• Responding to email notices you receive.
    **************************************************
In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

  • IMPORTANT! PLEASE READ!! About the Google Adsense ads being displayed

Yeah, I know. They are a pain in the butt. But they pay the bills to keep my server running. Just a fact of life, I am afraid.

Want to get rid of them? Simple. Just become a Contributor level member or above and they will be gone. -> Please click HERE."

Is that too much for me to ask of you to keep this site running? Well, sorry about that. I too wish I could get everything for free. But alas.....

    =====================

Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

I seriously doubt it.... In my opinion, the use for which the photos were posted was a FAIR use of those photos. They were used strictly for the purpose of identifying someone allegedly engaging in criminal activity. As such, they definitely serve a useful purpose which I doubt anyone would consider as "unfair".
You can think that, but I don't doubt that he could make a case to the opposite effect. In any event, the photos are not "public domain". If your provider received a DMCA complaint it wouldn't be worth your effort to fight it. If you did, my guess is you would lose, if for no other reason than the fact that the photos contain images of a child who has no involvement in this situation. The concept of "fair use" doesn't necessarily deal with "fair" and "unfair".

Proprietary Rights in Content on Photobucket.

Photobucket.com Terms of Use Agreement
6.1 Photobucket does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you post on or through the Photobucket Services. By displaying or publishing ("posting") any Content on or through the Photobucket Services, you hereby grant to Photobucket and other users a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the Site in any media formats through any media channels, except Content marked "private" will not be distributed outside the Photobucket Services. Photobucket and/or other Users may copy, print or display publicly available Content outside of the Photobucket Services, including without limitation, via the Site or third party websites or applications (for example, services allowing Users to order prints of Content or t-shirts and similar items containing Content). After you remove your Content from the Photobucket Website we will cease distribution as soon as practicable, and at such time when distribution ceases, the license to such Content will terminate. If after we have distributed your Content outside the Photobucket Website you change the Content’s privacy setting to "private," we will cease any further distribution of such "private" Content outside the Photobucket Website as soon as practicable.

The account was marked public not private.

The salient point here is:
After you remove your Content from the Photobucket Website we will cease distribution as soon as practicable, and at such time when distribution ceases, the license to such Content will terminate.

I read that. That's why I said I would remove the photos from Photobucket's server. Then the license terminates.

I would think it would be important to point out that the individual doesn't admit to ownership of the photos only that he appears in them. People have their pictures taken everyday and posted without their permission and broadcast on news outlets including reproduced in newsprint.
The photos belong to a person in possession of stolen property that went by the name of "Arnaud Moi". Interesting that the latest email is from a "Sébastien Moillard.

Avoiding further disgrace to one's family is also a strong motivator to make things right and mitigate the disgrace.
I can understand the concern of the parent (uncle? lol!) of this child having his photo plastered all over the place like "wanted posters". After all, the the child has committed no crime and is faultless for having a father that is a liar, thief, and fraud. But, I would think that an expose' of this nature would certainly be a motivating factor to make expedient restitution for his criminal actions.

ha!

Let him sue me...

Now, it's very simple :
I ask you to delete these photos from your forum.
I ask you to give me all the details of the administrator for direct contact because I need them to call you and communicate the information to my lawyer.
I am not asking for the elimination of the post but I just want you remove photos that do nothing and who are my privacy.
I also know that I contacted my family lawyer for the prosecution via computer commison and freedom if this is not done.
I think you will understand that the photos have nothing to do with the subject.
It seems to me that the dispute is resolved.
Regards
Sébastien Moillard
Mr. Moillard, (or should I say Mr. Gourami?), I recommend that you save your money. You will need it for a different type of lawyer when you are being prosecuted for international theft and fraud.

If you truly are not Mr. Gourami, you will still need a lawyer to defend you for aiding and abetting a criminal, and interfering with the administration of justice.

If and when this gentleman shows up in the USA with his attorney, I will let it be known when and where so papers can be served while he is on USA soil.

Randall, I see you made it home ok. It was great seeing you this past week. We must do it again in Mexico next year
Cheers,
Ken

No real updates yet Randal. I am still in contact woth Nicolas and he gives me his word that he will send me $1500 more this week.

Nicolas, Arnaud and a lot more of names.

Just the day that I came back from the Hamm show, A&M Geckos had contacted the guys(Drago Reptile shop) who picked up the Geckos at the show. But the damage was done, the geckos were send to Nicolas. We informed all the forums, who I think also contacted you guys, but he was selling all the gecko´s thrue a middle man who didn´t know anything about the scam. The prices were very, very low and the mayority of the animals were sold. This guy has a lot of problems in Spain because he has scammed a lot of people but the thing is that he also has a lot of happy customers who are defending him.

Last but not least I can confirm the story of Michel Klumpers because I was the one who warned him for Nicolas or whatever his name is.

Kelly, I hope that you will get your money very soon to leave all the negativity behind you and go on with the thing why we are here for after all, REPTILES!!!!

regards

Steve (Premium Reptiles)

p.s. the week is over after your last message. Any updates??
