Now this gets into a whole other can of worms. Ken was having problems with his paypal acct and needed to order two air purifiers. He called Sal and asked if Sal could run his credit card for the amount and forward it on to the guy with the air purifiers. Sal said no problem. A week later air purifier guy still has not received, Ken calls Sal, Sal says oh im sorry i forgot ill get that done. This transaction was never done. Eventually Sal tells Ken he needed all the money he could scrape up due to personal problems. Sal agreed to send the money to Ken's paypal acct which is by this time working. It is sent through Moonlit's paypal acct and then promptly canceled. I would have never posted something like this to this board had it not been for Alison starting this. Sad thing is if Sal had said "hey I need to borrow some money", Ken would have let him have the money.

Now......I will post everything as it comes to me. My life does NOT revolve around this BOI forum. In the past 3 weeks I have moved 700 miles, started a new job, was staying with friends until we got our new house amd working 10-12 hour days everyday here. Yes I spent my entire weekend moving and just dropped by the shop occasionally to check on things. I am so sorry I did not jump through hoops to get things posted for yall to read here. I was up until 3am this morning finishing up the move. Now I have posted what I have, and when Ken gets back to the office I will get the digicam and upload the pics from it of the dead animals from the freezer or we can snap a few shots from our sprintpcs phone and upload them but the quality is not near as good. I will also speak with Ken's personal assistant as to bank records on funds sent to upstate.

I feel for you with all you obviously have to do, but you really shouldn't feel like you need to do US any favors. After all, it's YOUR boss that's trying to save HIS reputation in all this.

If it's turning out to be too much trouble, leave it all as it is, and people will make up their own minds about Elite Reptile and Ken. I'm sure he won't mind . . .

So far all I see is, cough cough ack phetooeww eck cough, that what alison said is true. They ordered animals for ken to be delivered to them. They sent part of the shipment to ken. She said she was sending the balance of the shipment to him yesterday. If she did that then the deal is done and completed. As far as the animals go that were ordered from global. Unless ken has sent her personal snakes back then that deal is not finished. If she has not released the domaine name then that deal is not complete. But, all the paperwork you have shown backs up what she originally said. There are animals that she has listed as sent to ken that are not even mentioned on your lists. This may have been before you were involved.

This is a very large mess that I am beginning to wonder is even here. If ken has such a nut to get upchuck, then the courts are the place to go. From what I can see, once they have sent him the balance of the initial order and the domaine name, upchuck has fulfilled all obligations. ken, on the other hand still needs to deal with the website and the animals alison sent him before the global order. Any one else care to comment on this? I'm curious to see if I have the right take on it.

As far as any deal for air purifiers, that is not animal related and does not belong here, just more gorilla pooslinging.

So, kids, either work it out amongst yourselves or take it to court.

I have to agree with Wes here, all I have seen so far is proof that what Alison stated originally was what has taken place so far. If Alison did send the animals yesterday then so far she is still ok.


Just a couple of notes on some of the things I see, anyone please jump in and help with explanations.

On the Airborne Bill it looks like that is something that Elite sent to US Global directly and I am wondering what part of this it might be. Also no offense but cant be alot of animals for $25.00

The PayPal bill shows the canceled payment, now I dont use paypal that much but doesnt the receiver have to cancel the transaction. And all we know about that is there was a canceled payment no info as to if its purifiers or what? Also the PayPal bill does show bills from Moonlight Media that arent paid as Alison stated.

Well interesting info but really doesnt say much.

Going back to the waiting game.

OOPS got the two scans mixed up. That last post was the pmt to Reptiles/Fancy Publications for advertising in Reptiles Mag. Ken paid this and is getting ready to pay it again for this month. Upstate will once again get free advertising on us this month due to not being able to stop the presses for this month on the advertising.

This scan is the credit card pmt.

This is going to court, there is no doubt there. If anyone else has any questions email me please.

As far as the pics of the dead animals, someone was asking for them so I was going to post them. It seems its not necessary now. Its just that Alison said she kept the sick/non-feeders and sent Ken the ones that were ready to sell. This is simply not the case.

I dont know the whole deal on the previous "personal" animals that were sent to Ken but wouldnt you think that the advertising for the last two months alone in Reptiles Mag would more than cover that. lol (JUST MY PERSONAL OPINION HERE) As far as the green tree python goes, that animal has been in Ken's personal collection longer than he has even known who Upstate was. Ken is still searching bank records for me as time permits to find the funds sent to Upstate.

It is now 7:10PM Eastern Time and we have NOT received any shipment from Upstate and dont expect to.

As far as I and Ken are concerned, the proof has been posted, the questions have been answered and this is a closed matter.

Take it to court. There is so little truth telling going on here that I wonder why you even bother posting more useless crap. Neither of you have a shred of credibility.

Personally, if I heard nothing from any of you until court records were posted I would be most pleased. Can you do that? Please.

The deal on the first publication was since I designed it and dealt directly with the press, Ken would pay for the ad...but we did offer to pay him for the ad in reptiles mag when this all started....

And if you think that ALL the animals we sent to ken (Well over $2500) covers a $500 ad...you must either be really bad at mathematics, or your boss really isn't giving you the whole story here...

And that tree python....you've only been there 2 weeks...but somehow KNOW FOR A FACT that has been in ken's collection since before he knew of us...(well over 3 months)...pretty good..

So explain this...why do I have pictures of that animal here? Ken also stated earlier that he has a bank receipt for THOSE EXACT ANIMALS....the receipt he said he would just go online and copy & paste...what, now he can't find his computer screen to do that...now he has to "search" for those records?

I also wanted to add that Ken will be at the SC show...I am curious if anyone is going there if they can keep their eyes opened for OUR animals...the list I posted...

I'm sure Ken is holding out on selling those animals on KS as he knows that everyone will see them there....

I'm curious to know how much money he's going to make at the show off my animals....I do have pictures of all the stock we sent him that is OURS if anyone would like them to compare...

anja, I'm just guessing here but, it seems as if you are thinking that your continuing to run the ad in Reptiles is somehow lessening your debt with alison.

First in order for this to be true, which it isn't but we'll get to that in a minute, but for that to be true, you have to acknowledge that there IS INDEED a debt owed by ken to alison. So, you've admitted that ken DOES owe alison money. Very good.

Second, you cannot, after severing ties, hold her responsible to any obligations made by ken, whether or not they benifit her. He broke the partnership, severed all ties, and is therefore responsible for any future bills for the now nonexistant partnership. Did his crack "legal staff" tell you how this is the proper way to conduct a business? If so, then perhaps he should get someone WITH a law degree and not a shyster to give him advise in legal matters.

Take Darin's advise to heart. When ken crashes and burns, which it seems can't be far off, you would be better off if you had some other options than just watching the flames.

1.2 Jungle Carpet Pythons These guys are aggressive feeders on
frozen/thawed jumbos, they go through them like crazy. These guys are ready to

We also have a trio of Queensland Carpets, both females are CBB01 and
about 5FT, the male is CBB02 and about 3FT give or take. We will take

Hey Gorillaboy, er, ken, I've got a beautiful boa in my freezer. She died a long time ago and I just couldn't bear to get rid of her. I'd had her from a baby. If I send her to you can you bring her back to life too, like that kingsnake? Or are you limited to only bringing back to life the snakes that you got from upchuck, you know, the ones you claimed were dead?

Again, you seem rather level-headed. Really, it's obvious, is it not, that those two pics are of the exact same snake. Do whatever you can to get Ken to see the light on this. You'll be doing him a real favor, if you can!
