There has to be only a handful of people that breed albino tegus. If he raffles off some lizards, mostly likely they would be high end lizards, how many high end lizard breeders are out there? Maybe a handful of high end tegu breeders and a handful of high end rock iguana breeders out there.

He didn't tell me that he was looking into getting me a an albino tegu from another nreeder. He told me he was going to pick them up from another breeder and paying for them. What you fail to see is that wasn't part of the raffle terms. I asked him who the breeder was because I want to know where my animals come from and asked for a pic. He refused to give me any info and no pics. Later he said he couldn't even get the.m from the friend/breeder. So why are you still bringing this up.

His first post explained what the terms were going to be. And he asked him many people would be interested if he did the raffle. The second post march 10 said "an albino tegu " both purple and blue (t* and t-) are both considered albinos And tone delivered July. Since he said he only produced the purples and they are worth $5,000 he only owes me $2500 ( when he then decided to try to "get me a different one from the undesclosed breeder, which ty admitted he couldn't even get. shows that ty knew what produced meant right? Well if he only produced the t+ albinos , he couldn't get any of the less exoencivei es from the undesclosed breeder. What do you then think the prize should have been?? He gave the other 2 albinos he produced. Right.

The right thing for him to do from the start was to give all of the winners Albino Purples, and not act cheap. He got lucky last year with Albino Purples, and that luck should have been passed on to the already lucky winners.

Sadly OP and Ty got into a very messy argument. Ty decides to have a trust me moment and offers to send an albino tegu to OP. Unfortunately OP doesn't know Ty is sending the grand daddy of albino tegus, and refuses to give Ty shipping address. Ty gets tired of all the back and forth and says sue me, OP obliges.

To Ty, he probably feels a moral obligation to not send the tegu to OP due to feelings he has from all the communications the two had. And OP has a moral obligation not receive anything that does not resemble what was promised. The court is the way to go and the only way at this point. Like Mr. Walker says, there is never a true winner in these fights, unless there is a true winner.

Hindsight is 20/20 looking back at what both parties should have done. Ty shouldn't play games, Op should have just given the address and see what was given, if it was not acceptable we will be right where we are, but if it was acceptable it would have saved a lot of time and anger. But like I said, hindsight is 20/20.

Will be looking forward to the results of the case.

You did kind of harass John at IRCF. She should have sent you a picture and not played games.

In his only statement, he said "I could have just bought the tegus from a friend and shipped them without them knowing but I wanted to be honest and open." Now you are suggesting he would not tell potential raffle winners that he got animals from other breeders. He breeds a lot of animals, I think it is a little far fetched that he would give out other people's bred animals to winners of raffles. You can always try to contact the winners of other raffles, I guess just scroll down facebook for a while to find if he ever had raffles before.

It doesnt matter who he tried to get one from or why. His raffle wasnt for a tegu from anyone else!! Period!!!!!! He owes her $3000 cash since a tegu produced from him as described in the raffle isnt available. Youre making a fool out of yourself by saying things like "to be fair". What about being fair to mitchell??!!

She doesnt want, nor ever signed up for, or agreed to a lizard from anyone else....no matter the value. If ty offered her two $10,000 lizards, she doesnt have to accept because the raffle wasnt for that.

I know, he should have told you what he would be shipping. He should not have played games. I totally agree with you on that.

In hind sight, you still don't feel you should have given him your shipping address? If he shipped something to you that was not acceptable to you, then you still have the option for the lawsuit.

As for the label of "greedy" being applied to Michelle, heck, the way I am reading this, it appears that Ty said he was going to be purchasing an albino iguana from someone else. And it appears to me that Michelle suggested that rather than all that bother, she would be perfectly willing to accept the cash that was offered as a stated option and the possibly purchase what she actually wanted from him next season. To a reasonable mind, this appears to be a reasonable solution to the dilemma.

I agree, except, the $3000 tegu, is prob. a $2500 animal, and Ty, buying 3 would probably get a good deal, so let's say $2000, so $6000 instead of $9000. I think most people who create quite a bit of wealth are probably pretty frugal.

Michelle, It should have been obvious, Ty was becoming hostile toward you, he clearly did not like your accusations, he said he was sending a purple.
I did not copy every post in context (they are all on the first page) just a few to show the tenor of the dialogue. There were many missteps on both sides, but the problem is Ty had your prize, he had something you desired, you did not have anything for him, so yes, you should have been more polite, as fresno say's, if you had received something you did not want, then you could easily pursue him as you are doing now.

You seem to be suggesting that she could have received it and then made a stink about being unsatisfied at that point and it would somehow be better than the current scenario. That makes no sense. If she thought she might receive something she didn't expect to be fully satisfied with, why is it unreasonable to ask for pictures, breeder information, etc BEFORE he shipped to avoid that? How do you think things would be better if she had an unwanted tegu that he refused to replace? If he's unreasonable enough to avoid simple questions before shipping, why would he be reasonable enough to work with her after sending a generic tegu from a mystery source if she didn't want it?

Whether you won a contest, purchased an animal, sent one in a trade-it doesn't matter. When someone owes you an animal and is preparing to ship, there's no reason to avoid answering simple, relevant questions that potentially avoid a conflict or dissatisfaction with what is delivered. Any reasonable person will try to head that off in advance while it's easier to resolve. In this case, he pressured her to accept whatever he shipped quickly without addressing her concerns beforehand, which is no recipe for a successful transaction. No amount of splitting hairs over the details is going to change the fact that what he did was wrong and her refusal to blindly accept whatever he was willing to offer was NOT wrong.

Sure he says he was going to send a "purple" tegu now, but he's already proven himself to be a liar in this very thread, so there's no sense in taking him at his word on this claim. That may very well just be posturing after the fact to look like less of a jerk for the way he handled this situation...which in my opinion doesn't work even if the claim is true.

Or if you still believe he is an honest, upstanding guy, why did he tell her no when she asked for a "purple" if he was going to send her one per his later claim? Either he answered her honestly about his refusal to send one when she asked and lied about it later, or he lied to her originally when she asked. Either way, we know he lied about it (among other things) in this thread because at different points he gave different answers. Why defend the guy who has conclusively proven he's lied about this situation?

Also, as far as accepting the tegu and dealing with it after the fact, that would have been a very stupid thing to do as Ty would have clear documentation that he sent her a tegu and the fact that most judges don't value the genetics the same way we would, would mean he had proof he "fulfilled his end of the deal" even though he wouldn't have.

This idea that she should have been nice because he was becoming annoyed with her is absolute garbage. Sure it might have been EASIER, but that doesn't at all apply or remove blame as far as I am concerned. Are you telling me that in his long, successful career in real estate he has never been annoyed with someone? Or if he did, he would negate on a contract? That's lunacy. This is business, not friendship. The only thing you have to like is my money, and once you like (ie accept) that, then you don't get to change the terms because I ask reasonable questions (maybe in a matter you don't like, but oh well... you're an adult, get over it. Or get to know people BEFORE you enter in a contract with them).

We can all speculate how we would have worded our responses, but when it comes down to it the terms of the deal were in black and white and he IS being shady. Her stating so may have offended him, but how about him behaving so offending her?

I have spent years admiring your posts, until now! You've left me scratching my head throughout this whole thread. After this ridiculous post (but she was informed), there is no saving face. You are either desperately trying to do damage control for earlier posts that are flat out biased, or you, in my opinion, have an ulterior motive. He said no to a purple. He NEVER offered me a purple. He only told his followers on his fb post in oct that he did so I commenter for clarification and he did not respond.

On #77 he said he decided to send me a purple but did not communicate that to me to see if I was was greedy.
