Since I'm not convinced that he can even righteously claim to know that their genetics aren't what the ad stated - let alone prove it - it seems that basically any number he throws out there would have to have been pulled out of his ass. When it gets to the point where he has to justify the amount he's after, $6000 may not be so easy to defend. His little blunder with the naming of the defendants isn't the only aspect that takes me beyond wondering, "what the hell's he thinking," and into, "is he even thinking" territory.

Not sure if you picked up on it yet, but Lucille was an attorney until she retired recently. She is asking you the same questions a judge will. I hope you have better answers for the judge than you've given her.

I've been involved in three small claims cases and one contract dispute. Process is important and judges have little sympathy for parties that don't follow it. FWIW I won all four of those cases, not only because I had a pile of evidence, but because I's were dotted and T's were crossed.

He should not have misrepresented the sizes, accidentally or not, and I think you were right to call him out on that.
Now, at some point after discussing the sizes, you decided that the three turtles you got were the same EXACT turtles he posted as regular albinos, and therefore, he scammed you by selling them to you as hets. This is where it gets fuzzy. Other than comparing some photos, what proof do you have that these are those exact turtles? Saying that he admitted it to you, or that someone else told you they were the same is not proof. You have a contract in place for if they don’t prove out, so breed them and see what happens. You knew going into this there could be risk, that’s why you wrote up a contract. So abide by it, like you both agreed on.
For this to be a criminal case, you would have to prove that these turtles are not hets, and that Andrew did this on purpose, in order to defraud you. I do not see where you have a case for that. You can say that’s what happened, but that does not make it so.
Finally, you keep dragging Scales and Tails into this. Your error in naming Andrew Popp as a DBA Scales and Tails has been mentioned, but I wonder if you did that on purpose to make it look like Scales and Tails was the actual defendant. I hope you are not that foolish because you must know that will not be supported by fact and will not fool any court or lawyer. You have no reason to drag them into this, slander their name, and call them guilty just because you think they are. My suspicion is that you know Andrew doesn’t have the $6K you want, and you figure that their business will, so you are going after them. I don’t think that’s fair, or right of you to do that.

I believe you have raised some good points here, and some not so good points. We do have a contract as you said, and also, I should note that two things happened (after) I considered accepting the false advertised size.

1. Both parties agreed I would receive a full refund
2. More fraudulent information surfaced

Do I want to bring about a resolution? - why yes, your right I do.

However, believe me, I've done some
Homework, if they force me to trial, I'm not going it alone, I'll go with representation.

Also, I am seeking these actions based on them obtaining funds under false pretenses. Under the Nevada code section, it's fairly simple - you either did. Or you did not obtain funds under ANY false pretenses.

If in a few years, they prove out non-het, I would certainly envoke that contract at the appropriate time. There is no double jeopardy in civil cases, each false pretense is it's own violation.

However, I'm not an attorney, and should we go to trial, they would be paid to help me recover whatever I am due.
