Ehhh dont let it bother you , you actually have the law on your side cause you went about it the right way ..
the judge will either throw him out of court or put all your fees and losses onto his tab for wasting the courts time ..
I'd even bet they will make an example out of him ..

its gonna bite him in the ass if hes actually serious about this ..
make sure if you do make it to court to get the officer that was present , called into court on your behalf ..

Thanks for this. He actually caused the officers such a problem and gave them such a hard time they said if he even thinks of going to court to not hesitate to call them as witnesses, so I plan to.
I also managed to re-download the program to get text logs from the iPhone to the computer, so I have it in writing where he admits he hasn't been doing his end of the deal.
Hopefully these shenanigans will be over with soon.

He, of course, fabricated a receipt and is demanding money for the care of my snakes, my corner of a table at Daytona, and emotional damages because I demanded he return my snakes to me because he was not holding his end of the agreement.

hey make sure you get those text messages printed out as well and take them in with you to prove he didnt plan on holding up his end of the deal . and again make sure you get the officer to accompany you to court as well , by time all said and done , the court will prolly throw it out and you may even get compensated for your troubles . who knows .. LOL

Only because that is the maximum he can sue you for in small claims court. That doesn't mean that's what he would be awarded if he would win.

He, of course, fabricated a receipt.

Excellent. Play his game. Now you call the IRS and tell them how he sells you feeders to the tune of $1,500.00 every few months and how he stated many times he prefers you pay him in cash so that he doesn't have to report that income and pay taxes.

Do that and just see if he has time for court while the IRS is crawling up his ass sideways.

Just wanted to update. Dartanya supplied the incorrect mailing address on all records to everyone involved, the court system as well as myself. All attempts at contact have been returned in the mail for incorrect address, even though it's to the address he supplied.

He showed up at court on Monday and demanded that I be incarcerated and held in contempt as well as a default judgement in his favor to the tune of some $1500.00 because I did not hand over my personal information to him, though I did mail an objection to both he and the court for his ludicrous demands, it was just never recieved because he lied to the courts about his mailing address.

Absolutely unbelievable drama, and I sincerely hope that everyone stays away from any dealings with him in the future.

damn, i just read this whole thread. this guy sounds like a loser. if you're supposedly a reputable breeder who sells at large conventions and have a snake that not many have possessing special genes, then why would you even need to do a breeding loan on affordable female snakes? (i noticed a mojave in there, though i didn't notice what else) you'd think they'd already be in the collection, especially if you've got some special gene carrier. it's good you got your snakes back.

Sorry to hear about your problems. Breeder loans are like trades. Someone always gets screwed and it is usually the person bringing the quality to the table.

As far as the show issue being discussed, I don't care what show it is, to believe that all the animals on the table are bread by the exhibitor is at best stupid. There are booths at shows were people are fronting for someone else and didn't breed a single animal on the table. One of the best reasons for buying top quality animals for breeding from the breeder, and leave expos for the pet buyers.

Good luck with your problem. Being new, learn fast from this little incident.

All of this has already been done.

I don't have the money to be petty and counter-sue, though I've thought of it. It's more of a waste of time.

He is trying to oversimplify things using his business name, not mentioning any sort of deal or agreement, and by fabricating a receipt listing all kinds of bogus charges.

Trust me, I'm working all my ducks in a row. This just infuriates me what a waste of time, money,gas and brainpower this all is.

Its always best to go in with the intent to burry him with evidence against him.... dont hope for a silver bullet.... and by all means. IF the other side files paperwork with the court to see your evidence... turn over ALL your evidence. I got sued once for a traffic accident and I had photographic proof that I had been sideswiped. The lawyer my company hired had watched too many movies and declined to turn over a copy of the photos. Because of that they could not be used in court and were kicked out.... and THEY WON!!! All because he didnt turn over all evidence.

This is about money, so I guess were talking about fabricating invoices. He can print out as many as he wants, he can make the bills for as much as he wants, but so long as her signature does not appear on any of those invoices they mean absolutely nothing. And they would need to be originals and not copies.

There is really nothing for her to submit other than that police report which clearly indicates she offered his stuff back and he refused it. That police officer is an extension of the court and his report is golden to that judge.

Update & An Apology

For those of you still remotely following this soap opera, I thought I would do a small update. I have been cautious to write anything about this, because I worry about retaliation from the other party involved, as their past civil records indicate they are not above committing violent or shady acts.. Not saying people can’t change, but it’s fairly obvious that is not the case in this situation.

Dartanya showed up at pre-trial conference on December 8th, and immediately demanded that the judge rule in his favor because I did not appear to the subpoena duces tecum without deposition. The judge promptly responded that Of course She didn’t show up, she filed a notice of Objection…To which Dartanya replied that he never received it. The judge then held up my submittal noting the failed communication attempts, showing that all correspondence from me and from the court had been returned due to improper address, because he apparently moved within about 3 hours away within a few days of all the drama.

I cannot discuss at length what happened during mediation, because it’s supposed to be confidential from what I understand, but I will only say that Dartanya is NOT the person that I met four years ago, or the person I thought he was. He made statements and claims, and told lies that were absolutely extraordinary and out-of-this-world unbelievable. One of the things was that he went so far as to claim he could not take back his rodent bins because of IBD. So you demand to the cops you want them back, refuse to take them back at the exchange, and is now claiming the bins have IBD contamination..Right.

At pre-trial we were ordered to supply copies of all evidence and documents to be used at the trial. I complied. As of today, he still has not. I have no idea who his witnesses are nor what evidence he has (that I believe is likely forged or fabricated). He claims to have 10 witnesses and 500 pieces of evidence. I have submitted proper requests to the court to have this entire nonsense thrown out because he has not complied with the court order, and is attempting trial by ambush. The judge has marked my request as received but has not commented, and after speaking with the JA she informed me that it would be addressed at the final trial hearing, which is January 29th.


I wanted to take this moment to apologize to a few people that I fear are probably going to be involved in this case and with Dartanya, and I wanted to let them be aware of a few things.

When Dartanya and I spoke in August concerning sharing table space at the Daytona expo, he told me I could put a few of my snakes on his table, no problem. There was never a mention of a charge or anything whatsoever. He even mentioned at the time using some of my snakes to trade for what “we” (implying breeding partners) needed for our projects. I did not know until I got into the actual expo that Dartanya himself, or GW Reptiles did not have a table at the Daytona expo, and that he was sharing a table and putting his own animals on someone ELSE'S table. Had I known that this was the case, I would not have asked to put any animals on the table without asking the person that paid for the table and whose table it rightfully was.
Not going to get into other people’s animals on tables at shows politics here, but I wanted to formally apologize to Eric and Denis Daily of Captive Bred Reptiles, as well as their friend Mike who I think was also at the table. I did not know that it was not actually Dartanya’s table until I looked at the vendor listing in the Expo Program, which has been sent as evidence in this trial, as he is claiming I owe a large sum for using “his table” at the expo.
I don’t know if Dartanya is involving you guys in any of this drama or not, but I know I said Thanks at the show, (even though nothing sold except you guys’ baby normals, ), but I wanted to say I am sorry for an inconvenience it may have caused. I will state here as well as in front of the judge, that if Denis or Eric Daily, whose table it actually was, feel that I owe them any kind of money for the 4 snakes I had on the corner of their table, to please contact me directly.
I also wanted to say that from the brief time we spent together and what I have heard other people mention of you all at Captive Bred Reptiles, you seem to be nice, respected people and I would be extremely careful associating with someone like Dartanya. He has proved, a several times over, that he cannot be trusted and he is willing to backstab and hurt a friend or a fellow breeder without a moment’s hesitation. I hope that if you continue to associate with him that you do not get hurt as I have.

It's so sad when people change like that. People you once trusted and knew so well...who turn into liars, thieves, and criminals. So sad....
