On or around June 16, 2009 Ryan Kerss and I agreed on a trade for some pythons. I would trade him my adult pair of Irian Jaya Carpet Pythons (Morelia spilota harrisoni) for his young female Tanimbar Scrub Python (Morelia nauta), young female Southern Scrub Python (Morelia amethistina), and a young female Halmahera Scrub Python (Morelia tracyae).
On June 22, 2009 I shipped (UPS Tracking Number 1Z14W5622494938436) the Irian Jaya pair to Ryan Kerss for delivery on June 23, 2009.
Ryan Kerss received and signed for the package containing the Irian Jaya pair at 9:55 A.M. June 23, 2009.
Ryan shipped the three Scrub Pythons to me on June 22, 2009 (FedEx) for delivery on June 23, 2009. I received the package containing the three Scrub Python June 23, 2009 around 1:00 P.M.
Ryan and I talked on the phone and email quite a bit and in October, knowing I'm a Scrub guy Ryan asked if I would be a moderater on a website he was starting scrubpythons.com
Around April 7, 2010 I started hearing Ryan Kerss had quit him job at IQW and that most, if not all the Scrub Pythons he had sold/traded during his employment at IQW were not his but were bought by IQW, and IQW never received payment for the Scrubs. I asked around a bit more and after hearing the same story over and over, I contacted IQW and they confirmed what I'd been hearing about Ryan. I told them about the trade I had done with Ryan and they reviewed their invoices and confirmed that the Scrubs Ryan traded me belonged to them and they never had the adult Irian Jaya pair in their inventory. I apologized to them and told them I had know idea the Scrubs were property of IQW. I told IQW that I wanted to make things right on my end and offered to pay for the three Scrubs Ryan sent me in trade. IQW declined my offer saying they were not after the people that received Scrubs from Ryan.
I contacted Ryan and asked him for receipts or invoices for the Scrubs and who he purchased them from and how they were paid for. He told me he would get them for me. I didn't hear back from him so I gave him a call, and he stated that IQW had the invoices and he could not get them. I then asked him if our trade was between he and I or IQW and I, he responded that the trade was between IQW and I. I told him that was news to me and that the emails were from his own business email [email protected], and that there was never any mention of IQW before. I questioned him on posting threads saying the Irian Jaya Carpets were his and talking about how he got them from me. He told me he was trying to promote them to sell for IQW. I again told him that what he was saying did not add up as he talked about hoping breed the pair in the threads. I asked where the pair was now and Ryan replied that IQW had sold the female to a pet shop for $125 and the male at a show for $250. I asked why they would sell a pair valued at $800 for $375? I told him that wouldn't even cover what was paid for the three Scrubs. Wholesale value is over $500 for the three Scrubs. He responded that's just what they were sold for. We went back and forth a bit more on the phone and he wanted to talk to his attorney and he would call me on Monday by 12:00 A.M. his time. He asked me to not contact IQW until he called me back. He didn't make the deadline he had set. I sent him an email that stated he needed to ether send be back the Irian Jaya pair or their value at the time of the trade. Ryan cut off communication after that email even after requests for him or his attorney to contact me.
I told Ryan many times that he put me in a tuff spot with all this mess and I wanted to go ahead and pay IQW back for the Scrubs as the last thing I wanted was to get a nock on the door from the police saying I was in possession of stolen property.
Yesterday May 10, 2010 at 3:36 P.M. I received a call from a Sergeant of the Collin County, TX. Sheriff's office requesting information on the trade I did with Ryan. I'm in the process of gathering emails and a preparing a statement to email the Sheriff's office. I'll also be filing a report for the Irian Jaya Carpet pair as stolen.
I made two attempts to contact Ryan after I received the phone call from the Sheriff's office in an attempt to resolve this. I left a voicemail message on Ryan's cell phone the first attempt and after the second attempt, Ryan called me back at 8:49 P.M. Ryan is clamming that IQW is trying to set him up saying he stole $20,000 in reptiles and money. I again told him that I needed the Irian Jaya pair back or the value of the pair at the time of the trade, as I'm planning on reimbursing IQW for the Scrubs because I don't want any of this coming back on me and that IQW should not be out the funds for the Scrubs on a trade he and I did. I reminded Ryan that all the evidence points to the trade being between he and I and not IQW and I. I asked again why he would post threads claiming the Irian Jaya pair was his if they belonged to IQW and that IQW has no record of the Irian Jaya's ever being there. Ryan told me he had know idea where the Irian Jaya pair was and he has no money. He said he could ask his Dad if he could barrow the money, but then change his mind saying that would make him look guilty. I told him I'd give him until tomorrow night (May 11,2010) to try and find the Irian Jaya pair. Ryan agreed and assured me he'd give me a call tomorrow (May 11,2010) and if he didn't get me he'd leave a message. I was home all day and no call from Ryan.
I'd like to add that more than once Ryan told me that if the Irian Jaya pair produced any offspring he would send me one or two.
