I always feel the same way. For lack of a better term, the "seasoned veterans" have a very pompous air around them on this site, to the point that they act like anybody who does not agree with them completely is an idiot.

It is really sad that it appears Wayne is getting raked over coals when he very clearly had $10G STOLEN from him. Some people don't have better things to do I guess.

Really? I think I'll go back and read this thread to see what most people have stated.

Wayne is a great guy, I have done business with him in the past and will do more in the future. Very honest business person and always goes out od his way to help others. I hope this gets resolved. If you have the ability to help him in anyway please do knowing that he would help you if he knew you needed it. There are a lot of shifty people in this business and we need to police them ourselves.i say that because I have been scammed out of a few thousand dollars asmall well and had no recourse. We have to hold these crooks accountable!

I don't often comment, but this one seems so obvious to me as to who is right: Wayne, I think you are in the right, without a doubt. Remind me never to ask Branden for "help" if this is his idea of "helping" you - takes your snakes, and is unable to complete the deal as agreed upon, and refuses to send cash. So, Branden now has everything, and you have nothing.
Since Branden apparently can't come up with the agreed-upon roaches immediately, then he should send your snakes back, or send you the cash value. Immediately.

I have to side with Wayne on this one, the deal was made and roaches were set asside for him..

so no matter if they morphed into adults, they are his roaches..

best example i could give to compare!!! is someone making a deal on a bunch of baby snakes that are not sexed yet.. you fix an agreed pricing for them,, then if it takes two weeks to ship and the guy decides to sex the snakes and realizes they are all females and should be worth twice as much !!!! the deal was made plain and simple... he can't turn around and change the deal and price to suite his needs..

If he had shipped the roaches when he was supposed to, this wouldn't be an issue..

either he sends him the roaches that were set asside for him
or
send back his snakes, even the stolen ones that his brother took

Branden breeched the contract.
He agreed to the terms, of the deal, and failed, miserably, in upholding his end of it.
Therefore, Branden is, completely, in the wrong.

Worse yet, it appears (later) that Branden did not even have enough roaches, to begin with (in order to uphold his end), while making the deal with Wayne.

After deal was made, and after receiving the snakes, Branden decided to change the terms of the deal (breeched contract). Branden also refused to send Wayne's snakes back when it was requested (since Branden could not uphold his end).
He should have returned the snakes.

It appears that Branden had, immediately, sold a couple/few of the snakes that Wayne sent him. This seems to be what Branden told Wayne when Wayne requested his snakes back (after finding that Branden could not complete the deal).
Branden, apparently, kept the proceeds, of the snake sales, and didn't have the decency to even think of offering some of it to Wayne (in consideration that he owes Wayne roaches that he cannot provide).
Plus refuses (again) to send what snakes he has left when Wayne, then, requested that.

Meanwhile Branden is trying to get Wayne to agree on different, and unacceptable, terms re. the roaches.
This is, all, so wrong!

Then let's get right down to the bottom-line. Up front he sent you the snakes that were agreed upon for $10k plus extra. There was a set time frame for the deal. It didn't happen.

The deal didn't transpire liked agreed and there was a attempted to modify the deal to make it work. It didn't work.

At this point it would be better just to work out the difference that was sent in the one box and ship the snakes back. No reason to continue this.Just return the snakes.

Five years of good business practices means nothing if you walk with $10k worth of snakes and provide nothing. Its not a little speed bump. You have the snakes and he doesn't have his order. Stating you can't please everyone just isn't going to cut it. Trying to finish this deal I don't think is going to work. Its sour and not worth disputing counts on every box of roaches. Just end it.

Branden, bottom line is that YOU have the power to end all of this by either sending Wayne's snakes back or paying him the value of the snakes (even if it means eating a little less expensive dinners while out ).

The matter that Wayne stated that he will seek legal action (something which you are forcing his hand in having no other recourse) is immaterial and does not give you the right to wrong somebody.
If you do as has been suggested <*POOF*> legal action, &/or talk of legal action, disappears.

I have had dealings with wayne for many years now. He has always been upfront and honest in every transaction. When things gone wrong unexpectedly, he tries in every way to bend backwards to make it right. I have to say that this deal is cut and dry. Brandon has 10k worth of snakes, wayne (or dan, rather) has 181.00 worth of roaches. Plain and simple! How much more does wayne have to bend, hes willing to take back the animals, the roaches that are owed, or cash. This is crazy!

This was one of the biggest headaches of a BOI thread I have ever read... but well worth it and I'm glad the fraud responded.


Not even ONCE does Branden respond cordially by saying "y'know what... here's the rest of your animals back, I can't fulfill my end of the original deal and I messed up"

He apologized for not responding sooner on the 7th because it was his birthday, then when someone posted the pic from facebook, he Said that was from his birthday, but he claimed they were stolen before then? He was foolish enough to give photographic proof that he lied about them bieng stolen? Another thing I'm almost 100% certain of is that you can't take ball pythons to australia. There ARE online legal forums, kind of like this one, where you'd be able to have lawers, law students, prosecutors and others who would be willing to review this for you, I'd would suggest you look for one, put all your info together, in order, in a manner that's easy to understand and see what they tell you. I doubt that an llc covers fraud, if he even has one. If you do this, include the info that Josh Baity brought up, about the shipping a dresses and whatnot. Has anyone considered that he might have ordered roaches from someone, and asked them to ship them to you, with his name as the sender? I'd look into that too, would prove he never had roaches in the first place, and you might find out how much he paid for what few roaches he did send you. I've got a few other ideas if you want to pm me. On another note, I've seen in the past that other people have had much much greater success going to the police in the city the scammer is from than attempting to have the police in their area contact police in the scammers area. I hope you get this solved, the thing that posses me off the most is how he nonchalantly incinuates that he owes you nothing.

There is one poster "Lucille" asking to see the police report and making statements about it's a "old tactic". I would hardly state that is raking him over the coals by the "seasoned veterans" of this forum. While Lucille or anyone can post questions, nobody is under in obligation to respond or they can respond as they wish. You certainly have the ability to counter anything she states as anyone else does. Her points and questions are no more important than yours.

Let's not start attacking the forum or those that contribute to it regularly because you simply disagree with one poster. Counter it with your own points about the situation.

From my point of view, the OP was stolen from. The claim that his brother stole some snakes shouldn't even be a concern for the OP. It's the concern of the target of this thread. He should deal with it however he needs to. Get the snakes back or send the cash, if they were even stolen in the first place.

With my perception in mind, the questioning about the police report and such seems out of place because I personal believe the OP is being wronged.
I hope he filed a police report because I think he should.

They agreed on the value of the snakes at 10K plus a extra snake was sent.

We now have one party claiming what was sent in roaches was close to $200 and other party if I remember correctly around a 1K.

So why don't we just take care of the other $9k worth of animals first that was sent and wasn't compensated for within the two timelines given in the deal? Hell, let him keep the extra snake sent then work on the discrepancies on the worth of this roach package?

As far as I can tell the OP is the only person wronged here. He did nothing but send 10k worth of animals with the promise that specific sizes of roaches would be sent.

Whatever the reason the roaches weren't sent, It doesn't matter.

The man sent the snakes as promised. The roaches were not sent as promised.

The person who upheld his part of the agreement is now the one who has to work out the deal and comprise with the person that has his animals for something he doesn't want at prices he doesn't want? I don't think that is right.

He's the one that has to make concessions and take a alternate deal? He is the one trying to get his property or the value of that property back.

What did the OP do wrong? Nothing but trust that he would get what was promised.

As a site we don't control the opinions of others. In most cases if you state your case with evidence of your claim there will be a clear majority opinion.
Sometimes it isn't as clear.

One thing were not going to put up with is attacking the site and the contributing members in general for allowing people to post their opinions.
Keep it on topic.

The charge would be theft by deception genius. Since the valuation of the animals exceeds the felony amount of $1,500, it absolutely will be a felony charge. The crazy part is that you continue to question him, as if it were his fault, even with everything he provided.

Right. IMO, Wayne has meticulously and convincingly made his case. It's Branden's place to defend himself here and I don't see that he has credibly done so. Let's let the justice system handle it, and not cause any more stress to Wayne.

I will make note of your names, and when (if?) someone makes a negative BOI thread about either of you, then I will not allow anyone to question the authors of such threads, nor the statements they make about you. Yours will be special test cases to see how this different methodology you seem to prefer works out. How does that sound to you?

It's so very obvious he's a fraudster, and his tactics could have come straight from page 1 of Scamming for Dummies, e.g. trying to change the terms of the deal after you held up your part, delaying and stalling, trying to make you feel/appear unreasonable, overvaluing his own goods (seriously, an f'ing $1 per adult that you could sell at trade shows!?!?!? That's a far cry from your friend that wholesales AS AGREED).

Yes. I have been meaning to post the police report and an update, I'm just ridiculously busy. Unfortunately life doesn't slow down for speed bumps. I just happen to see I had an email that said a post was made. Unfortunately Branden is still unwilling to make things right and I have not heard from him other than his replies here. Besides, unless he's sending back my animals, which at this point who knows what health they are in or how many females he need them to, or sending me cash, I have nothing to say to him. I only read about 5 of the 14 pages of this thread so sorry if my questions have already been answered.
I don't understand why anything was put aside to begin with if u agree on the prices and the sizes, it's not Waynes fault that u put some aside and they grew, u should have taken his roaches the day before you mailed them at the sizes u agreed on. That's like me going to a pet store and saying hey I want 1000 small crickets in a week and I go there and they say sorry we didn't get the shipment in till 2 weeks so now their adults and they're going to be x amount more, it's not my fault that shipping got messed up its on the seller, especially when Wayne said he would pay the difference for same day, there is no excuse for the roaches to not be sent that day, unless of course he didn't have them to begin with. Obviously a deal of that price is going to take some time to complete agree on everything why would u pick the roaches right away. That's like a chef cooking 2 things one on which takes a hour to cook and one that takes 25 mins to cook and start cooking them at the same time. No the chef would wait them put the quicker thing on the grill (or w.e) obviously my comparison isn't the best but I hope u get my point

I know Dro B and I hope my reply wasn't mean. I have the copy in the glove box of the Jeep and I'll be honest, I just haven't felt like walking out in the rain the last 2 days to get it. Plus, unless my email alert goes off, I try not to think about this anymore. It's in the right and extremely capable hands of my friend Bob and his people. I promise I will keep this thread updated because the more people post here, when you google this clown's name, this is starting to pop up. If he ever goes for a job or anyone looks him up, the current third thing on the google search is this. Again, I don't think clownboy realizes how this can possibly affect him long term, but he brought it on himself. That or he truly doesn't care people will see he's a thief.
