Let him take you to court... then print off EVERY thread here about him and take it with you. You have nothing to worry about. The court will see his character very quickly.

This is standard operating procedure for a lot of bad guys around here! You see someone claim to pursue legal action when they are losing their argument here on the BOI! They hope that by threatening this you will drop the issue.

To the best of my knowledge there is NOTHING he can sue you for! He will claim slander/defamation of character/or some other B.S. but that won't hold up.

I have not read Dan's other threads and was baseing what I wrote off his emails. He asked Brett for time to figure out a solution and Dan did state that he was going to make it right but that was not good enough for Brett. Sorry, Scooter but by your own admission you checked your porch at 11:30 which meant the package had been sitting there for 90 minutes exposed to the elements......first you said it was a little below 60 degrees and then later you bumped that figure up to 70....which is it?

To play devil's advocate, if the lizards were not shipped in something comparable to a shoebox they would have stood a better chance of arriving safely.

Blank statement here: I am the only one in my family who is not an attorney so I have it on pretty good authority that any mention of "legal action" in any capacity is a complete and utter joke........it will never happen so please stop threatening it and certainly don't ever be scared by the ignorant threat.

If you would take the time to read other threads he replied to before he was banned... you'd change your mind real quick. Some of us actually have been here long enough to witness Dan first hand.... and that is NOT a grievence against you. That is a fact.

The reason you are getting a strong response is because the bolded part is completely and utterly untrue based on Dan's reputation and the way he has handled similar situations previously.

The lizards got here at 9:58 am according to UPS so I assume that by that time the temp would have been around 60F degrees maybe a little warmer and they sat there for about an hour and half in which time the temp couldn't have been to much more than 70F. And when you consider that this species optimal temp is 79F to 80F, then I don't think, this argument based on them being exposed, really hold up. Especially since the heat pack failed! They must have died in transit and that explains the smell that they were exuding.

Will you look at that, a cool little useful website and a well thought out logical argument......well done.

My suggestion is to find a way to be nice to Dan, since he has all the cards and probably really does not care what anyone on here thinks of him, and convince him to ship a new set of skinks to his buddy who can then deliver them to you in person at which point you then give him the 2 frozen lizards. Freeze them since too much time has passed to do any sort of meaningful tests. I know you don't want another pair from him but I think that may be your only option.

The pictures you provided Dan were very dark and I am confident Dan wanted them frozen and shipped back for identification......you may have switched them out in hopes of getting something for free.

You can say that everybody on here has a false claim but the way he replies to these claims tells you all you need to know about him. Wait.......when did I say "everybody" on here has a false claim? Based on the info in the emails alone I stated the facts as I saw them. Nowhere in those emails does Brett indicate that the animals were shipped in an uninsulated box.......I can assure you that had I known that from the beginning my posts would have been different.

There is no way the hour and a half on a porch did those skinks in. How warm and cozy does he (or anyone with that argument) think it was in the belly of a plane, out on a tarmac, or in the back of a truck in the late hours of the day or early hours in the morning?
