But since you responded first to my post, Was there any documentation once you received the snakes that the order did not meet your expectations.. I realize there was a DOA involved and apparently you were dissatisfied with the colors , but aside from verbal or written complaints, did you provide any or take any photos to show proof of death or what the snakes should have looked like had you received them all in good condition...

I am unsure as to who assumes the responsibility when a drop ship is involved in a transaction.. I can surmise that whom ever you sent the money to is the one who provides the TOS . Did Justyn contact you in writing on this matter?

Below are the emails that answer your specific questions. Mainly that Dan did receive notification and documentation of the condition of the animals. and that I was unaware Dan was brokering snakes through his ad and so had no communication with Justyn as a result.

As can clearly be corroborated by the appearance of the dead animals, Snakes as with any other animal begin to loose color almost immediately after death. Hence the pale color people associate with corpses and the snake in the pictures

The pictures you are asking for are already attached on post #61 (page7) along with the rest of the emails that transpired during those four months
As you can see Dan answered to the ad he posted on KS saying he had animals available he collected the funds. Never did he tell me he was using a third party and he was merely brokering these animals which by the way is against KS’s TOS until after there were problems with the animals. As a result I never had anything to do with Justyn until after I returned from Alaska and Dan gave me his personal info. All of this is supported by the emails posted on post #61.

If you have any further questions I will be glad to answer them although as I've said all the info has already been previously provided.

Hey so I talked with my friend and we both agree that it would be best for the animals to just ship next Monday. In my experience the shipoping services have always been notoriously unreliable plus having the snakes sit around all day in a delivery services with the Texas heat and a bunch of hicks around makes me very nervous. so no worries just ship them next Monday. Jon, These marine file snakes are the first ever imported so there is no care sheets available on them. I keep them in a salt water tank and use a heater to warm the cage to 83 degrees and they need a tube light of course to replicate the sun and keep it busy with sailfin mollies which can tolerate the salt water. I do expect another group in two weeks and would be glad to let you know when they arrive. Thanks. When you make it back, we can speak on the phone to share our experiences keeping them to better learn how to keep them.

Jerry: My ad expired and Mr. Liair Garcia telephoned after I ran out and I helped him get snakes from someone else and did not know Justyn was banned and just paid the refund to end the situation and get my account established.

I did not read through all the threads, do you have any policy in your TOS on drop shipments to avoid these problems...

This was not a drop ship. Mr. Liar Garcia is trying to defraud you into beliving it was. Had the buyer contacted me for snakes I said was available and were at a different location, then that is a drop ship. I told him that I was out, the importer was out, and none would make it for months. He pried and asked me to ask Justyn if Justyn would consider selling his pets and I did.

Apparently an extended period of time went by before this whole fiasco blew up. Were there any time limitations in resolving this .. JERRY

Yes, he received the snakes and said they were unsat and I told him 2 dozen times to return them and called his roommates number and they both dodged returning the snakes. I always said I would try to get him replacements or a refund.

Five months later he files a non-delivery report to force my account to be suspended and extort a refund. BOGUS.

He kept the snakes and the money. And never showed any photo of any dead snake. BOGUS.

What he is doing here is trying to paint a picture that he bought animals I advertised. He is scamming the readers. He did not. He is a master conman . I pulled the ad after his initial inquiry as I sold out of them fast. He called to check on any sources who might have some and I told him I was out. He got them from Justyn and I helped with the money because it was just easy that way so he obviously would not know my source. Had I had some like the picture he paints, don't you think I would of shipped them to him? You know Justyn, and Justyn's kid. Justyn would not lie about his email. It is the truth. I have his email and the buyer said I made it up and can forward it to you if you want to post it to verify it is real and not changed.

And Jerry, he was never at a loss. He stole 4 snakes and stole the money with a bogus non-delivery report.

I did get my money back but attributing this solely to luck I think would be too discouraging to other people who are in similar situations and thus preventing them from going through the appropriate motions. I will agree that there is an element of luck in situations like this but I took the time to go through all the motions In order to ensure my chances of having this resolved were as good as they possibly could be. Being complacent in situations like this merely ensures nothing will be resolved and that it will happen to other people.

You have a good point when saying I should move on Jerry and to tell you the truth I for the most part had gotten over it. I didn’t even bother filing suit for cost and time incurred through this ordeal because I didn’t want to continue fighting. But all these months something had been bothering me about this whole situation which is why I decided to post this thread in order to inform others as to problems I had when dealing with this vendor which I see nothing wrong with since I have a legitimate and well documented claim.

With most phone companies, the record is shown on your monthly bill. If not, you can request the phone record from the company, which is most often free or just the payment of postage to send it if not by e-mail. It does not require an "investigation" to acquire a phone record. Furthermore, at this point, I wouldn't trust my money with you under any circumstance.

Perhaps it is true that you did not advertise to broker, you have already admitted in this thread that you brokered the snakes. According to you, you transacted the funds through YOUR account, while the snakes sold were from Justyn. This sir, is in fact considered brokering.

He will be sued in court for the refund, attempts at defamation, and filing other negative reports with my wild life department.

IF this were to be taken to court, most of the things you have said in this thread could be EASILY considered defamation and/or libel. As for the refunds, the fact that you submitted to him an amount that was beyond what he paid for the snakes and shipping in the first place would make you look bad, especially if the post you posted stating that you did not remember what he paid, or that you do not keep copies of your sales receipts was brought up.

Just so everyone is satisfied, why not post the email with full and complete headers? That way it cannot be claimed that it was edited by anyone. I am not special enough to be the sole person to read it, everyone should be able to see it.

Cody I can forward whatever tangible evidence you want to your email address although keep in mind there's four months of emails so it will effectively swamp your inbox if you want to see everything. perhaps it would be best if I sent you emails specifically dealing with whatever questions you have. For example the fact Dan keeps saying I contacted him many weeks after his ad expired when he was out of animals which has already been shown to be a lie since payment was sent to him via paypal the same day he answered his KS ad saying he had a dozen animals available. Although this is something that has already been addressed and exposed in this thread before but Dan continues to argue otherwise without providing any tangible evidence.

When I click to highlight the email, it only allows me to highlight the top portion of the subject and to and from and then I have to highlight the rest of the stuff and cut and paste it. I tried it again but it stops copying at the header section and I have to go back and then copy the bottom section?

Sorry for the confusion

in all the questions. Its just that if I were the seller and did not have the animals, then the money should never have been sent nor even negotiated. Once the buyer realized that the seller could not come through with the sale, it became a blind bargain ! The monies if they were in Dans possession was sent in good faith and should have been returned immediately . there was no possibility of any sale without the snakes being in Dans possession..

Whatever agreement Juan could make with Justyn should not have involved Dan at all. Whether Justyn had these as personal pets, is a decision that Justyn decided to part with.. He accepted the sale and it should have been between both of those parties.. That would include any terms between Justyn and Juan...Not Justyn , Dan and Juan.
Its basically a situation where Dan received monies for something that he did not have and Juan received something that Justyn probably in hindsight should not have shipped. A real mess.

Insofar as your analogy Dan, with my the products that I sell.. I dont offer anything that is not in my physical possession.. Especially taking other peoples monies.. As you can see the ramifications can lead to a variety of problems that you already experienced and and are not looking for a repeat performance with Kingsnake.. You are always better off in either referring a request to someone else as an act of kindness or if you know that you have more of the item coming in, then you will advise them once you have them... that would seem to me to be the easiest course of action to take then to get into the mess that you currently have with over 7,000 reading this which cannot benefit you at all...

So Dan. Is it your assertion that every single penny that Mr. Gracia sent you for the four file snakes ($1,050 I believe)was sent to Mr. Miller and you did not financially benefit at all from this transaction?

If that is the case, why did you not direct Mr. Gracia to send the funds directly to Justyn?

This question has been asked in various forms a dozen times in this thread and you have still not answered it.

A much more likely scenario to myself and, I suspect, everyone else reading is that you persuaded Miller to sell you his four at an agreed upon wholesale price and sold them retail to Mr. Gracia. I might add that nothing in the truncated Email you posted from Justyn disagrees with the above stated scenario
