In February of this year, I became aware that Richard Stubbs of Global Tropical Reptiles (Import/Export) was using some of my photographs to help sell reptiles off his website (http://global-reptiles.com) and claiming the photos to be his own. The three photographs in question are:

- A Leaf Chameleon (Brookesia thieli) photo (http://global-reptiles.com/images/BROOKESIA THIELI.jpg)
- A Four-horned Chameleon (Trioceros (=Chamaeleo) quadricornis) photo (http://global-reptiles.com/images/chameLEO QUADRICORNUS.jpg)
- and a Giant Carpet Chameleon (Furcifer cf. lateralis var. "major") photo he has incorrectly labeled as a Peacock Chameleon (Trioceros (=Chamaeleo) wiedersheimi) (http://global-reptiles.com/images/CHAMELEO WALDERSCHMIDTI.jpg)

These photographs are my own personal photos that I took of my own personal collection in 2006. I shared them on a forum thread at the time (http://www.chameleonforums.com/photos-my-collection-dialup-warning-894/), which is where the photos were taken from.

According to Global Tropical Reptiles' Terms of Use:

Please remove my photograph from your site immediately.

After not hearing anything, on March 6, 2010, I called him on the number listed on his website, which he did not answer but gave his cell phone number in the message. I called his cell phone and he answered. He informed me he was in Mexico and that if I sent him the information again, he would have the photos removed as soon as he got back. I forwarded the above email with the following message that day:

After hearing nothing from him and with the photos still on his site, I called him once again on August 8, 2010. During this conversation he once again asked me to resend him the information and he would have it taken off. When I told him that this was the same thing he asked me every other time and that I felt like he was just telling me what he thought I wanted to hear to get me off the phone, he got testy with me telling me he didn't need my photographs and he would taken them off. I demanded he tell me exactly when they would be off, to which he initially replied "whenever they get taken off" but he finally guaranteed me by the end of the week. He claimed that he never got any of my previous emails, so I verified his email address with him and told him I'd send it from multiple email accounts this time to make sure it didn't end up in his spam. After getting off the phone with him, I sent the following email from 4 different email address ([email protected], [email protected], [email protected], and [email protected]):

It is now Saturday and the week has ended and my photos are still on his site.

While this process was going on, I was also working on having the photos taken off his site by his hosting company. On March 11, 2010, I submitted the following takedown request to IX Web Hosting:

Dear IX Web Hosting,

I am writing to you regarding the website global-reptiles.com. It is my understanding that you host this site. Global-reptiles.com, has been stealing copyrighted materials from me and utilizing it to facilitate the sale of their product. I produced this photographic content, and I own all rights to this content.

This is the copied content (three photographs): http://global-reptiles.com/images/chameLEO QUADRICORNUS.jpg ; http://global-reptiles.com/images/CHAMELEO WALDERSCHMIDTI.jpg ; and http://global-reptiles.com/images/BROOKESIA THIELI.jpg

On March 8, 2010, I received the following reply:

Hello Chris.

I would love to be of assistance in this matter; however, for me to do so I need some information form you. Please provide the copyright showing that you in fact own these pictures and we will immediately take action to have them removed. Until we receive this documentation, we will not be able to do anything as the pictures; while identical, are not watermarked nor does it mention that they are copyrighted and therefore it is not clear that you own the pictures or our client. You can either fax in the documentation at 614-777-1699 attn Dianne Reynolds, or you can attach it to this ticket. In addition to this documentation, please also include a DMCA complient complaint. Below is the best format for said complaint.

1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon as well as any supporting evidence as proof such as a copyright number or certificate.

2. Identify the material that you claim is infringing the copyrighted work listed in item #1 above.

3. Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."


4. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

5. Sign the paper and either attach it to this ticket or you can send it to our offices at (614-777-1699) attn Dianne Reynolds.

Once we receive correct legal documentation in this format we will act to rectify the issue if one is proven.

At that point, I began the paperwork to submit my photographs to the US Copyright Office to have them officially registered. While photos are protected by copyright from the second they are taken, in order to enforce copyright in court, photos must be registered with the US Copyright Office and a Certificate of Copyright issued (a process which can be done at any point in time). I finally finished the paperwork to have my 2006 photos copyrighted and I sent in those forms on June 5, 2010. They were received on June 10, 2010. My check for the fees to register these photos was cashed by the US Copyright Office on August 12, 2010, so I should receive my Certificate of Copyright any day.

Once it is received, I can submit a Takedown Request to his hosting company fulfilling their requirements and pursue compensation for the use of my photos through the courts. Throughout this entire process, had Richard Stubbs taken the photos off his site, I would have dropped the issue. At this point, he has jerked me around for 6 months and I'm fed up.

As the owner of the website and the company, Richard Stubbs is responsible for all claims and content on his website. He is using my stollen property on his site to facilitate his own sales. He has lied and fraudulently claimed to own the rights to my photographs while proclaiming a clear understanding of the legality of stealing photos in the process. He has told me repeatedly he will remove my photos, which he has not done. These to me epitomize the worst qualities in any businessman and I would never do business with him or any of his companies, reptile related or not.

Even better, if you know a lawyer, have them send a Nastygram with the phrase "NOTICE OF INTENT TO SUE" across the top and that works really well too.

Flatlander - I didn't think I needed a Copyright Certificate to have a DMCA Takedown Notice enforced either, however in the hosting company's reply they said:

So, it seems that even though I showed them where the photos were taken from, they are requesting proof that they are mine (specifically a copyright number or certificate), not just a statement indicating that and the link to the source.

At any rate, that documentation has taken a long time to get but it should be arriving any time at which point there should be no question I own the images.

I definitely will follow through with a letter from a lawyer if he doesn't decide to start taking this more seriously. I spoke to his secretary this morning (he was too busy with other things it seems) and she now has all the information regarding which photographs of mine he is illegally using as well.

This may be a bit OT in a way, but reguarding that warning message, my favorite bands website had that pop up as well a little bit ago( now, its no longer poping up. But here is the reason why google has put up the warning message so everyone can actually read it. It does state that a 3rd party could have hacked it. * i am in no ways defending global reptiles, but this issue with the pop up- he could have absolutly nothing to do with it- or he could. But at least its posted here for everyone to read for themselves.

Contact Carolyn and take this :censored: down. Its because of people like this that I have to plaster large watermarks over every image I place online. Not only is she a copyright attorney... she is also a photographer. She could probably have a field day with your case. He has shown blatent disreguard for copyright laws and has shown intent to use your photos to make money.

RG - photo theft

Hi Chris -

I am amazed that this low-life didn't immediately remove your photos out of embarrassment.

I have a BFA in painting and illustration and over the years I have stumbled upon some of my artwork that was taken from THE VIVARIUM or other places and used for business cards, hats, banners, etc. Some people don't get or don't care that this is copyrighted material just the same as the articles, etc.

Your photos are amazing and you have invested countless hours and dollars in the hot sun, swarmed by mosquitos, to get them.

As a side note, there was a Richard Stubbs who used to be in the import business and was implicated in some illegalities about ten years ago and my recollection is that he was banned from being involved in the animal business for a number of years. I think he was an accountant in Colorado. I wonder if this is the same guy and if his ban is actually still in place. Does anyone out there know this history?

Tyler - It's does seem suspicious, but who knows.

Janet - Absolutely, his site could easily be a victim to a third party attack. As angry as I am about this all, I assume his failure to remove the photos is more a result of either not caring about my rights as the copyright holder, being too lazy to do anything about it, or thinking I'll just give up and I would hope he wouldn't stoop so low as to actively attempt to add a detrimental code to his site knowing I was watching his site. Who knows, of course, but I'm trying to give him the benefit of the doubt.

Kevin - Thanks for the link you sent me. I definitely think Mr. Stubbs showed willful intent to infringe on my copyright based on the clear understanding of copyright laws he showed in his Terms of Service. Also, because he is using my photographs to aid in his own profit, I likely have a case to seek any money he made selling those species. We'll see and I'll definitely let you all know how everything goes.

Russ - Thanks for your compliments of my photography. While I would say that these three images are not my best work and my photography has increased in quality dramatically since these were taken, as you said, a lot of work, time and money goes into producing these images and they represent what I believe is a valuable subset of my ongoing attempts to build a diverse collection of reptile photos. Obviously they are also good enough for him to think they would help his sales and so he has sought to profit from the work, time and money I've invested without my permission.

I'm very curious about whether this Richard Stubbs is the same Richard Stubbs you remember. This individual is from Colorado as well (the address given on his site is 1710 S BROADWAY , DENVER, COLORADO 80210 USA). I too would be interested to know if anyone knows if this is the same individual or knows the details of his ban from involvement in the animal business.

I agree, take the bugger down. He knows better by his own site rules, and chose to keep the pics up after 6 months of you being patient. I hope you can successfully sue him.

If it is the same guy who isn't supposed to be dealing in animals, it'd be very interesting when he gets nailed for that too.
 
Yeah, both FL Chams and Lost Lake asked me to keep them updated with any progress. I'm not sure if they emailed him about their photos too. It seems that most of those photos were taken from other people, mine are definitely not an isolated case.

I just checked and it looks like with the exception of the main entry page, the entire site is down. We'll see if it stays that way or not...

Well, I just checked again and the photos are still up. I called Mr. Stubbs and he said that because of the malicious code, he had been blocked from even signing on and they had to reset the page (which was why they were off the other day). He assured me he'd have them off today but in the same breath claimed that what I said in this thread was not true because all the photos were put on by his web people. I reminded him that as the owner he is ultimately responsible for the content of his company's site and he said "well, whatever, do what you need to do but I'm taking them off today." I think I would add "

Regarding the Richard Stubbs that Russ mentioned, I found the summary of the United States v. Richard A. Stubbs, 11 F.3d 632, 633 (6th Cir. 1993) on that situation: http://www.loislaw.com/advsrny/doclink.htp?alias=F6CASE&cite=11+F.3d+632 Seems that the Richard A. Stubbs that Russ was speaking of was convicted of illegally importing endangered crocodile species in violation of CITES and the ESA, thus also violating the Lacey Act. I'm not sure if this is the same person but according to the Colorado Secretary of State's Business Record for Antique Row Market LLC and Stubbvo Partners LLC (the two LLCs listed on the two other companies I've found he is involved in by searching google for his email address: www.antiquerowmarket.com and www.land-in-colorado.com), the Richard Stubbs I've been having problems with is also a Richard A. Stubbs who is involved in the importation of reptiles...

Hey Chris I am positive he is the same guy. I bought chameleons from him before and he is intact a import broker who works with other large importers in Florida. I would like to point out that the animals we received were in decent shape (being that they were wc) and he did refund us for an animal that we received dead. I didn't notice the pictures being yours but I didn't really view the site too much, I just got his price list.

He actually imports alot of animals and I am pretty sure a lot of the fresh import animals you see on the market are from him and his affiliates.

Which species of chameleon did you buy from him? Do you still have a copy of one of his lists with any or all of those three species he used my photos of for priced on it? If not, do you remember how much you paid for them?

The problem lies with the image search function on Google, Bing and the like. I can't tell you how many times I have to tell clients that they would be infringing on copyright by taking images off of these sources. Personally, I'd like to see these search engines to disable right click on their image searches with a pop up warning (much like I did here). It doesn't prevent screenshots being taken, but it will deter most photo snatchers.
