Tony Hurt and SnakeEvolutions Terms $ Conditions (Bad guy)

My name is Tracy Thompson, I am new to on line FaunaClassifieds but ran adds in the old news letter Fauna Classified (do not know if it is the same?) back in the 1980's. I had a small reptile breeding project and put out a price list each year. I was the Host for the D/FW 1990 IHS wile working at the Ft. Worth Zoo Herp Dept from 1989 to 1995. Then worked about a year after that at VPI as there Collection Manger. In or around 2004 I met Tony Hurt and then latter he became a friend of mine.

In 2005 I paid Tony $1500.00 for a year old 1.0 - 650 gram Pastel Ball Python, then he sold me 0.2 - 650 gram Pastel Ball Pythons for $4500.00 ($2250.00 each)

The 1.0 - 650 gram Pastel Ball Python was not a rat feeder as Tony had said, it was a mouse feeder that only ate one mouse a month. It was a problem snake. He said he would take it back, and he did. Then later one of the 0.2 - 650 gram Pastel Ball Pythons Tony had sold to me turned out to be a male not a female, and he took it back as well.

1500.00------ 1.0 - 650 gram Pastel Ball Python (went back to Tony)
4500.00------ 0.2 - 650 gram Pastel Ball Pythons (one was a male, it went back to Tony)
= $6000.00------ Total that I have paid Tony Hurt.
- 2250.00------ 0.1 - 650 gram Pastel Ball Python (I kept this snake)
= $3750.00------What Tony H. owes Tracy T.

Tony told me that he could not come up with the cash ($3750.00) so we talked about other Ball Pythons that he will hatch in 2006 that I could get from him, and we finally agreed on a 2006 Pinstripe Ball Python (at that time they were selling for 3500.00 to 4000.00) And that would take care of the $3750.00 that Tony owed me. Well Tony never did hatch any Pinstripe Ball Pythons in 2006, So when I ask about other Ball Pythons or a payment plan he was very vague in his reply just saying that the 1st one that hatches is yours. This was some time around January 2007. I started calling him and leaving messages, then in March 2007 he emailed and said he has Eggs. 6-21-07 Tony shipped me a 94 gram 0.1 Pinstripe Ball Python that was hatched around 5-10-07. I sent a email and said, don't you think you owe me anything else? 2007 Pinstripe Ball Pythons are selling for 1000.00 on kingsnake so you owe me $2750.00.

On his web site, SnakeEvoulutions.com under Terms & Conditions it states, (Cancellations - No Refunds if we produce your order in the year ordered) Well I had a order in 2006 and all I got was a 2007. And Tony said he could not come up with any refund at all.

Also, this was his last email to me:
Send the pin back. I will send you your pastel males and you can deal with jack.
Im done

I understand that he got the 0.2 - 650 gram Pastel Ball Pythons he sold to me from Jack Briges.
What does that have to do with me? I paid Tony Hurt, not Jack Briges?

So Tony, I am asking you to make it right. Pay me $2750.00

That blows for ya Tracy. Not sure what Tony was expecting by sending you a $1k animal and calling it quits. It looks to me that you agreed to the pinstripe since its market value at the time was the same as what Tony owed at that time. I'd be upset as well to wait 2 years for my refund or animals to cover it then get 1/4 value and attitude to boot. There should've been some better compensation for your refund from Tony. I would think the refund animal ( value of ) was based on the amount that was owed to you. If that was the deal then he owes you more pins or the balance in cash.

Sending your pastel males back and pushing you on to the breeder that sold them to Tony is low class. You didn't pay Jack , you paid Tony.

Tony , what exactly do you think Jack is going to do? Is Jack one of your partners? YOU were the seller , YOU took Tracy's money , YOU find a way to pay it back.

Maybe those words are truer than Tony thinks. Seems the amount of good posts he USED to get are slowly becoming rivaled by the bad guy / questioning posts ( of his ethics ) he gets now.

Tony, Start Making Things Right: Reputation Is Everything In This Business

I have known Tracy Thompson for over 20 years now. He is an excellent herpetoculturist. He worked with me at the Fort Worth Zoo and also for the Barker's of VPI. He knows what he is doing and he certainly knows how to breed herps.

If he feels that he has been wronged by Tony Hurt, then I believe that he has. Tracy has been around a lot longer than Tony and knows a lot more people than Tony in this business. Tracy has given Tony plenty of time to make things right and it appears that Tony has decided NOT to make things right.

Well, like I mentioned in the title of my reply, reputation is everything in this business and without it you are basically nothing.

Tony, if you are reading this I hope that you at least try to salvage what is left of your reputation and make things right with Tracy and the others that have posted here on the BOI. That is unless you plan on disappearing into the night like a lot of others have done in the past. I was hoping that you would be the real deal, but I had a feeling that you were only going to be a quick flash in the pan so to speak. Please do the right thing Tony and at least make some sort of effort to correct the problems you are now faced with.

That definately sucks.

I personally would not have waited until the next egg season for a different animal-as you can never be sure anything will reproduce(well except for feral
cats and annoying neighbors!)

I would definately agree that you do not deserve to take the monetary hit due to the depreciation of the common market price. You are out a couple years time, growth and a possible breeding but that type of compensation is harder to argue for.

I have heard Tony's name around for awhile now , too bad it is ending like this.

You and me have had many deals over the years with out problems like this. In this business I have never done what Tony has done, and you have never done that to me. Even back in the day when I had a customer that paid for a certain reptile, if I did not produce it that year, I payed there money back. If they wanted to wait till next year then I would pay them back, if the market price has changed.

That definately sucks Tracy. I'm glad you posted this, I was thinking of contacting him about some bp's because he's local (and I always like to deal locally when possible), but after hearing about your story and the other thread, I will be taking my business elsewhere!

I hope this issue gets resolved quickly. Take his to court!!!!

He did not take care of the guy with the hets in the other thread, and I am shure he will not take care of me. He would have to crawl out from under his rock first. All I can hope for is these threads will help others from becoming Tony's victims.

And trying to collect in Texas is a joke, people like Tony like
living here because of that. Texas is the toughest state to collect a civil dept.

everyone who has purchased hets?? from him and don't produce any visibles should do a class action suit against him--if he is smart he should get his checkbook out and start writing checks before he winds up in and out of court--the verdict has already been decided here.

I doubt it. From what I've seen on the BOI, he will either A) Come on here, cuss you out and blame you for the ordeal and accuse all of us of being on a witch hung or B) simply ignore it and continue to rip off other unsuspecting people.

I can not believe Tony is trying to pawn you off on Jack. He ends up brokering for Jack and gets burned by Jack. Awwwwwww, too bad for Tony, because his deal with Jack was done, and his deal with you is far from being done. I just can not begin to fathom how someone who trys to pass himself off as a businessman and then when the shyte hits the fan cowers down and gets all defensive. Find out where he works and start calling there. Isn\'t he like a used condom tester or something? He shouldn\'t be too hard to find. Next thing you know Tony will be trying to sue everyone who called him a little prick scumbag snakeoil salesman, for defamation of character because he\'s such a standup guy. BBBBWWWWWWWAAAAAAHHHHH!!!!!

Since you and Tony are in the same state you should go to to the county courthouse and file in small claims, won't cost you much and the form will take you less than 5 mins to fill out and your off...your only 3 hours away and with your emals I think a Judge will easily find in your favor if there isn't more to this than what was posted.. I'd make sure to add lost wages, hotel expenses, gas anything else that might be awarded as well.. He has a choice ..settle up now or later..later will cost a whole lot more than now..
It is rediculous that he is behaving in this manner..wish you luck.
Maybe getting served will light a fire under is arse and he will handle this..Either way he hasn't given you much option it seems.

He is a price of sh*t, the best we can do is to tell others to watch for him.
