    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

alright so...he is sending you 250 for the snake that has died...which means he is (without wanting to im sure) taking responsibility for the dead snake

what happens if the second snake dies...if he is giving a refund for the first snake then i feel he should give you a refund for the second one as well if it meets the same fate (tho i really hope it pulls through for you)

so far this is better then nothing...but it sure as heck isn't redeeming the seller in any way for resolving this problem at the bare minimum instead of taking into consideration the situation he basically forced the OP into
 
Well Jason, he said he would have given you a full refund if you had notified him the second you got the snakes. We have to trust he is a man of his word. His word is also that you can have "any other reptile." What is the most expensive reptile they have? Maybe some people on here would be prepared to give you $300 for it.

haha Deborah, my comment was pretty tongue in cheek, as you might need to pay anyone reading this thread to take an animal from Touch of Class Reptiles. Those guys are pretty stupid to not take Jason's offer and have the last page of this thread say they have resolved their issues.

This is staying up here and every search someone does on the company before making a purchase with them will end by saying they are an incredibly classless bunch.

They are also thiefs, so I hope Jason considers court on this.

Honestly, Kelvin, he offered to cover the veterinary costs to rehabilitate the animal your employee shipped to him at death's door, and then ship the animal back to you....if it survived. You come at him with this??? Why don't you just tell him how it is. You buy crap, you keep it as though it is crap, you can't lose any money on this deal because then your crap would be costing you money instead of Jason.

You, sir, are a disgrace.

I know this is not by any means a pleasant situation, but in tough situations your true colors show. You're certified good guy in my book (and I'm sure I am far from the only person who agrees). So on that note, look at the bright side (as cliche as that is)...

Really though, people like you in the hobby are rare.

As someone who is trained in Adobe: Photoshop and works with it frequently I'm going to throw in my 2 cents here and agree with Turbine. Those photos have not been altered. It is not easy by any means to achieve an unnoticeable 'fix' like that to a photo. The only post processing that could have been used would be something along the lines of brightness/contrast/levels, but I doubt it.

I didn't mean to say I thought the markings on the snake were touched up - only that the contrast and/or saturation had been enhanced. But I am glad to know that it appears they have not, and I apologize to TOCR for the false accusation.

That being said, the whole reason I came into this thread is because I had some interest in inquiring about the Amazons TOCR has listed for sale. At this point I certainly will not be considering it. Even if TOCR makes everything right by Jason and issues a full refund (offering at least some compensation for vet bills would be appropriate, but Jason has already been extremely kind to solely accept those responsibilities), there is still one thing that is really bugging me..

Kelvin, the snakes with the fungal infections, parasites, and lesions are the ones that you sent to the purchaser, as has been concluded. You claim that they did not appear that way when you shipped them. I am not going to argue the validity of that claim - whether or not it is true is irrelevant to my point. Even if the lesions were not present or were significantly less severe prior to shipment, there is no doubt by the evidence provided that the snakes definitely had those infections and parasites while in your facility. Have you taken any steps at all to test, treat, and/or quarantine the other animals there? Even if the issues between you and Jason were completely resolved and your business practices were no longer in question, I, as a potential buyer, would not want to risk bringing something like that into my home despite my own quarantine procedures.
 
So Kelvin doesn't feel like there is no benefit to doing the right thing by giving the money back, I can assure you there will be a world of difference for people skipping to the end and seeing the OP is happy.

Yes, he will need to fight very hard to win back the people that have seen him drag this along this far, but it isn't impossible for him to win some back.

It is wrong that he has the OP's money, and I would hate for the OP to not get that because he feels "hopeless." Don't shoot the hostage just because you are already going to jail...it would get worse.
 
Reading this prevented me from wanting to purchase the chameleon he had up. Even though he is refunding $250 I would think a full refund should be in order. However he could of easily protected himself from this by putting in his terms that the only refunds he will issue are in credit (I see this on a lot of websites).

The main reason I wouldn't want to purchase from him is due to his lack of "caring" about what is said here. The owner posted twice while an employee (who had no dealing with issuing a refund) basically took the full blow from the people defending the op. I don't think the employee should of been help accountable as the owner (someone who has been in the industry for a while) should of known better than to ship the animals and the owner should of also been the one defending himself here.

I'm pretty sure his reputation is shot, at least here. And he doesn't appear to be too concerned, otherwise he would offer a FULL refund, and pay vet bills. Maybe he should change the name to "Touch of Trash" :NoNo:
 
I have just finished reading this entire thread, as well as the others involving Touch of Class (a misnomer if there ever was one).

In most situations of this sort one can only hope that the vendor has the character to make the situation right since the dollar amount is usually too small to pursue it further. I believe Kelvin to be the sort of "businessman" that is in it for the quick buck and not one to understand the importance of building and maintaining a good reputation and customer base. Having repeat buyers is but one of the keys to growing a business and being successful. Another being quick to address a customer's concerns/complaints immediately and quickly resolving any issue to the satisfaction of the customer. I could go on as to the mistakes made by Kelvin, but we all get the point.

I think that Jason may have a good legal case here (I am not an attorney) and may be entitled to more than just compensation for monies spent. If it were me, I would at least ask an attorney to look at all of the evidence and offer his/her opinion. Along those lines, Jason, I would not accept any offer from Kelvin unless it is far and above any he has made to this point. It might be construed as acceptance of a resolution.

In Kelvin's shoes (and I have been a seller online) the initial offer should have been a full refund of the original transaction, full compensation of all costs incurred by Jason, and an offer to let him keep the remaining animal. However, at this point the offer should be all of that AND an offer of TWO replacement snakes (I don't blame you for refusing the latter Jason). Otherwise Kelvin could find himself having to cover all of that in addition to compensation for time spent on caring for the sick animals, attorney's fees and possibly pain and suffering!

I know this sounds like I know what I am talking about professionally, but it is only based on my layman's experience in today's world and we all have heard of much more outrageous lawsuits being won.

What burns me most is that it is a shame that people such as Kelvin are able to make money at the expense of those of us who believe there is honor and goodness, at least in some amount, in all people. Sadly there is very little of that these days.

I have been quite interested in some of the animals TOCR has placed on KS, but will no longer consider any of their offerings from here forward. Kelvin, if you read this (which I doubt) I hope you will see how bad it is for you and your business to have failed to resolve this before it reached a public forum. You have not only lost 1000's of customers from those that have read this, but also all the people those 1000's know, and on and on. At this point, full restitution and a sincere apology MIGHT be enough to POSSIBLY salvage SOME of your already questionable reputation. Otherwise, I would not be surprised to find you out of business within weeks.

Jason, you have maintained remarkable decorum through all this and are to be commended. I do hope this works out for you in the end, but I feel the outlook is dim. I hope this doesn't muddy your view of other vendors as there are plenty of reputable breeders/dealers out here.

I apologize for this lengthy post, but I have dealt with situations like this from both ends many times and I have strong feelings when it comes to dealing with less-than-forthright people and companies.
