feeling buyers remorse after carefully considering the selection he was offered again (after saying yes). The OP makes a claim that he can not be refunded on the label, which I personally know is simply not true. Two instances I've had to cancel and reorder a label and both times went flawlessly thanks to SYR. Back on point, the OP should not have spent money that was not technically his. Until a product has been delivered alive and well, that money needs to be left as is minus any shipping costs needed to be deducted. Ebay forces this on it's members, only allowing a small amount of the funding to be available for shipping. But mandating that the rest be untouched till the status of tracking shows delivered. Helps prevent these instances.

Again, is either a "bad guy" - short answer is no. But is either completely in the clear on this - Again, short answer no.

That looks identical to the ops original first post, I really do not see anything missing as the buyer has tried to claim.
the ONLY thing missing are the actual pix of the alternative snakes the seller offered but it seems clear to me that the seller stated categoricaly the super ghost was not going to be part of any deal
then you see the buyer agreeing AFTER THE SELLER SENT HIM PIX OF ALTERNATIVE SNAKES.

I still think there was confusion on both sides and the seller needed to be MUCH clearer on the actual animals for sale but I would say the buyer truly got buyers remorse.
Whatever the case there is no way the seller should have spent the buyers money even BEFORE any shipping took place and buyer confirmed he had received the animal(s) and all was good!

And its going to get really confusing if we all end up having to double post on both of the BOI,s
So maybe we should stick to this original one?

I just got home and was about to head to the airport hub and saw this. I have all the emails, you knew what you were buying.. but lets get beyond that.

And no I did not see any profanity, quite restrained actually, only got a bit abrupt right at the end.

I still truly believe this could have been very easily resolved without involvement of the BOI but it is here now and we will address it for what it is.

So neither partie's time lines were correct it was just over 2 days between the done deal and Chris wanting his refund. . . As it stands, there was confusion in the matter, but the buyer did agree on a particular snake it would seem, and likely had buyers remorse afterwards. Since the snake wasn't shipped at that time, unless the seller has TOS to protect against buyers remorse, I don't see the buyer as a bad guy - just changed his mind at a bad time. . . the seller made a mistake by using funds that weren't available, and will continue to make a mistake by not honoring the refund in a timely manner, just as he was paid. Neither circumstances deserved a BOI IMO.

Once a bargain is struck, and an item paid for, buyers cannot ordinarily simply back out of that contract because of remorse.
It is, I agree, always good to have specifics in a TOS.

When the animal is already shipped, I agree. But to FULLY satisfy a customer, unless damages are done in the form of a lost sell, in this instance I believe that the buyer could be qualified for a refund. Again, the OP agrees with this agreeing to the refund, he just simply had no monetary means to make it happen.

But yes, a buyer backing out at the last possible minute, is not the best of buyers. But it does happen.

I backed out right away way before it was to be shipped what you cant see is the pictures of the messages from thye ads I sent that was a snake he said was the same and later said looked just like the one he was pawning off on me, cause he didnt want to give me a quality snake .

The pic on 12/15 8:11 pm shows the snake he had advertised at the time on Kingsnake and Fauna! This guy was only interested in sending me a second rate snake for fear of future competition.

The first one I responded to was even nicer , but he only wanted to send me him worst.It took him like 2hours to back out on the first deal.He should not have had the animals posted if he didnt want to sell them.
