    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

I'm starting a new thread, because the original one wasn't picked up by the BOI search button in his ad. Here is the link to the original thread, posted by Deborah Stewart: http://www.faunaclassifieds.com/for...ight=flherps307+Sebastian+Montero#post1480494


Mr Montero continued to post that ad, until Jonathan Foltz (BreedersCircle) questioned why he (Mr Montero) was using his (BreedersCircle's) image. A short time later, Mr Montero deleted THAT version of the ad - leaving the explanation that he'd made a mistake. Since it had already been posted that he was using other people's images, and he had already been banned from another site for that practice, I'm not sure what he considers his mistake to have been....but he still has the image on his site, so that apparently he doesn't think that was it.

I'll be notifying both BreedersCircle and FLherps307 about this thread as soon as I post, but here are a few screen shots I took this morning.
First - the ad, as posted; showing the question about the image (I blacked out the prices, so as not to advertise for him any more than necessary)
Second - the deleted ad.
Third - the pastel lesser on FLherps307's site (http://www.flherps.com/ball-pythons.html)
Fourth - the same image on BreedersCircle's site (http://www.breedingcircle.com/available/reptiles/ball python/)

Thanks for posting this Harald. I checked out Sebastian's website the other day and was pretty suspicious of his photos, could not put my finger on anything though.
 
Well, the guy is obviously avoiding this thread, and opting to try to minimize his exposure by using PMs. I'm not big on posting "for" somebody, but I don't view this as posting on his behalf, either. Here are some of the statements he's made:

My response: I hope you aren't trying to convince me of that, because I am neither naive nor stupid. Using another person's images in your advertising does not fall under "Fair Use"...it is a violation of copyright law. You have already been advised of that, so I don't understand your position. If I were Jonathon,or any of the others whose images you are using, I would have already contacted you regarding the removal of my images from your site...AND contacted your host.

He got called out on his latest BP ad, for using one of Strictly Reptiles' images.
His response (sent to me by the recipient, Brian Fontaine)
Yes they do know we are very close to them and we have asked them if we can use it. We will have all the pictures by thursday because we are going over to strictly reptiles to take pictures of them.

I responded to his message to me, and referenced this info
I already told you that I am neither naive nor stupid. If you HAD the animals, you would be able to use your own images....you would WANT to use your own images.
Just for the record, I've contacted Strictly Reptiles to see if you do, in fact, have permission to use their images.
At which point he admitted
I have a wholesaler that provides me with the animals and on thursday I am going over to take pictures of all the animals that I have on my website. Strictly Reptiles they are about 20 min. away from us.

My final statement: Like I said, you don't have the animals in your possession....
This isn't rocket science, you're just really bad at it.

There you have it, and buyers beware - I obviously can't comment on the quality of the animals he sells, but he's just taking orders, picking up the animals from another dealer, and shipping (if business picks up, he'll probably have Strictly ship for him...if he isn't doing that already). I have nothing against resellers, but I'm not a big fan of people advertising animals that aren't even in their possession.
 
They have an ad up in the corn snake section and my first assumption was it was Florida Herps with a different username. If I remember correctly, they too stole others' photos and claimed them as their own, but they also didn't claim to be 12 years old. :shrug01:
 
I think a lot of people initially thought this was a new account for florida herps - and, yes, they used other people's pictures, as well - but I haven't seen anything to indicate that to be the case.
If florida herps gets wind of this kid, though, they might have some kind of case against him based on the name similarity.

He is not lying about being 12 I am afraid, I have screenshots of his Facebook that I matched to his youtube video.

Wonder if mommy knows what her son does why on summer break :shrug01:

I have told him about Copyright laws in a previous email so he KNOWS, I also mentioned fraud, and federal crime seems it had little to no effect on him, I guess since his info (Phone and address are out there) it will be very easy for anyone to contact the local authorities.
 
Yes, he has ads for numerous snakes that he doesn't have...but, if he is, in fact, only 12 yrs old, that is probably the most important thing to come out of this thread. I don't think any of us would willingly enter a transaction with him for that reason alone.

Guys, I think this is going out of hand here, I openly share and explained you that the pictures were posted because my inexperience in this type of business. I used picture that were posted in Google image without knowing the copyrights regulations. My only purpose with my website is do something that I like, dealing with reptiles, because they are my passion and I love to share this with others with honesty and principles.

This is a new business and all my clients so far are well satisfied with our service. We have taken some necessary changes to avoid this type of problems in the future.

But just to end this long speculation about our website, we are here to enjoy and share our passion with others about reptiles with high level of ethics and principles. Sorry for any misunderstanding; I hope you can understand.

False! You posted the ads here on July 28 yet you have been made aware of copyright laws after being busted on BP.net and made aware of copyrights laws on July 10th.

Who are your clients do you care to have them come forward to share their experience?

If you own those animals how about proving it all you have to do is post pictures of the Highway, Pastel Lesser, and other animals you own and that are currently in stock. Why don't you? Cell phone pics will do.

The fact of the matter is that you still do not grasp that you could be in a lot of trouble here kiddo.

Copyright infringement and fraud we are talking about thousands of dollars in fine and possible jail time if you defraud someone.
 
Maybe we should call his mother. This kid is setting himself up for a world of hurt. What 12 year old has these Lind of snakes? What 12 year old has the money to buy these snakes to flip? Sounds like a grab and go to me.
 
That was a website that we were trying to change some of the design at the beginning, but it didn`t workout for what we were trying to do. Thank you for reminding us to unpublish it. It is already done. Please don`t be so repetitive in what you are saying I already explained our reasons. I do not have the time for this foolishness, I have other positive things in what I can spend my time and energy. Good luck, I hope everything works out for you all.

Avoiding question is not the way to go about this, why don't you post some pictures of the animals you have in stock? Not tomorrow not in two weeks, Sometimes today?

I can tell you I can post pictures of any animal I own within a few hours if asked.

You lied by saying you were not area of copyright laws this is plain simple you can call it foolishness I call it fact.
 
then how did you end up with jon at breeder circles pic of the butter pastel on your site?not to mention the pied pic from strictly reptiles in fl?
