    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy David Ferguson ( hdavidf309 ) Sold unhealthy animals as RTB and shipped improperly

When it comes to the shipping side of all things I have apologized many times...and have learned my lesson. I take complete fault for the shipping...and she had stated in her PayPal emails that it wasn't her concern. The reason I shipped them out this way was because I have received geckos in the exact same manner from Jon Boone (want to state for the record that I am not bashing Jon Boone in anyway...he is a wonderful breeder). In the end I have learned my lesson regarding the shipping and will not be shipping any animals out that way again. I am very glad that she received them alive.

I don't remember you apologizing many times, I remember you stating that it was SYR's responsibility because you went through their account. You're right that that wasn't my concern though. I did receive them alive and was not asking for compensation for that. I was just informing you of what you did wrong and trying to educate you about the laws as a service to everyone in the reptile community. People that ship like you did risk everyone's ability to ship reptiles. I am glad you have learned your lesson and won't do that again. If nothing else good comes out of this situation, at least there is that.

When it comes to these claims I am very leery of giving anything back to her. She never offered to send them back for a refund. She has completely stated her issues with me and even hit below the belt in her emails. I have tried to not sink to her level...which has been very hard not to do. I had concerns with dealing with her from the beginning. She showed in the above text messages that she wanted to be in control of the shipping time frame of when she received them...which is completely out of my control. I feel like I am being scammed a bit myself. She has posted the majority of my phone number on this thread and now I am concerned about fraud...I never agreed for her to post any part of my number on this thread...THIS IS NOT OK! All it takes is some time and number searching to get my complete number, and additional personal information.

Please remember when judging me that I am not the only person involved. I didn't want to respond to her right away because I have been caught up with my family and job...I am not a store and just breed in my spare time. She also came at me aggressively regarding this issue several days later...it made me wonder what her real reason was for wanting her money back.

I did not try to dictate the arrival time of the package. When they had not arrived by the time that I expected them to, I looked at the tracking info and it gave an estimate of arrival by 4PM which would not have been acceptable on a hot day like that and I was concerned for them. I did not (and still do not) blame you for Fedex running late, I just wanted to confirm that you had shipped them Priority Overnight which you had.

It was not my responsibility to come up with terms to fix the situation, that was on you. You should have offered to take them back for a refund. I gave you multiple opportunities to come up with a solution that was acceptable to you before I proposed my own.

What concerns did you have with dealing with me from the beginning? Everything was smooth until the day that they arrived as far as I can see. I absolutely am not trying to scam you.

As for the phone number, I do apologize for that. I did not do that intentionally. I was paying attention to the messages and didn't notice that it had most of your number visible at the top. I would have blacked it out if I realized that. You do post your number in all of your ads though so I don't think you are actually concerned about that, I think you are trying to come up with anything against me that you can possibly find.

I did receive your text and read your offer on here refund me partially if I would take down this thread and drop all claims. I would drop the Paypal claim but it is not possible to remove or even edit BOI posts. That is why I gave you every opportunity to fix this before posting here. Posting something permanent like this was a last resort and I even mentioned to you twice that I was going to need to come here if you continued to ignore me.

Personally, I think I have been quite reasonable throughout this whole process and I think most people agree. I really appreciate everyone that has taken the time to read through this lengthy thread and share their thoughts here.
 
All of you have to know that there are at least two sides to every story. I personally don't see the swollen limbs in the pictures above due to not having a straight on angle to compare against the other like limb. As for the sunken eyed gecko allegation, this might be true that she may have a sunken eye (which was not the way I sent her out) due to dehydration in shipping...but as stated in PayPal emails she was a FREE gecko. This gecko was not a part of the charges...but completely free for her, due to her being a buck skin.
I do agree that some of the OP's photos don't show issues as well as they could. A video could help show them off a little better. I am having trouble seeing a swollen limb as in the photos provided the arm is bunched up in on itself, which always makes crested arms look chunky, and one spot where wavy tail is mentioned but not pictured.

In my experience (I can only speak for my own dealings through rescuing animals), when a crested gecko has become dehydrated, both eyes sink in, not just one. Only one eye sinking in tends to mean there is either an injury or deformity. The sunken eyes in dehydration pop back out to normal once the gecko has been properly hydrated. If this injury occurred in shipping, it could have been due to the sub-par packaging.

Seller: if the buyer paid the shipping cost, I am surprised that you had to ask her who a shipping refund should go back to should it happen in the case of a late delivery. Keep in mind that your buyers have to generally set aside time in their day, maybe losing work time, to wait for things to show up. A refund of money that was meant to go directly to the shipping company and not to you is no loss to you, and it can help smooth over some ruffled feathers when a buyer is inconvenienced for the greater part of a day. If you use SYR, go to the FedEx site and run their zip through the time & cost calculator tab before you accept payment to see when they say a package will arrive by and let your buyer know. Some Priority Overnight shipments can take up until 4ish for more out-of-the-way areas.

OP: you were aware that 23 grams is well under what most people consider OK for crested breeding, so I'm a little confused why your texts to him after receiving the animals mention the weights again as a negative when that was the one thing he was up front about before shipping. NOT taking his side on this btw, I believe listing 23 gram crested geckos in a "RTB" group is a definite red flag, just am wondering why you didn't walk away then.

My complaint is not about their weights, I was aware of that before I purchased them and like I have stated, I wasn't planning to breed them until spring anyway so that was not a big deal to me. My complaint is that they are probably not breedable geckos (ever, not just not right now).

The fact that only 1 of the geckos in the RTB group was a red flag but I figured I was dealing with someone that just lacked crested gecko breeding knowledge and that they would be fine even they weren't actually RTB quite yet. I had no idea how bad of a situation I was getting into.

If you're referring to the last text when I complained about the 22.6 gram one, that is because she laid fertile eggs. That means that he bred her even though she was nowhere close to an acceptable size for breeding.

Ah, OK, I was a little confused because in your texts you did bring up the weights of all of the animals again as a negative point so I thought you were still unhappy with all of the weights at the time. That's something I would have brought up at the start when he mentioned it, "Those aren't RTB weights by most standards."

It was a little difficult for me to follow which gecko was what weight in all of these text & forum messages, and which ones were laying fertile eggs/purposely bred.

Unfortunately "just lacked crested gecko breeding knowledge" is often followed by things like 22 gram geckos laying fertile eggs. :( Lesson learned for the future, watch for low weights on "RTB" animals, and wait for new photos if something seems sketchy (even if the seller pulls out the "lots of people interested" line when you ask for more pics - at that point, I just let the lots of other people buy instead). Definitely someone I wouldn't recommend buying from :/

If you don't want hits to your reputation, maybe next time try resolving a complaint immediately before being forced to by a BOI Bad guy thread.:thumbsup:
 
Samantha, given the behaviors of David during this transaction, I'd like to hear from you, yourself, that there is a resolution, that he did you right, and that you actually received any promised funds.

I ask again, not trying to muddy up the waters but would be a huge concern to me if I was purchasing from him, why does DAVID have 2 accounts on here? Each listed with different address. Not saying he is but could be viewed as a way to get extra money for a so called shipping charge or what not. There are lots of bad things that may or may not happen using these 2 accounts. I could kind of see if one was an older one but he used both in this thread so he knows that he has them. Just some extra thoughts.
 
You'll noticed he used the one from 2006 with Illinois address only once. I think he started a new account when he moved to California and used his old one by mistake. Because he hasn't been using the 2 accounts all along I really did think anything of it myself.
 
I guess so. It seems that it would be easier to change your state and city in your profile than to go and make a whole new account just because you moved. Like I said was just something that concerns me.
 
glad this has been resolved. I can say Ive noticed my Saras and cresteds have "sunken eyes" when sleeping or just waking up. Hard to say with one picture. Also a video showing the tails would have helped. Its hard to come to a conclusion with just a still shot picture. This all could have been handled better I believe, but again. Glad it has been resolved. Ive seen alot of posts from David and have almost made purchases from him. I hope things can be learned from this experience and he is not completely scared away.
 
I know I was saying that I wouldn't post again, but I need to give some responses here. I literally did not know about my other account here (or rather didn't remember it) until it was brought up recently in this BOI. To be honest, I was sort of surprised about it too. In any case, my BII thread is here and on my other accidental account so I have nothing to gain from having 2. Also, the BOI is the only post on there (right?), so I really don't have much to gain since I so not even use it. Just saying. When it comes to this transaction, I truely am sorry, and believe that maybe there were problems I may have been unaware of. I keep and breed much less tolerant animals than Cresteds, and honestly stand behind my animals, BUT this was definately a hiccup and I have never had this happen before. Also, it was hard to stay in contact, as my family from accross the country had been visiting and I was out a lot. This is not an excuse for rare contact, but rather an explaination. There has been a refund administered and agreement made. Samantha and I are good with the situation and just moving on w/ our lives. Furthermore, I feel great for doing what was right in the end AMD I ask for forgiveness from everyone. I will not allow this sort of thing to happen again. Thanks for reading.

I truly have learned to be more aware and also the logistics of shipping. I truely hope that I can build trust and confidence in you and others again, and that people realize this was all just a mistake I made (big 1). As for being scared away, I sort of am, but this will not detour me from continuing to breed/keep spectacular animals.
PS- I am not a pet shop and I am normally a great breeder but I DO like to label my tanks. Give me a shot to prove my animals are AWESOME please. Over and out.
