If when you sent Wendy the photos to use for any reason, and perhaps failed to stipulate the conditions that she could use the photos, she is pretty much free to do with them as she pleases.

Not taking sides....just a fact.

When you give something to someone without explaining or outlining the conditions for its use you cant demand anything if its used in manner inconsistent with what you had in mind for it.

If you did set conditions for the photos use...then it shouldn't be to much trouble for you to post the email outlining any such conditions of its use.

Quite frankly I'm amazed that anyone would send her photos without expressing how they could be used when a small portion of complaints about her have been regarding the wrongful use of copyright photos.

I'd take you up on the offer of her autograph but I still ogle over my autographed Farrah Fawcett poster from the 70's. Lee Majors is a six million dollar shmuck if you ask me.

Here's the basic story as I sent to another member, though I have added more details to fully clarify:
Wendy signed a note, they are still posting and selling the lizards using my pictures from my web site and won't finish paying for them when payment was supposed to be made when my husband delivered them. It was all very upsetting and I wanted to wait, they didn't and I was 2 days out of surgery. I had one deal with them 2 years ago and they did pay me off over time so I was hesitant but went along when my husband called they did not have all the money, so he made her sign a note. (attached).

I had no idea of the problems others were having with these people as I had not been to or read these forums in a very long time.

The funny part he said was she did not even look in the boxes when she met my husband and never said it was short till after he started counting. He just noted it was odd and no sgreement for terms or partial payments had been agreed to. She then said it was all her mother could get out of the machine in 2 days and had MAILED the balance already. (we should have been smarter there, but remeber we had had a good deal previous, and I was at home fresh out of the hospital from a hysterectomy.)

Then the crap about not happy and when I offered to pick them up and refund her her money she shut me down and no return emails or phone calls, yes I have all emails and am waiting the verizon printout of calls to them and none to me. It wasn't for 9 or 10 days or so, dates below...she finally emailed me a crap cease and desist thing and offered to let me pick them up if I paid her feeder and electric bill??? Still would not talk to us personally and there was NEVER any foul language or threats from either side. Meanwhile mind you all along these Crimson dragons are posted at kingsnake and reptile auction and her web site and I am supposed to believe I would get them all back? My hubby went by there house anyway and then took my kid for ice cream and to get a pen, ok he was ill prepared, and left a note on their door as he was again prepared to pick them up or collect (9-8) on his way to the airport. That is what prompted the email from them finally and they said he was "stalking". Anyway, she agreed to purchase on the 8-27, I had surgery on on 8-28, and the lizards were delivered to Wendy in a walgreens parking lot on 8-30 in Coeur d'Alene, ID. My last email with from them 8-31, until 9-8, when I am informed to cease and desit any further communication in an email and wendy says the deal was with her mom and she owes nothiong and her moms owes nothing either. She also wanted feeder bils and utility bills. Not a single call if she was so unhappy or set a time I could pick them...still selling them though! If she wasn't happy she should have allowed me to pick them up, not ignore me for over a week when I am local) if they were not healthy as she later claimes why was selling the very next day on kingsnake with her 100% health guarantee?

I sold her a 40 lot of dragons, 2 clutches sired by my Crimson male ans 2 separate females, 3 to 6 weeks of age for 1000.00 and a 5 lot of juvenile red females from my crimson male for 325.00 reserved from 2 previous clutches.

I also gave her a pair of horny toads that I had got last yer as a trio of wild-caughts, one female had died, they had never done well in captivity and the female of that pairo was very thin, I knew she had horny toads and had told me they were doing well with them and she had no problems with their particular needs, again, I GAVE them to her.

My regular lot buyer shows up in an email 2 hours after agreeing to sell them to her, and I would have gladly picked them up and refunded her money if she was so unhappy, I had my regular really ticked I had sold them while he was gone. he and another person were HOPING I could get them back so they could have them.

Another note on this deal, there has not been any fould language used by either party, yet on the phone or in emails to date, I regret the sale horribly, I just want my money, I am preparing a court case, and they still are ignoring me. I also have the deposit slip I made of their money, I had held it for over a week so I could get my dragons back, hoping at least. I don't want them back anymore, no gurantee how they have been housed, sold off or anything else and with the health issues I am hearing about on all their other animals I would be scared to bring them back.

Sorry for any typos or errors in advance...Am I missing any reason I should not be paid?

For the record, this banning was not done to get new people over. It was done because a history of crappy service, lying and general deciept was well established by these two. It just took a looooooooooooooooooong time to actually lower the axe.

No one asked me to get people to post over there or anything like that. I just thought it would be cool to have another good, honest, reliable place to post ads. Someplace where if you can PROVE someone is not being honest, something will be done about it to keep the good guys, the honest breeders and sellers, away from the scum of the industry.

She was called on 9-5 by my husband and was told to stop using my pictures and selling these dragons and to call us.

To heck with Yellow Brick or ding dong, more a feeling of #to dream the impossible dream#. I do applaud them removing her, it might save some people some heartache and certainly some headaches!!!!!

PS: I never said land, its water, that's the joke of it.... But I do own an unbuildable lot down there, you can take over paying the taxes if you want, that is all it is good for unless you want to tie an airboat up on it overnight.

What is funny is how many people emailed or pm'ed me for the 3 screen shots of her ad on the rankins and her answering questions, removing them, changed the "pure" in the ad and then changing it back just to see them, or who asked for them and affidavits as they have court cases with her or are filing them. All these people need to add their stories here!

You were informed wrong. As you admit, you gave her permission to use the photos and did not clearly state that you reserve the right to cancel permission of use for any reason at any time.

If you have that written down and agreed to by Wendy urine luck.

I'm familiar with copyright laws and doing searches. What you're stating only applies when permission has not been granted or when conditions for use have been violated. Again.....you set no conditions for use and she had your express permission. Doesn't matter if you have a little copyright logo and your name on the photos. She can use those photos with the unconditional express permission you granted back in 2004 and everyday forward.

It sucks, I know, but thats the way it is.

People I will post the case law as we can determine the applications as soon as it is made available to me. This may not be until next however due to the immense amount of legal stuff that needs to be reviewed.

What I am told right now preliminary only and how it is being interpreted to this case is she had implied permission to use these pictures in how they were furnished for the sale and for her re-sale, however when she/they failed to FINISH the purchase all terms and agreements implied or otherwise are then voided. She had no previous permission to use these pictures, though I had not stopped their use prior to this transaction but that does not give her freedom of use when she is notified by the sole owner(s) to desist and THEY must provide WRITTEN, on paper and signed, permission to use material for the purpose of profit. Emails and their admissibility into evidence is a big field due to the ability to alter/edit information. In the case of a small claims matter it will be up to the judge and the amount of supporting evidence he/she will hear and the weight given to it.
Obviously I have made a lot of mistakes in this deal and in being lax, etc. But we are all going to learn as we go.

I just went and checked reptile auctions....boy it is nice not to see the site flooded with ads from them. Maybe the rest of us who care about the dragons we sell can have a half a chance to sell some healthy dragons!

I have to agree, I am also getting ready to post some classifieds on there as I have been watching latley and the TRASH is indeed being taken out. Used to be a slum(perfect for Wendy) but now seems to be pretty spiffy

This seems like her usual pattern. At least you're not getting the nasty emails. Until she sees your post that is. There's no reason you shouldn't get paid but the liklyhood of it happening is slim. At least with their actions they're finding fewer places to sell from.

Great Crested Breeder (GOOD GUY!)

I just had a great ordering experience with Crested Geckos and I'd like to share.



These crested geckos are Lively, Active and very healthy! I had ordered 3 other babies around the same time from a different breeder and they are nowhere near as active or healthy. Now that said I'd like to tell you about my experience.



I placed my first order for 3 baby-crested geckos on October 31st.

I asked that they be shipped the following Monday November 6th I believe and the vendor was more than compliant. The Sunday before they were to be shipped I decided to save on shipping I would order 2 more crested geckos from this Breeder as apposed to another breeder. I made a payment via paypal and and sent an email requesting the geckos be added to the original order. I never asked if I could do this nor did I ask for confirmation that they were still available.



In my order that arrived Tuesday the 7th I got only the 3 from the first Order and they were in great shape much better then the other delivery of cresteds I got that day from a different breeder.



When I informed the breeder that I had only received 3 of the 5 and I had added 2 to my order. I exclaimed full responsibility for the last minute order and offered to pay shipping on the other two and this was the reply I got:



"oh crud. Thats my fault. Send me the 2 pics, if you can. I took them all down and dumped them. Re did shots last night. If you dont have pics saved. I am right smack in the middle of moving, thats why such a mess. Again I am soooooooooo sorry. I'm a ding bat! Don't worry about shipping I'll send them right out"



I was astonished at how nice and generous this person was considering I offered to pay shipping on the second order. The breeder also found pictures and sent me them to confirm that they were the ones I ordered.



I received my 2 Crested Geckos the following Thursday as I requested and they were in as good a condition as the first Crested I ordered from this breeder. Now when these crested geckos came in I was not sure if they were the ones I ordered and I had not saved the pictures. When I asked Wendy about this she gladly sent me pictures that I am sure are the same ones. Once the night came around these little guys fired up just like the pictures and I felt horrible for even questioning them. The Crested Geckos looked as good as they did in the pictures!!!!



These Crested's are very healthy and active at night with beautiful colorations and I must say at a more then reasonable price. Communication was great and I will be buying more Geckos from this breeder in the future!!


I give Wendy from Crazy Cresties a 100% grade A+ with a 100% customer satisfaction!!! If you have any questions about my dealing with Wendy please ask I will be more then happy to answer them.
