Ken if I were you I would definitely encourage your lawyer to put extra effort on getting those criminal charges filed. even if it's for something petty for the moment and then more serious charges can be brought on later. The reason being is that since he's on probation any additional charges filed against him or arrests would immediately put him in violation of his probation so even if the initial charge doesn't stick he'll automatically go to jail for violating his probation which he might be able to beat but at the least it's going to cause him a lot of temporary grief and then when the real charges come on he'll once again be in violation of his probation.
So even if he doesn't go away for a while for scamming you and others he'll probably end up going away for that drug charge. Just something to consider.
