Recently we have been in contact with our ISP regarding an email issue. However all the facts are a little sketchy and contradicting to us at this time. But we are working with their legal department to prevent a repeat of the same or similar situation.
But it was come to our attention that our recent message sent to all of our members about the temporary AOL banning that was token into effect for a short period of time was reported for abuse. But after talking to our ISP’s support department, we have a general idea of some of the people in the community who has chosen to do such a thing.
We would like to advise these members that further attempts to deceive either our ISP or hosting company will not be tolerated. As he have also received an email from our hosting company about Mr. Luna’s attempt to shut this site down.
This site is not going anywhere and your attempts will be documented and exposed along with used as evidence in to any potential criminal or civil actions that may arise. Your actions are also an attack on the community, by trying to remove a resource site that has helped many people with their pets. We consider this a direct attack onto the community and our members. We consider this a serious matter. Continued harassment will not be tolerated.
It is also interesting to note that when a certain name was mentioned, that our ISP has quickly turned to a more understanding outlook. A name that was supposedly receiving spam. A name that should not have even received the previous update unless they have created other account which is in direct violation of our terms of service since they were in effect banned due to abuse and various violations of our rules and terms of service.

We would also like to take the time to advise our members that our terms of service and rules are constantly being updated and revised. It is up to you to ensure that you keep up to date with the new revisions.

We would also like to let you know that during testing of our system, we have accidentally sent a test message to all of our members instead of a restricted group. This email is not spam and according to our terms of service is permitted.

We apologize for the tone of this message. However we are attempting to make it very clear to a few certain individuals that we are well aware of their actions and they will not get away with them. They are in the real world now that is governed by laws and not their own personal rules or ideas.

How does FaunaClassifieds.com get away with their actions?
Simple, they allow others to post defamatory comments about their competition by providing a source or means to do so. They do this because they believe they are protected by the CDA or Communications Decency Act of 1996. They operate on the belief that they are protected by the law from liability of someone else’s postings.

What is the Communications Decency Act of 1996?
The Communications Decency Act of 1996 (CDA) was signed into law as part of the Telecommunications Act of 1996. It was passed as a result of Congressional concern to help prevent children from accessing pornography with a few simple clicks of a mouse.
The act was widely criticized and debated as it was poorly written. As back in 1996, not many Congressman and Senators had internet accounts with very little first hand knowledge of cyberspace. It was “the only section of the Telecommunications Act which directly dealt with the Internet, the CDA was seen by many as a knee-jerk reaction in an election year to "barbarian" Internet pornographers”. Basically it was a quick way to ease concern of the public to address a serious problem. It was so poorly written and prepared that in act it was unanimously rules unconstitutional by the U.S. Supreme Court on June 26, 1997 as it violates the First Amendment.

What is the First Amendment?
The first amendment is probably our greatest part of our constitution. The one that affords us all with our rights to freedom of speech.
The first amendment states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

But if the CDA was about protecting children how does it relate to faunaclassifieds.com or the first amendment?

Basically, the Act was so poorly written, it only prohibited our first amendment rights. It allows innocent people to be harmed in the cross fire while protecting the same people it was initially against.
This all relates back to FaunaClassifieds.com as this is the act they hide behind to commit their actions. An act that was founded as unconstitutional. One that prevents free speech and causes censorship. Again, one of my strongest arguments against FaunaClassifieds.com has been that their actions are anti-American and censoring and that they are prohibiting free speech. Hiding behind such an outdate act that has been legally founded to be unconditional and in violation of our first amendment rights serves as proof to their actions.

So does FaunaClassifieds.com support anti-American values and rights?
It sure does. Since it is using the CDA in an attempt to condone their actions, this means they are promoting this act. By promoting the CDA, you are in affect supporting it and what it represents. This act was ruled unanimously to violate our first amendment. Our freedom of speech. FaunaClassifieds.com is promoting anti-American values along with promoting laws in which remove our freedoms and rights. The rights and freedoms that make us Americans. It’s all right their for anyone to see and read. Yet they call other site owners dictators.

Yes, in fact, they already have a dictatorship control in the reptile market. This is why we need to stick together and boycott them.
Since we know that their actions are to suppress freedom of speech and to create their own rules above the actual law, then we can safely establish the fact that they are in essence a dictatorship.
They use the power of loyal supporters to protect their dictatorship control by harshly attacking anyone against their views, opinions, or control. This creates a level of protection around them where they can do what ever they please without fear of them becoming accountable for their actions.

How can you say they can control the industry?
Again, this goes by power. Since they have built up a large group of supporters whom are both heavily invested in both time and money, with the credibility of their names at stake, then they will have to protect their professional interests as due to their own personal best interests being at stake. It’s much harder to go against them then to go along with them.

Of course. Again, anyone that is not with them is against them as I believe they put it. Since it is comprised of many breeders and enthusiast, there is a strong market presence. One that is easier to gain a foothold in when you go along with them and their stance then if you go against them. In fact their rules make it very clear, that you do not want to be against this group as you will be boycotted against and be committing business suicide. And since they are a dominating presence in the community, any single individual has little chance to go against them.

This is a complete paragraph posted on threadid=8880 that is their “Rules for Posting on the BOI”. Blackmail is illegal. It is unquestionably an immoral and illegal act. This is unquestionably blackmail. They are telling you flat out that if you file a lawsuit against someone posting against you, then you will be boycotted and long with receiving damage to your name. Not only are you going to be boycotted against, but so are your clients.
Basically if someone posts defamatory comments that harm your name and they do this on the BOI, and you take legal and ethical actions on this serious issue, you will be boycotted and basically blacklisted in the community. And this is regardless if you are right or wrong. This is a very serous issue. This is a definite dictatorship type of control. One where they alienate your legal rights. This is using fear to prevent people from going against them. Using fear to gain supporters is completely disgusting. Using fear to blackmail people to not do things in a legal manor is illegal.

Obviously the supporters and advertisers need to be boycotted along with FaunaClassifieds.com. As they are supporting this type of activity and funding this type of activity. They are supporting and funding criminal activity and supporting methods t remove your personal rights and freedoms.
As for why their members need to be boycotted. Here is why. These members are supporting this site by continuing to use it. It does not take a rocket scientist to see what’s going on. It’s these members that are attacking other people. It’s these members that are helping then to grow. It’s these members that are keeping faunaclassifieds.com alive. It’s these members that are what FaunaClassifieds.com feeds on. These members cannot hide and justify their actions of using that site anymore as to the extent that “I didn’t know” or “but I am just a member” or “I don’t condone their actions, but”. Sorry, but those are excuses that no longer work. People can see the inaccuracies, people can see the crimes, people know better then to blindly follow and support and site and to attack someone simply because others are. People cannot hide behind excuses anymore. It’s time for people to be accountable for their actions. The truth is out, and FaunaClassifieds.com’s actions are very relevant. People have the choice to make a moral decision. But when they know this site operates in unethical and illegal manors and they continue to utilize the site. This is considered supporting their site and discussions. While obviously everyone’s going to disagree with everyone else, there are some issues that are unjustifiable. Would you knowingly shop at the store that is owned by thugs and criminals? One that the owners are degrading your neighborhood? Of course not, so why utilize FaunaClassifieds.com services? Same principles apply.

But they do expose some bad people, so doesn’t this justify a few innocents from being caught in the cross fire?
Did this justify the CDA? No, of course not. But we need to look at this question more detailed and at some different perspectives.
First, let’s just assume for example that FaunaClassifieds.com was operating in the most just conditions. How can you theoretically justify innocent peoples names from being destroyed and their businesses going bankrupt because you may avoid being scammed by someone that is listed? Many people try to justify their actions in their minds because of this reason. Because someone might get a sick snake or loose $60 in a bad deal. So to make sure that the bad people are weeded out it’s some how ok for the good people to be victimized as well? People spending a lifetime to earn a reputation and lifestyle destroyed because someone is upset because they misunderstood something or are just flat out to get something for nothing. Well not only did the good person get his name and life destroyed by what certain people feel are justifiable, but a criminal has gotten away. Now what’s this good person to do? File a lawsuit? Well not only is their case probably compromised by trying to defend their good name, but they will now be boycotted against and risk business suicide according to FaunaClassifieds.com’s Rules that they have posted. And this is justice? How is this justice? But apparently this is justified in the fact that eventually it will catch up to the person doing wrong. Well maybe. Obviously if they got away with their crimes on FaunaClassifieds.com’s flawed system of justice, they will probably continue getting away with them. Now what about the person that lost everything because of this? His names still ruined and destroyed. Again, this is a real concern that comes up many of times. People try to justify this with those reasons.
Now lets look at another prospective angle of this.
Now we already know the actions that faunaclassifieds.com will go through. We know that they will flat out lie and deceive people. We know that they will flat out frame someone. I have the evidence on this site to show this. So how can you justify the above question? After all, we established that you cannot trust what they say as accurate. So how can you trust anything they say? Yu cant. Just like they make it clear on their site, that once someone is found to be lying, then they loose all creditability. This same holds true with faunaclassifieds.com. We know what lengths they will go through. We know of their corruption. We know that we cant trust what they say or is portrayed in front of us on their site. This means that this site had little if any credibility. So what is the purpose of using it? You know the info is bogus. And if you got garbage coming in, then you will have garbage coming out. You cannot make a valid decision when the facts and truth is distorted. That’s the bottom line. So there is no way you can justify the concern or idea by this manner. Again, it’s only helping one group of people, the ones that are protected within the faunaclassifieds.com. It’s a no win situation for the hobbyist or the rest of the industry. The only ones that are winning are the few people whom are protected behind this empire. One that do have shady past’s and proven themselves as frauds.
And finally many people justify this by saying well hey look, they protected me from being ripped off by so and so. They did? How do you know? Who saids so and so is a bad person or criminal? FaunaClassifieds.com? Well they have little credibility. You don’t truly know this so and so is a bad person. You know so by what FaunaClassifieds.com saids. But you know that FaunaClassifieds.com will make up lies and evidence. You know they will distort the truth and hide the true facts. So you don’t truly know who’s bad and who’s not. And gossip really spreads in this community like a wild fire. So you cant just believe what everyone said’s because chances are the originating source isn’t vary credible.

So then where do I turn to know who do business with and not too or to report problems?
Well to begin, there are non biased groups like the Better Business Bureau and the law enforcement or courts. Turn to the police if you been ripped off. This is what they are there for. Generally its out of miscommunication or error, so try to resolve it first. Or you may also turn to the BBB to resolve this. The BBB had allot of credibility and a tract record. They are unbiased to another’s beliefs in the community and got nothing to win by being deceptive or nothing to loose by doing something against someone. They look at the facts and attempt to resolve the issue. You can contact them to inquire about a business before you do business with them or not. FaunaClassifieds.com is not the way to go about inquiring about people or attacking someone. There is a reason many people speak negatively about this group or is against them or their practices. It’s because of what they do.

I am living proof, a victim of his illegal activates and crimes.
Many people have come to this site to find gecko information. A site designated to be a resource center/portal. I am also a gecko breeder relatively new to the reptile cultivation industry. I am also one of Rich Zuchowski's competitors. I have been victimized severely by Rich Zuchowski.

A Short Intro To My Situation
____ As coming to this site, you know I run a major gecko resource site. In fact, it was rated #1 on the Reptile Top Sites statistical program during our last few months being a member of. We had a substantial lead over the runners up. Well along with this site, one of our secondary sites, the Herpetologists Gecko Forums was moderated my a few members in the community. One of these members we had moderating went by the name of Steven Beckerman, owner of E2macpets. Unfortunately, Steven was unable to follow the rules and even after our clear and direct orders, he chose to violate them and go above our orders by giving his personal business associates special privileges to advertise and spam our forums. In fact, he even aided them in doing so. When I went to correct the situation, he choose to badmouth me to my associates. After he still couldn't get his way, he choose to abuse his powers and abuse on of our members by verbally attacking them publicly. It was clear due to the nature of his attack, he was taking his personal differences with me onto my members. I will not condone abuse to other members on my boards and especially not by a moderator. So I choose the best course of action and made my voice clear publicly in the same thread to let everyone know this was not the voice of HGF or its owners and associates. And we will not condone this activity. Steven then decided to take matters further and complain more to our associates with obscenities and to defame my personal name and Gecko Network on the FaunaClassifieds website in their Board of Inquiries forum. Along with doing so, he violated our copyrights and disclosed private internal material publicly. And this is where my problems with Rich Zuchowski begins.
____ In attempting to defend myself against his false allegations and protect my sites and members, I was quickly attacked, defamed and criticized by the members their, especially the staff. This was allowed to be carried out by Rich Zuchowski. Infact, I was given various warning when providing evidence or defending myself and providing factual information that was important to my defense. Once you accumulate a number of points, your are then banned from the site.
____ In the daily ongoing harassment and attacks against me, I have provided numerous chat logs, email, screenshots and other evidence. I even provided a hostile and scared witness. Anyone in the industry is scared to become subject of attack by FaunaClassifieds as they make it very clear that anyone going against them with my severely punished and their carriers destroyed. This is infact due to the large memberbase of both breeders and hobbyist in the industry being actively involved on the site. But the staff would dismiss any evidence presented. And this was even with Steven Beckerman unable to present any evidence. I was even questioned and attacked as to why I would even have all this evidence. But anyone that owns and operates an major site on the web that deals with the public in a personal manner such as I do will quickly learn from experience as I did to keep anything that my be of legal importance. Especially when you have been through similar problems with other members in the community.
____ But because Steven was a previous active member on fauna and continuously brown noses to everyone, he has made strong alliances with these people. He has also played directly into the sympathy of Rich Zuchowski and the members their with the subject line in reference to "Another Kingsnake". It doesn't take long to become familiar with the personal hatred Rich Zuchowski and his members hold for Kingssnake, a other competing site. So that alone set the tone against me and my site as to them I am nobody by a competitive threat, as it doesn't take long to figure out I also am attempting to run a number of community based services that would be in direct competition with Rich Zuchowski's services. Especially when my site was gaining in popularity at the rate it was going and quickly buried the directly competitor gecko sites in popularity.
____ During these attacks I received many harassing emails one with a virus included, phone calls, attacks on my forums, attacks on other forums, and ext.. They have used many cult type practices and physiological techniques to run me down. Some of the ways techniques I have been exposed to where sleep depuration, metacommunication, removal of privacy, disinhibition, verbal abuse, forced confession, finger pointing, isolation, controlled approval, no questioning, guilt, and fear. Other cult practices that I I have noticed take place on their site are peer group pressure, love bombing, rejection of old values, confusion doctrine, uncompromising rules, group conformity, confession, financial commitment, chants and phrases (by using various common generalized phrases), and portrayal of group protection.

Here is a universal definition but by far not the only or an conclusive definition of a cult:
CULT - Any group which has a pyramid type authoritarian leadership structure with all teaching and guidance coming from the person/persons at the top. The group will claim to be the only way to God; Nirvana; Paradise; Ultimate Reality; Full Potential, Way to Happiness etc, and will use thought reform or mind control techniques to gain control and keep their members.
This definition covers cults within all majopr world religions, along with those cults which have no OBVIOUS religious base such as commercial, educational and psychological cults. Others may define these a little differently, but this is the simplest to work from.

____ But dealing with fauna and the people their of, I have even resulted in personal injury. Because of lack of sleep trying to defend my name and reputation, I had fallen down the stairs and in doing so, injured my tailbone. But the extent of the damage is still yet unknown. I had also nearly loss a figure as well when my dogs got in a fight right in front of me and I tried to push them out of the way. Unfortunately, I was under so my fatigue, that I placed my hand in the wrong spot and my thumb was caught up in one of our dog mouths. He bit completely through the skin numerous times to the bone as I bled profusely. I have unable to use my thumb and hand normally for a number of weeks loosing that much time in work as I require the use of my right hand for my mouse.
____ But these are just some of the problems that have occurred. Their was even a time were I exposed Steven to defrauding the public with screen shot evidence which I was was quickly attacked, and harassed. Because I was showing the Ritchie Luna's lies and proof of what I have said so well, the whole thread was hidden from public view. But this is the type of actions Rich Zuchowski allows to take place on his site with his direct involvement in.
____ Even his privacy policy is not followed. A legal document set in place by law to protect you on what and how information is used. Here is a copy of their privacy policy as stated on June 15 2003 and was this way as far as I am aware of.

Infact I remember reading a post where Rich Zuchowski was completely against spam. Infact, I believe he was arguing about spam. It's real interesting though that once money is involved, his position changes on the situation real quick. And he violated his members trust and his own privacy policy, a legal agreement he has made to his members. You has violated their rights and broken the law. He is a criminal seeking financial gain off his crimes. Both of these sites are commercial based sites to make an income. These are separate sites from FaunaClassifieds.com. They have different intents, names, services, and domains. FaunaClassifieds.com has been mention many times over as a site note to make profit from or one where he doesn't make money from. It is it's own entity. Yet I have received spam email advertisements to yet again violate my rights he publicly promised. This is just more proof of the ethics and actions of this person and his actions. More support as to why he should be boycotted and not trusted. More proof that when financial gain is involved, he will violate your rights and break any deals or promises made to you.
____ It's very clear that on the BOI forum, if you are found even in error of information you say, you are considered lying and a bad person. Someone that should be avoided. Their is no second chances. Their is not room for error. You cannot delete or edit posts in this section. Even when it has nothing to do with the topic at hand and invades another's personal freedoms. IT is forever public and available to use against you. Whether true or not, accurate or not, accidental or not, a typo or not. It is considered final and as written. ____ I have now been banned for trying to defend my name. I have been harassed my both email and on my forum and others my members of their staff. Even my family is now in a state of implied threat with one of the latest emails addressing the research of my family members by first name basis and my location. Regardless if the information is accurate of not, it is still a implied threat to me and my family. Information that is not made publicly available without researching and piecing pieces together. Information that should not even be relevant for any other reason other then to make an implied threat.

They will and do stand as a group to blindly support each other, even when evidence is providing right in their face. Evidence that cannot be dismissed by a non biased person when followed. They work on a principle that people will blindly follow them, and many of their members blindly follow. The members that do not are too scared to say anything and fear the same wrath. You witnesses will also be harassed and attacked as mine until they keep their mouths quite where then they are complemented for not saying anything and staying out.
____ This is why this site, its owners, and even its advertisers, supporters, and certain members that are participating in this type of activity need to by boycotted against. It's time to put an end to the abuse. An end to the criminal activity in the industry. An end to the businesses and people that violate the antitrust laws. And end to the people the benefit from other peoples misery. To the people that think this is a game when they are dealing with people lives. People with an irrational way and biased way of thinking. Where people have proven to put financial greed over their mouths and agreements made. They have organized a system of protection in which the only people that are protected are them. They are free to harm and so as they please without anyone stopping them or going against them.

Familiar Territory
____ Rich Zuchowski is no stranger attacks of competing sites. He appears to have a history of personally motivated attacks on competing sites. Such major names as Kingsnake and SSnakess. also appear to be victim to his terror. Due to various reasons, it seems that he looks for ways to allow for conflict, to justify his actions. Weather right or wrong, these actions only appear to be justifiable to him and his members. Yet these other sites have to face his wrath. And taking his vengeance to the extreme is hardly overlooked. Theirs been admitted "boycotting" to these other community sites designated to help the community. But this is only after boycott's have sprang up against his site and his actions. Only has any attempt been made to correct his image in the publics eye been made. But even his attempts only appear to go so far, far enough to deceive visitors as if he is cleaning up his act. Only to be a loaded spring, looking for ways to continuously attack any threat in any manor he sees fit regardless if it is right or wrong.

What are Competing Sites
____ Well a competing site is generally any site that is in the same trade or industry aiming for the same members. Many of us have a hard time considering Fauna as a competing site because of the nature of their site. Even they use this to their advantage to justify that they are not in a competing marketplace. This is because sites such as this one and others, the main goal is to educate the public on reptile care. However the main draw of traffic on fauna appears to be something different. A place to inquire information on people. While this is generally left to now one forum. It does appear to be the main goal and audience. They do have competing forums. While these forums are not very popular, he does run a cornsnake specific group of forums. It is also well known that one of his goals is to run a gecko specific group of forums as well as noted in some of the discussions that take place. One of the popular deceptive tricks is to say they are not even a competing forum. But truth be told, their is a strong personal and professional image and motive to eliminate these site. One to help create a monopoly in the market place. One to control information. One to profit off the site in one manor or another.
____ Information sites are a tool by breeders to draw in a market group. Unlike what some would like you to believe, information sites are not a burden on the owner that is generally a breeder or product seller. It is a marketing tool. Rich Zuchowski sells cornsnakes leopard geckos, and other reptiles. He is gathering a market base toy sell his product to. While the site may not directly make a profit, it is considered as a marketing strategy. A secondary system of advertising. A way to market one product to another. The reptile industry is big business. Were snakes can sell for $30,000, making a profit of nearly $30,000 off of one sale. Their is little investment needed with a high level of return. This has always created strong competition where competing businesses use illegal practices to eliminate the competition. While saying a site is only of a financial drain to a large breeder is only justified by false presentation. The truth of the matter is, it gains a competitive advantage over the competition. One where it draws in clients. One where it is an advertising source.
____ Now I'm not saying that a site is souly an advertisement, They may provide a valued service. They may actually be more then that. Such as this site. While yes I do admit to eventually sell reptiles. But their are other goals with some sites like this one. Goals such as informing the public. Creating a center to find information conveniently and easily. A place to find the most accurate and trusted information. A place to interact with others.
____ One of the main goals of this site is to provide information freely available. To help people with their pets. It is both a hobby and business. But one of the goals is to do it in such a way were information is not biased my marketing and trade ideas. One where people can be sure to find information that is not subjective to marketing motives. So its been a long strategy to find ways to do this and not make this as a walking billboard for my personal professional endeavors. This is not an easy strategy. You do have to provide ways to make products available to the public as they do demand to find it. You do have to find ways to justify the experience and pay the bills. A site like this requires a great supply of labor to keep running. It does have it's own bills. And it is intended to be a separate non-commercial entity, souly an information based non profit site designated for research. But as with all sites, their is some sort of reward. My greatest reward is knowledge.
____ So please do no be fooled my a false face that is portrayed. Just because certain information is given by fauna, doest mean their are other motives. Their are. They have been clearly displayed. they will always try to justify these actions in ways to deceive you._
