    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy Ken Marino of Phoenix is a thief and scammer, beware!!

Ken if I were you I would definitely encourage your lawyer to put extra effort on getting those criminal charges filed. even if it's for something petty for the moment and then more serious charges can be brought on later. The reason being is that since he's on probation any additional charges filed against him or arrests would immediately put him in violation of his probation so even if the initial charge doesn't stick he'll automatically go to jail for violating his probation which he might be able to beat but at the least it's going to cause him a lot of temporary grief and then when the real charges come on he'll once again be in violation of his probation.

So even if he doesn't go away for a while for scamming you and others he'll probably end up going away for that drug charge. Just something to consider.

It's only because of people like you that help to put an end to people that think they will always get away with their illgotten gains until they go up againest someone such as yourself. I wish I was in the states and able to get Andy Charek, I would also go at him with everything I've got and even more, not for financial restitution but for sour taste in his mouth to always be wary of ever trying to scam or even think of having any ill intentions again.

Update

I just wanted to update folks on what's been going on in my duel with this loser. I tried filing criminal charges, but the Phoenix police dept would not do anything, even with my lawyers urging. So we sued him for $15,000. He never responded to the court papers he was served, so I won a judgement for the full amount by default. We were just about to put a lean on his house, car, and any other property we could find, and the court was going to order a monthly restitution with interest. I got a notice from the bankruptcy court in Arizona that he and his wife have filed for chapter 7 bankruptcy. My lawyer is looking into contesting it, but in most cases it's pretty hopeless. So it seems that he was correct in saying I'd never get a dime out of him. At least his credit is trashed, but it makes me wonder how many other people he's done this to, and how many others he'll do it to again.

On a side note, I will find him in person when I have the time, sooner or later. I would love to have a chat with him in person. I'm sure it would be interesting.

So that's it for now, in case anyone was wondering what was going on. Cheers
 
Thanks for the update, Ken. Damn shame that even the PD seems to have dropped the ball ... let a thief and scumbag get a pass and screw the victim. I just don't get it sometimes.

Hi. I personally met with a detective and finally the precinct caption, to no avail. I then paid an attorney to do it for me, but once again, even after speaking to a judge, nothing. So I sued him instead. I won the lawsuit, but then Marino and his wife filed bankruptcy, so that pretty much halts just about eveything. We will more then likely contest the filing, but that usually does no good at all. And since it's chapter 7, he's going to get rid of all his debts with no intent of ever paying them back. He'll lose most of his stuff, but will legally be able to keep his house and one car. At least that's what I understand. I'm not a lawyer, so I can't say for sure. It was a good fight, and I actually won the battle, but lost the war. Nothing I can really do now short of a baseball bat or jar of gasoline, and I'm not really pissed enough about it anymore to bother with those methods. I wrote off the loss and the attorney fees on my taxes. At least that's something.

Uh, what happened? Still investigating, or still looking for him? Seems to me, you have a complaint for a sizable amount of money, and you KNOW where the guy is, you go and get him. :shrug01:

Richard, there is not investigation anymore. The police found him and asked him to come in and answer some questions. He declined. They said OK. That's about it. They were useless. Said they could find no crime, and that it was a civil case. So I had it tried in civil court and won. Also useless. Live and learn as they say. I'm not done with Marino yet, but I regret that I'm not willing to post on here about any future plans. ;)
 
Well, Marino won't have an easy time of financing his next vehicle, and they don't last forever. This will follow him a looooong way.

I'm really happy to have made a purchase from Ken Foose in Feb. He's one of the good guys and awful this happened. Knowing I helped to fund your endeavors with this Marino guy in a small way and getting a great snakey in the meantime. Now I wish I had gotten a pair :)
 
I only read three (3) pages of this thread (due to the EXTREMELY SLOW Internet connection I have out here in the sticks right now), so please accept my sincere apologies if I am simply repeating here what anyone else has said on this thread-
Have you considered federal charges for wire fraud and/or mail fraud, because this guy defrauded you via a telephonic offer, and he received the payment by mail.

I realize that:

-someone may have mentioned this already,
-this advice may be useless and inapplicable in this matter,
-you may not have specifically pursued this avenue with the feds if your previous contact with them was summary,
and/or,
-law enforcement, especially local, may want to decree it a "civil matter" , like many other similar things, so they can promptly ignore the complaints.

All that said, if you haven't done so already, I would at least check into mail/wire fraud charges, and if your complaint seems in any way tenable I would go to the FBI and allege those specific charges, and if you get no joy that way (or if you have already had your specific allegations of wire/mail fraud summarily dismissed by the FBI), then I would meet with the Attorney General of your state (likely an Assistant Attorney General, of course) and escalate the complaint thereto.

Regardless, I wish you much luck. I absolutely abhor a scammer.

Anyway, Marino filed for bankruptcy, and then never paid the filing fee. So my lawsuit against him goes on. My attorneys are taking care of this at this very moment. If anything new arises, I'll let you all know.

You may be able to charge him with Mail Fraud. But one other thing you can try is the media. Here in St Louis, they have short news segment on people who rip off other people. For example, last night they aired a story on a contractor who took money from several people but never did any work at all. They even followed him around with a camera and tried to get answers.
