    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy JERRY TRESSER--BAD GUY- the worst kind

and since Mr tresser seems to keep referencing our correspondence here it is---start from the bottom---other then the in person talk at repticon which was witnessed by a group of people(even when I pulled jerry aside as a friend) luckily a friend heard no other correspondence has happened. LET ME BE ABUNDANTLY CLEAR---no settlement will be accepted From Jerry Tresser unless it is through my attorney. Jerry had ample opportunity to take care of his debt in an ample time. He chose not to. I will let my attorney and my managers attorney and Snakes at sunsets attorney handled it. Here are the completely unaltered emails--_REMEMBER_-bottom to top-- and it was only Jerry that had the audacity to bring up a tragice incident in my life, my managers life and eddies and his families life to use against me while trying to collect a debt. I have never seen a man like this before. Never in my life.

It does not matter if the animal died on the 7th day or the 12 day. There was something very wrong.. I tried to keep the poor skink alive. Otherwise you would have gotten it back sooner. I doubt you would have even honored your own terms bringing it back half dead..... There was no trickery here, it was a sick animal and it died. I would have preferred it alive especially since the price was expensive as you know.... You also know from prior experience that I ALWAYS paid my bill. Never defaulted once on your gesture of good faith to me.. This would have been no exception. But to tell me that the guarantee period expired on a $ `1,000 skink by a week is not acceptable.. Do whatever you want and have any future correspondence come from your attorney.

Finally, Its not appreciated about these fabrication MODUS OPERANDI. I have had one problem with a bad shipment. Far different from my situation with you. I don't make it a policy of using other peoples stories to justify some child's nonsense that you feel is necessary to bring to my attention.. That's not going to work any more than seeing something negative about you on the BOI or myself for that matter.... You have a hell of a nerve bringing anything up that does NOT relate to the issue on hand.. If you do find more than a few people over my 50 years in this business, it happens from time to time. That includes you as well.... That's the business we chose, like it or not, it has its risks and liabilities which in many cases can be settled, but in your case , you find it easier to bring up things that have nothing to do with skinks. !

This is the behavior of someone who knows they do not have a leg to stand on. If he thought he was in the right even just a little bit, he would not have to resort to bringing up the incident at your store. There are no other arguments so he throws this in your face.
If I were you I would print off everything he has stated in this thread and hand it over to your attorney. I would look into suing him for the $900 plus and slander/liable that they think you can go for.
I would not bother replying to this childish, moronic behavior on here. All it is doing is upsetting you and its not getting you your money any faster. Forget the war of words and just get on with taking this to the judicial system.

Not that anything hasn't been stated here, but to reiterate, a counter offer was made. Jerry wanted to trade animals as well as some cash. In no way was Ben obligated to accept this. Just because Jerry offered a possible resolution does not mean it was one both parties were happy with, if it were, Ben would have taken the animals and this never would have happened. Ben decided it was to be paid in cash at cost or stick to the previous AGREEMENT, which is more than an acceptable offer. It is every right of Ben's to then take it to the court. Jerry acts as though none of this would have happened if Ben had just accepted the offer, which is completely unreasonable to say. I believe these accusations and fabrications Jerry has placed into this very public and popular forum may have harmed Ben's business negatively, and, in my opinion, seems to have been incredibly emotionally damaging, given Ben's responses.

For the record - I have had previous assumptions of Ben Siegel and who he is based on his many positive customer reviews, but have never had any personal encounters, with him, nor Jerry, nor their respective businesses.
 
There is no reason for Ben to "settle" because there is no reason to think that the skink is really dead. Either Jerry still has it, or he sold it.

A 'settlement' is merely an agreement, often reached so both parties do not have to spend time and funds on litigation.
It does not mean that the person who settles must take less than the amount in question.
Here, Ben may very well want to settle for more than the $900 since he has spent money on legal advice, and his time, on this issue.
 
I am referring to Jerry's offers to pay Ben's original cost for the animal, or accept animals in trade. The original sale was $1000 cash, and that is what Jerry owes. He can't change the terms after the fact simply because he decides to.

While I do believe Ben can get significantly more than $900 if he has a mind to pursue this through litigation, I do not recall making this specific claim.
While I am free to voice my opinion just as anyone else here can do, and it is obvious that I wish him the best, I cannot give Ben specific advice because he is not my client.

I think it a joke that Jerry makes it sound as if he is doing Ben some great favor by offering a settlement, like he is being gracious and he is the one who is being taken advantage of. Smh....
 
$900 plus all the additional lawyer fees, which after frequent consultations, should be a nice hefty bonus. That's what I would ask for!

There are several separate issues. The lizard debt is one. Far more complex is the financial and emotional damage Jerry may have done, in my opinion, by his intentional parading around of his less-than-knowledgeable comments about Ben when he discussed the roach incident.
 
Indeed. Lawyer fees and related costs are not really a "bonus" since the person bringing the lawsuit needs to cover those out of pocket. Suits are really for the plaintiff to be "made whole" instead of making a profit. But I do think Ben has said he's trying to get more for emotional damages, which he very well should. Jerry's behavior in all this has been abominable and defamatory.
 
I don't think either party has hired a lawyer, because the first thing the lawyer would have said is to cease all communications on the matter and let the lawyer do all the talking.

It is obvious that Jerry is in the wrong and by his own admission the said animal "died" and he failed to contact Ben within the 7 day guarantee time frame.

Speaking from my law enforcement background I would advise against discussing an ongoing investigation with anyone let alone a public forum.
Jerry knows he owes the money. He knows he took advantage of a tragic situation.
Never wish ill on anyone, life knows when to kick someone.
 
Yes, Ben clearly should have known better than to trust a long-time friend, with whom he's had numerous successful transactions. Definitely his fault for trusting such a person, and a lesson that should cost him $900. :rolleyes:

Dude...In case you couldn't tell; yes, I was being extremely sarcastic. Biting the bullet does nothing more than reinforcing the idea that scammers can do whatever they want, and not suffer any consequences. Aside from the scammers, no one benefits from that mentality.
 
I forwarded my attorneys information to Jerry in our original correspondence via email. Please see first post. He is trustworthy and hard working. I feel the need to defend myself when being attacked. This thread has caused me many many hours of losing sleep. I am reading and checking back to it constantly. I mean it is about my business and a huge tragedy and has been seen almost 20,000 times by this time. I have woken from a dead sleep in a sweat only to run to the computer and check this to make sure ANOTHER untrue statement hasnt been written that could potentially hurt my business either directly or by making incorrect statements about Eddies death. Painful.

At this point, you can rest assured that everyone here agrees with you, and no one is going to believe any of the lies. People here (myself included) won't even believe the truth without proof, and that's a good thing. We are behind you 100%, having been through 18 pages of this story. Most, like myself, went in with a totally open mind.

There are so many things that must be going through your mind right now; so please take the reptile community off of your list of worries. You're a good guy, and thousands of folks can see that.
