I agree that Wendy hinted at using DHL but from what was posted, she didn't say no to UPS. Just based on past experiences she'd rather have DHL.

Yup, saw that part about her UPS guy... I left out the obvious which you seem to be the master of in which the animals may have been fine if she had gotten to the door fast enough... Didn't think the obvious needed to be said but you must be just too stupid... Let me say that again... But you must be just too stupid to see that I have recognised the fact that she should have been there... I even said it straight to the point that she should have answered the door on time...

And yup, I read that in his TOS also... I did not say anything to the contrary... You just too stupid again... To summarize what I have said in a really simple three year old format for you to understand... You cannot and should not hide behind your TOS if you are negligent... You have agreed that he should have used a cold pack...

I am not letting her off the hook at all but I am open enough to say that both sides made mistakes here and leave it at that... Can you?

Absolutely Sam. Erik, thanks for being a good sport watching this. It was meant to demonstrate to a few that mistakes, exagerations, spins, etc, are not always lies, and in fact usually are not. A few, such as Sammy (shrap), have thrown around the label "Liar" like its unwanted pennies in a pocket of chump change. Probably been used 100 times in this thread by all. IMO there was no obligation on your part to use DHL, although I will maintain that in hindsight, this could have been avoided by a more proactive buyer and/or seller.

There are other references Erik, but what is clear both with your thread starter, and well-established by post 107, about 7 hours later, was that you weren't interested in what your TOS said, weren't taking their calls, and weren't returning calls as you had spoken with them earlier. That includes being upset at Wendy's use of the "F" word but not returning a message left by Jeane, whose money was on the line.

You don't need to be "flexible" in honoring a "for any reason" satisfaction guarantee. Your TOS do not say "unless you curse at me, then all is void", which seems to be the after-deal-amendment. The customer was at fault for missing the delivery, but not for the animals being small and unsatisfactory. As I, and thankfully a few others, have maintained from the beginning, is that both shipper and receiver were at fault here.

That your ability to type and twist people's words somehow puts another block on your already high pedestal. What you don't realize, but most of us do, is that you are hurting only yourself. At some point, you have to ask yourself Jim, what are my posts worth? Is my defending someone like Wendy worth lost business? Business might be good right now but trust me, it would be better had you simply learn to keep your mouth shut. Or more importantly, learned to know right from wrong.
