Yeah Id say all cell phones have call logs shouldnt be too hard to get a screenshot of his phone number.

OK Mike give me his number ill look it up just for you..lol - whats a matter you dont trust my word ? I run 2 business off this phone and have probably had thousands of call since then.. also he called me once I didnt think anything of it.. do you expect me to remember his number ? i couldnt care less about this really eaither way as I dont know or have ever met either of these 2 involved. Im just stating the facts as i know them and wasnt implying anything..

yes thats the ad.. these were leftover slight b grade from different groups all mixed.. he inquired if any could be hets or male, i said doubtful but one or 2 could "possibly" be.. then he asked if i would sell one of my larger hold back het males i said i had, because he was looking to pair up his 3 het clive females, and had been looking for a het male for awhile with no luck..... i told him sorry NFS..a day or 2 after that is when he placed the ad.

So to me it sounds like it here actually was looking for het snow makes then Andrew could provide that information with documentation. But as it stands Andrew's only proof of them being hets. Are his "word".

Anyone who deals with hets, especially 100% hets know it should be easy to prove it by providing background information. Such as receipt of them being bough that states they are 100% hets, proof of who you bought them from leading to the breeder who produced them who could verify them being hets, or things of that sort. Andrew has yet to provide anyone with any actual proof, background, information or anything to help prove they are hets. The only says they are hets and my word is my proof.

If they are hets Andrew, where is your proof? It's not that hard, provide your receipt saying they are hets. Provide emails with the person you purchased them from saying they are hets, provide any PROOF they are hets.

Andrew has not come here at all to provide any proof to his side. They are small and it's obvious from the pictures and he has not given any info or proof they are hets.

So, Andrew Popps most updated version of events, goes something like this.... A customer walked in to Scales N' Tails in Las Vegas with three albino turtles, and either traded or sold the animals, to the business. Remember that Andrew Popp is a salesman at the business.

He says James Whitt, The owner of Scales N' Tails who lives in Colorado, sold him the turtles, or gave him the turtles. Then he says he came he stumbled across undeniable proof that without a shadow of a doubt, the three are het for caramel and snow. (lucky guy?) He claims that his constantly changing stories and pathological lying, is simply a mis-understanding. He also warns me, that despite his felony prison stint, I need to be careful about defaming his character.

Andrew Popp is extremely broke, is why he did this, and he would honor the return guarantee if he had the money. When I asked, how much he can pay back now, he answered zero, completely broke, but asked if I would give it six months, I said nope. In my opinion, Andrew Popp is teetering on bankruptcy, and that is likely why the whole story about his job sold him the animals, then he sold them online, because that could protect the business from liability, but that is very very convenient. Also, Scales N' Tails has hired an attorney, All defendants have gone silent.

On several occasions, I have offered Andrew Popp that if he can provide me the het caramel snow proof - that I could likely get over the size difference and the mis-representations. And false guarantees. Truth be told, if he revealed the source of these three, our forum members would trace them immediately, furthermore, somebody on this forum likely knows the source of these turtles, but they dont want to get dragged in to Andrews mess.

My claim is that this could not have happened without Scales N' Tails, and certainly could not have happened without Andrew Popp.

So I have filed my claims, I am tentatively planning to return to Las Vegas in the coming weeks. Although I cant prove these turtles are not het for caramel or snow yet, I would bet my life on it.

Im pursuing them in every way I know how, and I will update the post as Andrew Popps scam continues to unravel. And advice would be appreciated beyond the obvious, that I likely took a $6,000.00 hit

to be honest I sure don't know whos side to be on but I would tell you this: I would be careful and refrain from saying to much. one thing ive learned in life..."the less you talk the better off you are".

I recently went through a federal lawsuit (as a plantiff) and I prevailed. saying something like you said above.... "I have offered Andrew Popp that if he can provide me the het caramel snow proof - that I could likely get over the size difference and the mis-representations" on that bases alone could cost you in court. if the defense wants to rip into you and say you were originally 100% unsatisfied when you filed the complaint, but now you can live with certain aspect.....that to me could be understood as buyers remorse.
I'm not saying I agree with you or disagree. I hope it works out for everyone and everyone learns a lesson. just friendly advice that I hope you hear. if you have a case in litigation and have retained a lawyer, you need to close your mouth regardless of what people on this forum want to see.

I know that's opposite of what this forum requires but maybe you could put this thread on hold until you have a legal resolution. going out on a limb, it sounds like you have a case. id hate to see a factual case be ruined over a comment or statement. don't think for a second that the defense doesn't have a copy of this thread! youd be a fool to think otherwise. good luck.

Okay, so in regards to the Scam by James D. Whitt, Andrew Popp, d.b.a. Scales N' Tails Las Vegas L.L.C.

The investigator confirmed that I have met the burden of proof with regards of fraud - more specifically - "Obtaining funds under false pretenses".

This makes me very happy that, even if I personally never see my stolen money again, maybe, just maybe, justice will be served.

Please do not ask me specifically what makes the transaction, "false pretenses" because this would be redundant, plus, there are so many things, that you can go through the list, and just pick one you like.

As for the civil process, - I had to hire processors in Colorado to serve James D. Whitt, a process server in Vegas for good Ole' Andrew Popp, and the same Vegas server will get Scales N' Tails.

Also, I have found a lawfirm, who I have not retained, that is willing to take my case on contingency, due to the circumstances and case strength. In addition, I have been told my local authorities can become involved as well, since technically the money was deposited in their account, here in Georgia.

Its very slow, but justice will come

I'm having a hard time buying any of this. Post something of relevance. Court documents. Names of "judges" you spoke to etc. Right now it looks like smoke and mirrors. We've already seen pics of turtle sizes and heard your arguments. Nothing more to add to that. Post receipts and legal documentation. Puh-lease! Or let this rest until the outcome has been established. Cut and dry here. Not cloak and dagger. No offense, but this surreal poop is getting old.
