    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

renae,that was a one of kind animal, i cant replace her,and i dont have the cash.why didnt i hear from you on the day is was to be delieverd instead of the second?i assumed it was fine and then the second day you said it was there and dead.look at my emails i never guaranteed it!look at most breeders terms they dont either when temps are not between 40 and 89.you booked and paid the shipping why didnt you get it insured?the weather wasnt that bad on both ends,i think fedex just screwed up and blamed it on the weather!maybe you should have went UPS?

Then why do you have so many wanted adds up for wholesale animals?

You folks need to realize that people make mistakes, and we are a community. Enough with the crusades. It's the guy's first mistake. Help him...don't crucify him.

Yes they do... but when a seller tells his customer they "should have been a better shopper".... um no!!! Thats not a mistake... that is completely disrespectful to their customer.

I can deal with the folks that make a mistake and attempt to man up to it and make it right. Mistakes happen. But for what he did there is no excuse. I'm glad he is attempting to make it right finally.... but for me.... he took it too far with the "should have been a better shopper" comment.

Makes him an asshole IMO. Even if he does take care of this the right way. He's been sort of a bonehead from the start, and is only doing the right thing because of the peer pressure.

I certainly hope he takes care of this, but it's only a small step in the right direction. Looks like he's got a long road ahead of him judging by his posts.

Actually I wouldnt hold a trip to the BOI against him. He lost me when he told her she should have been a smarter shopper. Sadly I agree... she should have never bought from him.

At lease the links you listed have a TOS and will work with a mistake they Make. Dont try turning this out on other people cause you messed up.

Shipping delays hardly happen and even some say thier not liable they will work with the customer to replace it or do some kind of refund. Not say should of shopped better or used a diff courier.

i dont have a site stateing terms and i never guaranteed live delievery.maybe renae should have gotten that before the deal was done?

I know that our terms do state that we do not guarantee against carrier error. It is stated right there in our TOS. But then again I would not ship if the temperature was not between 40 to 90 degrees no matter what. If there was a carrier error I would do everything in my power to make that customer happy. If that meant them getting a replacement or refund. I would not spend the money until I knew that the customer was a full 100% satisfied. You know what, I am confident in UPS not making that many carrier errors that once we get our new site up and running " I will include in our TOS that we cover for carrier error." I watch the tracking number when something is shipped so I know where it is and what is going on because I will not hesitate and make a phone call to UPS to make sure my shipment is put indoors to keep it safe if something were to hold it up.

Ed, I undestand your feelings here but, I guarantee that each and everyone that you mentioned has also said in other forums that if there was a shipping error, they would eat it just to satisfy their customer. A TOS is for your protection, you have to make exceptions to it.
 
Well, Ed, if you READ my terms, the specific statement is this:
KBI Herpetoculture is not responsible for shipper mishandling/delays beyond the guarantees listed on this page.
I already have a live arrival guarantee posted, as well as the statement:
Shipping may be postponed due to extreme temperature/weather conditions. I may, at my discretion, require FedEx shipments to be held for pickup or suspend overnight shipping
options in favor of Delta Dash.
I have long since removed the common wording about guaranteeing as long as temps were between X and Y...because I firmly believe that if I cannot guarantee live arrival, I shouldn't be shipping. Simple.

In other words, by stating I am not responsible beyond the guarantees listed, I am saying that I am not going to refund shipping costs or provide a partial shipping refund if the carrier is late.
I have guaranteed live arrival, as long as the package is signed for on the first delivery attempt.

Here's the opening paragraph of my TOS. The first, third and sixth sentences were added specifically because of people like you. :yesnod: I think they are rather fair, and they mention nowhere about shipping problems voiding a live arrival. In fact, I've had shipping delays on overnight packages, high dollar animals too, even had one spend 3 winter nights in a cold Ohio warehouse. Always package for a 2 day trip because shipping companies are about 90% morons to start with. Anyway...


These terms will be strictly followed, so please read them carefully, and feel free to make a copy. All birth, lineage, feed, shed, weight, and sex records will be sent with animal. This is a legal and binding agreement, so please read entirely, and carefully. You must be 18 or older to enter into a legal contract. If you are a minor, then your parent, or guardian must handle the transactions as their own, for Your protection, and that of Sublime Boa Constrictor, and the reptiles in question. These terms must be met prior to commencement of any shipment.
