Soliciting opinions on a deal that has the possibility of going sour real soon here. The big question is, when is a deal considered dead in the water. My situation involves my having paid for a trio of snakes from an individual in Southern California (I'm in Northern) back on the 24th of August. The snakes were to be delivered to me that week, yet didn't arrive. He sent me a tracking number, but records showed it never left Southern California and was shipped back to the sender (he used the Postal Service). His message to me was that the animals had been refused at my wife's work and that's why they didn't arrive on time.. This was later found out to be false when I had our local Post Office run up a sheet on the item (which clearly showed it never reached Napa)and he acknowledged such. Next the item was to be shipped prior to the disaster on September 11th. Granted that took us all by surprise and really made shipping all but impossible, so I let the fact it didn't arrive that week slide. That following Monday I called him about the snakes only to find out he didn't know how to send them anymore since the post office would not accept live animals. I suggested Fed-Ex, of which I waited the entire week to see again nothing delivered. That brings us to this Monday, of which I contacted him again about the snakes. His response was "I didn't ship last week because it was too hot here". Now I know with my business, and shipping, if there's delays I notify my customers, not leave them hanging and wondering. He ensured me he would ship Tuesday for Wednesday delivery and would phone or e-mail me with the tracking number (of which I still have his e-mail stating this saved). Well here it is Wednesday, no snakes and no tracking number. These snakes were picked up for a specific purpose (I have a show I'm a vendor at on Saturday and Sunday). I put in a phone call to him today, of which there was (surprise)no return call. My big question is, should I consider this deal dead and demand repayment of my money. I did send this money via a USPS money order, so it is a federal violation. If the animals are not here by the time I head off for the show on Friday morning, they're of no use to me as I don't plan on raising them and breeding them.. What would some of you do in this situation.

Kill the deal if you cant get them in time to sell them at the show. The seller has made to many mistakes for my book. Granted the WTC dissaster kinda screwed up shipping for a while but thats no excuse for not contacting you. Just my oppinion.

Try to get your cash. I to had shipping problems because of the WTC. Mine were sent out MON. the day before. And were stoped before they ever left CA. However My seller was still able to get the snakes to me even after the USPS returned them to him. So if shipping were possible for him it would have been possible for your guy. Hope it all works out for you. GOOD LUCK.

Sounds like a dead in the water deal to me. I would contact the seller requesting your money back. No need sitting on the fence waiting on this guy/girl. If I can't ship, I tell my buyers why as soon as possible.

He's promised to refund the money after a barrage of e-mails, phone calls etc. from me. Told me I must not understand how hard it is to work 7-3 each day .. Must be a real tough life.. Explained to him I spend at least 3 hours a day just in traffic commuting to work, plus 9 hours at the job working in a major Biopharmaceutical firm, then head home to my wife, 5 year old and 10 month old sons. This on top of keeping over 200 reptiles in peak condition health-wise... This kid has no idea what life will be like for him in another 10 years or so.. Anyways, I'll keep you all updated on the status of my refund (Thursday was the day we e-mailed/spoke for the last time). Won't be posting for another month and a half on this topic if it takes him as much time to find a mailbox as it did for him to attempt to ship a trio of snakes ...
