Let me ask you, as I do not expect many new to the thread to read it all, but if a seller has a satisfaction guarantee, and the customer feels that some of the animals are undersized upon receipt, besides the breakdown in communications that occurred, does the seller have an obligation to try to work something out with the customer?

I usually feel that the seller only has what responsibility specified in his guarantee (which the buyer violated) as well as any responsibilities expressly stated or implied by law. With that said, negligence on the part of the seller to adequately safeguard against a foreseeable problem does make the seller at least partially liable in my opinion.

Both the seller and the buyer need to take responsibility here and a refund of half of the cost for the dead animal plus half of the cost of any veterinarian charges due to needed medical attention to ensure the survival of the other animals is the verdict I would give in this case. The buyer did not get to the door in time to accept the shipment and the seller did not use an ice pack when he knew the destination temperature was above his guaranteed range. I think most of us will agree that we would see an ice pack as necessary and his terms say, "a heat or cool pack if necessary". If you don't even guarantee live arrival at that temp, why would you not use an ice pack?

Yeah what Wendy did to Erik was low(I wouldn't do business with her) and her criminal record as has been posted in this thread sure adds nails to her coffin in the reptile world. Yet I really doubt Jim or anyone else here knew much of anything about her past. We now know way more than we wanted or needed to know about Wendy.

Lets try to keep this focused on Wendy and her deal with Erik or next thing ya know folks this site will be listed on Sextracker.

Hey I have no problem with porn but there are kids who visit here and we have open links to porn sites posted in this thread. Not a good idea to post any more and I hope one of the Mods cleans up what is here.

For those of you who feel the need to dig in my past , be my guest. Like I said early on , I have nothing to hide. Yes I did get a felony conviction WAY BACK in 1989 ,it was for burglary and theft. I served almost 3 years of probation which was broken because I relocated and had no transportation to report in. I served about 1 year in the Elsworth Correctional Facility in Elsworth Ks. I then served 1 year and 3 month parole. I was released from custody July 1st 1995. What you don't know is how it all went down and I won't go into detail or try to claim innocent. There are no records accept a few traffic violations since then.

I did call Wendy 1 time last night and all that was said was that I dug up some dirt and that she might want to check this thread. Since then she has been calling my house steadily. I know that she has been following this thread (not logged in so no one knows she is here) . 1 call that I received she mentioned (inbetween all the filthy words) that the real truth will come out. Now I have to ask, Wendy , what is the real truth?
Are you going to tell us that :
1 you didn't have 3 golfball sized baggies of meth in your purse.
2 you did not hold off the SWAT team with your 12 guage shot gun (weapon of choice)
3 you were not involved in 200 adult films.
4 you are not and were not ever involved with the Ku Klux Klan.
5 you never went by the name of Bianca Trump.
6 you never went by the name of Wendy Christine Iwanow.
7 you never went by the stage name of Christine Smith.
8 you never forged fake ID's.
9 you never kidnapped and beat a guy half to death.
10 you never went by the user name of tattoogirl1488.

All of these links that I have posted are just websites that people have mistakenly confused you with someone else.

Or were you referring to the real truth about my past which is now 11 years back. And by the way Jim O , for your information the BRADY LAW only goes 5 years back and yes I could own a gun , if I wanted to. I have no need for a gun , I do not hunt and I do not fear for my life. Nor do I worry that the SWAT team or the K.K.K.will surround my house unless I send them an invitation for a fish fry.

Timmy DeFrees, poster #1, C'mon down

The Spokane County Animal Protection Services, 509-477-2532, received a complaint from Timothy DeFrees (not protected information, BTW, confirmed by the Inspector) of substandard housing conditions for a quantity of animals maintained by Wendy and Jeane. I will withhold what address and other contact info that I have, as phone harassment has been rampant of late regards to disagreements here. Anyhow, they got the surprise visit today, which I independently confirmed, passed with flying colors (report forthcoming in a few days), and the inspector is returning this weekend to buy a bearded dragon !!

I will be the first to say that this does not address many of the other alleged ethical concerns. But there has always been far more to this thread than meets the eye. Sorry Wes ... guess I forgot that Timmy DeFrees, who speed-dialed the wrong number asking for Erik, BTW with the same access card as the harassing phone calls, is not the issue here .... by your command, eh ? Timmy, I understand Bianca told you "not in a million years" ..... sorry dude.

Sammy, John may not have a grasp of all the facts, but he certainly has a grasp on objectivity, and that the seller has an obligation to be attentive to the customer once a shipment is received with a complaint or two.

I have seen tons of posts that have nothing to do with the issue at hand and that is the responsibilities of both the seller and buyers to ensure the safety of these animals and to meet their obligations to each other. My post was based on the sellers own admission and I did not find any posts from the buyers. (Those posts will be helpful if anyone has seen any.)

If I did not take into account all of the various accusations being thrown around, that is good because I didn't want to.

You have the seller, Erik in Colorado, confused with other entities in the thread. There's another Erik even. As the one here who has voiced criticism of Erik in Colorado, the seller, let me say that I do not think there is one negative comment about his past business dealings or character anywhere in this thread. While I do not agree with choices he made in this transaction, I do not believe there to be any other blemish on he or his business. He has been endorsed in other transactions by people of good reputation.

I did not say I agreed or disagreed with the validity of his good past. It was a comment made so maybe you might want to read back through the posts and ask them... That has nothing to do with the topic of this thread... This is about a specific instance... You might want to go figure out if a tree makes a sound in the woods when it falls when nobody is there to hear it...

And thank you for making my point for me... I do not pay much attention to posts making accusations that really have nothing to do with this specific instance...

Did you not see my other post asking what "facts" I was wrong on? If not, go back and catch up on this thread and lets put all of the stupid accusing aside and make choices that ensure the safety of the animals being baught and sold...

Here are some good questions to answer:
1) Should someone use a pack in that instance?
2) Should someone make sure to pick up the shipment when first delivered?

My answer is yes to both of those and therefore they both are accountable...

Yep John You must go back and read the whole tread,it's unbelievable to say the least.Now Wendy was caught lying about all kinds of things from the shipper to the way they were when she got home,to how the UPS person seen the dead animal.You must have read it all to fast as i did part of it too.Theres just so much to read and it was late and i lost track.Heck i had her and Tim having a Kid together and he beat her up and thats why she left,I'm not sure were my mind found that from.LOL go back and re read it all its a good Novel,,those dang Filia Buster in my head even lead me astray

Alright... I am not even going to waste my time sifting through all of the spam to find all of the meat... I read the first 6 or 7 pages (sheesh) then it just went really crazy with very very little applicable information... Even if the animal had lived through the trip, I find it really sad that he did not use a pack at that temperature... Don't you? I also find it really sad that she did not answer the door in time... Don't you? Of course you do...

My sincere hope is that everyone can look past my not reading all 500+ posts and can think more about how they ship and recieve animals and make decisions accordingly...

Sammy, you declined my request for more direct communication. I hoped to be able to actually discuss the issues here instead of trading all this "you live in La-La land" crap (my paraphrase), as nothing has been accomplished in this thread, except some free porn, for several hundred posts. Fortunately, I have appealed to a couple of others, and still have hopes of a rationale discussion so as to enlighten myself.

Someone mentioned earlier the coincidence of a Jerry Springer participant actually now being a part of a thread ! Critical Bill I think. I think that Jenny Jones and Howard Stern were confirmed, but am not certain on Jerry. It is close enough though, and just one more of today's surprises. I think at one point today we both said "Damn!", ......... probably several times. Wasn't in anger either !

And to those of you who continue to participate in the early AM phone calls, animal inspectors (they were not happy at being a tool of harassment, BTW), and all the other trash emails from the sites that you log into and have sent on your alias behalf ..... heck, if nothing else, I am so glad to be an opposing view to yours here. It is well worth the cost of disagreement.

OK but how can you not have all the FACTS if you don't waste your time reading it all,I think she is a con artist and a dam pretty one at that.Yet i look past that, and i see skin is only so deep.She is low I've seen it,OK to say yea he should have packed ice.He's thinking she'll be their bright and early it was 86 when they left that evening,it allways drops temps at night.So i think if she would have been there"Like she should have" then they would have been fine,did you read the part about her betting that they wouldn't make it to her because of her Ups driver was an a**h*** and she didn't like "HIM" then it turns out it was a she.And she drove all the way home to find this,,then she said the driver was a witness to it being dead 33 miles away.I see to many changes in her story and she hasn't been back

In trying to sound knowledgeable you make yourself once again sound foolish. The "Brady Law" has nothing to do with state statutes regarding firearms possession and voting rights. As I said

voting and gun owning privileges are permanently denied for felons in most states

I don't know the law in your state, nor do I really care. You are a felon. That was my point.

Erik however notified her 4 days prior to shipping that he was going to ship via UPS, to which Wendy agreed, again never saying "no use my DHL account", she simply said "By all mans if you ever use a different shipper, feel free to do so!" as shown in her e-mail:
