Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Lisa, I understand all you are saying. Just FYI, though, I am relatively old as well as old-fashioned. I remember the days when all the ads were placed in the appropriate magazines and the responses were all made by land line phone and/or US Mail (or if the buyer was in a real hurry, one of the other carriers' Next Day Letters).

Hence I still do not use any online or CC payment methods for my animal dealings, so there is no danger of me selling an animal to someone in person while someone else thinks they have just bought it online. I contact potential buyers in the same order in which emails expressing interest are received. It keeps things much simpler for me.

In this case, both the buyer and the seller could have done better for the reasons I have already posted. That's all I am trying to say.
 
A central point to this entire discussion is whether the seller accidentally had an ad up due to automatic re-publishing, and clearly disclosed that the advertised critter was not available, or whether this was a bait and switch. (This is more difficult than it seems, IMHO due to the buyer saying in writing that there was another critter he wanted from another vendor after paying, and due to the mounting drama of the buyer's description of the issue).


Anyway, as far as the post quoted above, (I realize this seller is not Kmart but I believe the quote should be addressed) here is what the Texas Deceptive Trade Practices Act has to say, below is one of the list of illegal practices:

Advertising goods or services with intent not to supply a reasonable expectable public demand, unless the advertisements disclosed a limitation of quantity;

In one of my posts referring to Kmart, I stated that normally they will have a disclaimer in small print that states "while supplies last".. but they are dealing with mass quantities, a large number of stores, and supply and demand can not always be kept.. this is on a much smaller scale.. but to me, same concept...

I think when people list animals online and there is only one of that animal (which is usually the case), it shouldn't be automatically assumed that they are keeping that animal listed in hopes to trick people into buying something else. People might not always be able to get to the computer to remove or alter an add within seconds of the item being sold, so there is always a chance someone will email during the process and be disappointed. Like it was stated above, no one forced anyone to buy anything at all... and the agreement was for the only male left after it was made clear that the add relisted and seller had no clue.. and snake #1 was no longer available. (regardless of who got the snake).

I can see this happening.. if my 15 year old daughter came to me and said mom, I really like "Jake".. instead of selling him, can I have him... I would most likely say yes. It doesn't mean I had sellers remorse.. It just means I gave into the request of my kid.. If seller was under the impression the add was down, when it actually auto relisted.. it would be an honest mistake.. You can see the confusion in the first emails, and the seller stated why there was confusion.. he had no clue the add was even still up.


Did anyone ask where the emails were that came before this one?

no no, I fully understand.. please dont take anything I say as being upset or impersonal.. I type 76wpm and tend to get very technical with things at times... I fully agree with you.. there are things they both should have done... the sad part is that there WAS a misunderstanding, and there are things on both sides that should have been done, and shouldn't have been said. Its a coulda, woulda, shoulda thing..


With new ways to advertise, and sell animals, there is always a chance for something to go wrong. I can see the buyer being upset if there was a "buy now" option and he paid for the animal before talking to the seller.. but this wasn't the case.. no money was exchanged before he was informed the add shouldn't have auto listed and snake #1 was no longer available. He agreed to the only male snake the seller had, and a female.. THEN paid.. I think it was clear snake #1 wasn't available before money was sent, and buyer wasn't happy with that.. he shouldn't have agreed to the other snake.
 
The facts are #1 He agreed to sell me the Ghost Boa for $400 and 2 hours later changed his mind and said his Daughter wanted it.This was after I asked to get a female boa also. Then He told me could do this one and this one for $460 I didnt respond right away cause I was not on the computer.Then he offered both for $460.
He told me the one he was trying to sell me was the only one left, I saw a good one still listed on kingsnake and fauna so when he said I will still honor the $425
for both if we can get this done . I sent him the money. I felt rushed cause I didnt want to miss out .Later after I took a better look at the snake I realized it was the
most undesireable of the 3 in question. His ad was up for the other on yet he took down the first one. Really this Guy was yanking me around!+ Later he refused to refund my money till 2 1/2 weeks.
 
So Chris, it appears that you are saying that Smoky Mountain Reptiles was the seller for all three of the males which you wanted? And that when you agreed to buy snake #2 and had paid for it, you then saw the ad for snake #3 on KS and decided you would rather have that one since you liked it better than the #2?

Then, when he said you couldn't have either the #1 or the #2 males, you sent him the email demanding the refund or snake #1 or you would post this BOI thread?

I think you need to answer these questions directly so everyone can understand this more fully because it is obvious that some people think the snake you said liked better on KS was from a different seller.

A lot of people responding , think I was trying to buy someone elses snake. That was after he refused to give me my money back.
 
In the Email where he said the one I messaged him with is the same one,
That is where he Deceived me I messaged him about Snake #2 that I would accept as a sub for #1.
 
In fact after looking at the email again, I Am not at fault at all. He lied to me, and told me that was the one and later said they look alike . This is Way out of line.
 
Nice to know he learned how to take the ads down after he sold all the snakes he wanted to sell.


I think after realizing the add auto listed, he removed them fully as well as the one Chris "purchased".. that's a possibility..


and Chris, he didn't REFUSE to give your money back, he just didn't have it right away so it would have been delayed... he only refused shipping since it was already paid.. in which case, I would wonder if he could have been refunded if it wasn't used. Some places will refund someones money less a "restock" fee.. which is normally a %... depends on their TOS.
