    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy Legal battle hindering sale- Lea Hurst and Nikki Pardalis

If there is a lawsuit between Lea and Nikki then anyone with a PACER account can look up the attorney info.

PACER is a Federal Court system and it is highly unlikely that their case, if there is indeed one, is filed in Federal Court.

I don't know what type of access Oregon provides to its state court system, it varies from state to state.

Mea culpa, you're right. Looks like Oregon requires a written request for records.
 
I, absolutely, do not believe that Lea's alleged attorney advised her to not refund the OP. Well, unless Lea did not disclose everything to this alleged attorney.
If a partnership - they can either keep the money or keep the gecko. They cannot, regardless of dispute/s, keep both.
If not a partnership - the money/payment, itself, is not part of a partnership (which frees it from "business/ownership" disputes). It also means that Lea (as an individual) made the sale, Lea received payment (has/had the money), Lea cannot send the gecko to the OP (and Nikki, of course, will not). Thus, Lea owes the OP a refund. Now, not later.

You're absolutel right. Although Lea an Nikki both have means to do the right thing here, I question Lea's integrity alot more. Why? Let's go back to the first post in this thread. Lea directs Brittany to with Nikki, then cautions her to "be careful in dealing with her, claiming Nikki is a pathological liar, bipolar and violent. Who's the liar here? Would Lea's lawyer say it's feesable for Brittany to have any correspondance with a dangerous (alleged) person like that? Doubt it. Lea's statement..."my lawyer says it's best to contact her through written means. Is there one person here who would take that advice if they thought the person they were being told to cantact as a dangerous, bipolar pathological liar? What lawyer would say that? If Brittany is the dangerous one, why did she get a restraining order against Lea? Nikki said she had to "go to the extreme of a restraining order to protect" herself. Does Lea deny that? Yet Lea claims she was "endlessly contacting her to get her to return her animals. Also, Lea states, "I'm getting out of the reptile world for good". Then, "not going to focus on reptiles for a while". Then, "if I ever decide to get onto cresties again, you can bet you'd get as many freebie's as you could ever want". THIS JUST IN...Lea is not getting out of reptiles! Lea, who are you trying to kid? I knew from the first post here that you have zero integrity when you solicited Brittany to do your dirty work for you. Your exact words were, "I'd also welcome you to make one (boi post) for me if you feel like it". Really Lea? First of all, that's against the rules here. I am in contact with another buyer who Lea is refusing to refund. They were set to pick their gecko up in person this weekend but she got back to them around two weeks ago saying she didn't have their purchase or a refund and to just track me down to badger said gecko from me.

They have chosen to not post here but are aware of the thread and we are working out a solution that leaves them as happy as anyone could be through this mess.

I will be updating this thread as I see relevant, likely after the upcoming trial regarding Lea contesting the protective order against her.

I may have missed this while reading through 20 pages, but what's keeping you from simply asking your bank to perform a chargeback? Since the animal wasn't delivered the chargeback process should be pretty simple from what I know.

You gave money to Lea and she never delivered the animal. So now she has extra money that is not rightfully hers to begin with, so there should be no problem if you were to take back that money that is rightfully yours. She's obviously not willing to give you a refund without putting up a fight, so let the bank take care of this ordeal. The legal battle is THEIR problem to deal with, and you shouldn't have to waste your time and effort in all this.

The bank was the second group I called after contacting Paypal. Because my Paypal was directly attached to my bank account (for deposit purposes), it pulled the funds directly from the account, bypassing any credit or debit cards (and has since been edited to not do that again!). The bank claims that this type of ACH payment cannot be reversed. I don't really get that either and I'm going to try calling Bank of America again to see if a supervisor or manager can help. I appreciate the reminder!
 
I am the other buyer, and I have yet to post because I'm still getting all of my screen shots of messages together. We are currently going through with a charge back from the bank, so hopefully we'll have our money back soon. Nikki has been as helpful as she can be with the situation she is in, and I feel thankful for that. I had many times where I was stressed and frustrated to the point of tears, so I can't imagine how others in the situation feel. As soon as I heard what the situation really was, I did not ask for my gecko. If Nikki cannot legally send the gecko, I understand that she can't, and she simply didn't have the money that I paid for the gecko with. If anyone should have refunded me, it should have been Lea. I understand if I backed out of the sale, but she is the one who was unable to send the gecko, therefore she should have returned the funds. She also did not let me know when the gecko was out of her hands, though she should have told me as soon as it happened. I am in just as much shock as the other people I contacted for opinions on her as a seller before I paid for the gecko.

I agree with you completely- Lea terminated the transaction when she no longer had the "items" we paid for, thus we as buyers should have our funds returned. Otherwise, it's blatant stealing. It's just that simple.
 
Today was our court date and it ended in a mutual no contact agreement that also specified that Lea must refund Remy and Brittany as well as drop my name from this whole ordeal and stop slandering me. I expect that she will try to weasel out of the refunds yet again but I have the legal documents to prove all of this and will happily help that resolution come to fruition. Something I found interesting is that she attempted to tell the judge that "one of the buyers has agreed to let it go and that it is lost money."

I am now free to answer any questions you all might have as the court aspects are over, the geckos are legally mine, and I am ready to leave this all behind.
 
There isn't a date set but I am working on figuring that out. Your best bet would be to contact her or her attorney about it. His name is Eric Hale. As for the legal documents, I will happily forward scans to the buyers once I have them (they are coming in the mail).

I do realize that this thread will stay; I am fine with that. What I am not okay with is being slandered as I did nothing wrong and was pulled into this mess without my consent or knowledge. I have done everything in my power to make things right for the people involved, even though I had no obligation to.

So Remy, you no longer want Trenzalore at a reduced cost after getting your refund from Lea? I understand and wish you well with your project. I believe Brittany and I are planning on shipping Fangorn in the next few weeks; I just have to work it out with her after my return from a trip to the Seattle area this weekend. I would like to thank you both for your patience and understanding through this mess.
