Looks like I am about to get screwed for recieving a dead animal... the seller promises are refund and then claims he promised no refund and directs me to take up m complaints with USPS..... I love this business..it's full of lots of pleasent people!

WHat a Terrible thing to happen..

First of all.. It's illegal to ship snakes through USPS therefore if you try to file a Claim for this it will just get you both in trouble.. Him for shipping in the first place and you for accepting the package!!

I hope Kevin does the right thing but it really doesn't sound too promising so far. I'm sorry you had to go through this!! Did you send Payment by Credit Card through Paypal?? If so.. you might want to dispute the charges... If not then file a Complaint with Paypal on fraud!!

Good Luck and hope everything works out in the end... If you don't get your money back then maybe this thread will make Kevin's business go down the drain!! I sure wouldn't purchase anything from him!! He sounds like a real Screw Up!! Good Luck and Keep us Posted!!

I know that is what they say, but they have done it in the past. Perhaps they did only out of ignorance, not knowing that it was animal for which reimursement had been offered? At any rate, simply setting the wheels in motion with PayPal will tie up this guy's ability to use his checking account, and that would be fitting retribution, in my book!!!!
 
I agree with the posters. You need to make an inquiry with the Post Office, hate for you to file a claim that ends up getting you into trouble. And do start the process with PayPal. This guy owes you the money, no ifs ands or buts. Time to start making him become responsible. And sorry for the trouble your having, why cant sellers recognize that this kind or customer service ends up hurting them more than the cost of making good. And this is what gives the industry a black eye.
 
Last time I checked, it was illegal to send a snake via USPS. You can't be reimbursed by them for something you are not supposed to send. Also on the airbill (or invoice) for the shipping, you need to check and see what was listed as being the contents of the package. If it says something like "computer chips" and you list a snake on the complaint form... that won't look too good. D&J needs to issue you the refund, they chose to send it via USPS, not you who had requested FedEx overnight. You kept all of your e-mails and took photos too, good for you.

I won't buy from them, that's for sure.

Aside from the fact it was shipped through USPS, which is illegal, there is also the fact that shipping a snake that's about to shed it is very risky in itself.

Just out of curiosity, was the snake in a bag or deli cup before you took the pictures? I'm just hoping that they didn't ship the poor thing loose in the box.

And as everyone has pointed out, live snake shipments through the USPS is ILLEGAL! Unfortunately, by signing for the package, you are in violation of what I believe is a federal offense(though I could be wrong on the federal charge part).

If this is the same D&J that have been around for years, they should know better than to have sent a juvenile chondro through the mail.

Hopefully you can get it all worked out with them, but now that they have the body things may be harder to get worked out. You've given them back a key piece of evidence, in my opinion, and that could possibly come back to bite you in the buttocks.

Just out of curiosity, has D&J been notified of this thread yet? If not, they most definitely should be so that they can have the opportunity to voice their side of the story.

Actually the animal was inside of a snakebag with a piece of bamboo ..... I agree that an animal in the final stages of shed should not be shipped. This guy apparently is not taking any responsibility for his actions.... I have failed a complaint with paypal and will do so with the post office also. I did not sign for the package, my wife did unknowingly. I will print out these emails have them notarized and use them as part of my complaint with the USPS.

As Corey points out you are incurring two violations. First you are shipping illegally though USPS. Second you are violating the Lacey act as the box was not properly labeled stating the species being shipped (how could they any ways!).
 
I will print out these emails have them notarized and use them as part of my complaint with the USPS.

Be careful with what you do or say, because If I'm not mistaken you also violated a federal law the moment you knowingly accepted the shipment.

To start with, this neonate should NOT of been shipped while in shed and should NOT of been shipped in a bag, it SHOULD of been shipped in a deli cup due to the fragility of this species.

This animal more then likely died of stress!

UPS does NOT ship snakes and you should not lodge a complaint with them, for your own sake. Complain to kingsnake etc, but don't expect them to do anything.

I hope you printed out a copy of the advert or email that states live arrival or some sort of health gurantee?

I would NOT buy off someone that does not, in particular with Chondro pythons.

Best of luck with getting a refund, tie up that paypal account.

This thread should also be fare warning to those wanting to buy a chondro off Kevin Roberts who clearly shows no expertise or ability to care for these wonderful animals.
 
Actually, Kevin Roberts is responsible for dragging D&J Reptiles into this by giving that shipping address. Had he put:

It would have been a different story.

However, it's good to know that this isn't a problem caused by the company, but rather this individual.

How can someone who is employed by a reptile store NOT know that you can't ship snakes via USPS?
