Well, it seems no matter what I do to get this resolved it just won't be good enough, so after talking with local law enforcement as well as Texas Law Enforcement, and several friends.

It seems best to just pay off this idiot and be done with. And then move forward and deal with all the threats separately.

Originally I was going to give him $150.00 in trade value for the snake and he was to add $50.00 cash. (Total trade value of $200.00)

Since the snake he sent was NOT the snake he represented in the photo he provided, and is clearly of lesser quality, I will be lucky if I can get $100.00 bucks for it.

I am open to any suggestions, if there are any.

This is the last email I sent him to get this resolved.

Since we both cant trust each other the only way to resolve this is as
follows....

Since the snake you sent me was not the snake in the photo , I will give
$100.00 for the snake and the $50.00 you sent in cash.
If I try to re sell that snake there's no way I can get more than that.

If you agree to this , the matter can be resolved before the end of the
week.

I really don't have a problem w/ sending him back this snake, but I think no matter what condition this snake is in when it arrives, he will just claim it was dead when he got it. And if that happens I will end up having to pay for it anyway. Then I would be out the money and the snake, and then not be able to at least recoup some of that money back.
So unless I can get a neutral third party that could make this happen, I have no better solution.

And HOPEFULLY .......I'll see him in Daytona.... but after talking with law down in Texas ...... this guy barely leaves the house, because there’s so many people looking for him.

In my opinion the past couple of posters are correct. The best/safest way to end this mess is for you both to agree on a cash price for this animal.

Then I would Paypal or overnight a US Postal Money Order and be done with this issue ASAP!

Well it seems to me that paying him will only encourage him. Since you're both going to be in Daytona then why not just give him the snake there? There will be plenty of people to verify the condition of the animal and to witness the return. Why should you be out any money when he sent you the wrong snake? You know he's not going to agree to the reduced amount anyway.

I didn't send him the money, I decided to send him back his snake instead. I packed in front of the FedEx driver to prove it was put in the box alive. If he wants to pull any after it arrives ...he can take me to court.

I suspect the same would be true in this case. He would have to take you to court where you are and not where HE is. I mean, it is all bogus, but I just wanted to let you know this.....

I would have sent the animal back via the Val Verde Sherriff's Office since that is where HE claimed they were going to press charges against you. Make him pick it up at the Sherriff's office.

It sucks for the animal, but I would have personally had alabel ready and returned the package unopened right then and there. I'd have lost the $50 to just be done with the deal. Cheap lesson.

Be careful, though, bud. Stupid, I know - but that is our court system. AMAZINGLY stupid, but it can actually make you the part to be found in the wrong. I was just trying to find my cheapest way out of this, sending the snake back was it, if he doesn't turn around and say it arrived dead. Thats why I packed it up in front of the FedEx driver. And I still fully expect him to say it is dead upon arrival. But ... I really don't care at this point , and I'll just deal with the system if it comes to that.

I have more than enough emails from him to prove his intentions.

Obviously unrelated, but it was the only reason I know Texas laws on the matter, so I felt it was appropriate to put my reasons in context since it was non-snake related.....otherwise people would have asked what snake deal did I try to bring to court.....lol.
