OK, I have to admit I'm pretty confused by this "cease and desist" letter.
First off, this attorney is located in St. Louis, Missouri.
Where are the people who are being represented actually located? Where is the business "BallBids" a registered business entity? Where is the target of the letter itself located? Anyone of them located in St. Louis? Does anyone know the legal term "jurisdiction"? As best I can tell, this attorney is not within the jurisdictions of neither the plaintiffs nor the defendant mentioned.
As best I have been able to gather from what I can find, Zachary Byers lives in Kentucky, Mark Byers lives in Florida, and BallBids LLC is registered in Florida. Shaun Sumner lives in Indiana.
Furthermore, it appears that this attorney specializes in bankruptcy proceedings.
Here is a link to this law firm's web page, if anyone is interested ->

Also, this attorney's letter PLAINLY states that he is acting as a representative of BallBids, LLC. Then SPECIFICALLY mentions by name, Zachary Byers and Mark Byers. Yet hasn't Mark Byers, stated many times that he is not an owner of BallBids? And furthermore has completely ignored all requests for his official relationship with said company, seemingly implying that there is NO official association?
So excuse me if I am completely baffled by this. Here we have an attorney representing clients who do not live nor work within his practice's jurisdiction, sending a letter to a person who also is not within his practice's jurisdiction, and including in that letter a person in the company (BallBids, LLC) he is representing who denies here any official association within that represented company as being inclusive of the attorney's representation.
Why would this attorney have taken these clients in the first place? Even if it would go to court, he cannot practice in any jurisdiction likely the case would be held within.
Can someone please explain this to me? Obviously I MUST be missing something....
IMHO, of course, and based on information from sources that may or may not be accurate.
