Help for anyone ripped off in the herp business

Im a bit lost here, so maybe someone could help me out.

I assume you are speaking of Kane Herpetological in MA.

He contacted me a few weeks back with some great prices on animals. I didnt have the cash at the time, and told him I would contact him when I did. I have tried to contact him since, but he wasnt available most of the time.

He then told me his store was robbed by an ex employee of computers, ect. He told me no animals were taken, so we could still work a deal on them.

He sounded sincire, and put alot of names out of people he "supplied". The prices seemed great, almost too good to be true. I asked a few friends about Pat and was given a good word on him, none bad. Now I see he in claimed to be a con? People are claiming he ripped of Rich here at Serpenco? He ripped off Regal?

Can someon please confirm some of theese details, as I was in negotiations with Pat for a substantial amount of money. Rich any input?

Im also going to email and call pat and see if he is aware of this thread, and if he would like to respond. I would be interested myself to here his side.

Please contact the following officials and file a complaint. They think I am a single individual that had a misfortunate deal. Rhode Island and Mass. FBI:617-742-5533, State Division of Agriculture: 401-222-2781 (Pat told me he opened a store front to sell to the public, and this state division office has warned him about not being licensed to do it), East Providence Police dept.: 401-435-7600 and several people gave me this number to contact his parents because I had just found out he's a minor: 508-336-0667. If you call the Federal Trade Commission at 1-800-876-7060 and file a complaint it would be helpful to everyone as they cannot investigate until a pattern of alleged criminal behavior can be seen.

Please follow through so that no one else gets burned by Pat Kane!!!!!!!!!

I will help with whatever I can, please keep me posted.

Not to defend Pat Kane's actions BUT if you sent out your animals without securing payment FIRST then I feel you are partly responsible for what happened.

Why would you send the items before you got the money? What was your history with Pat that you trusted him that much?

Never make a large purchase from someone who is not legally responsible for his/her actions! I saw some nice boas being sold by a 14 year old at the Manassass, VA show this past weekend. As soon as I realized who was selling them, I kept on walking.

I would like to clear things up. I am not a business but a private seller. I bought some of my animals from Pat about a year ago. I HAD NO IDEA he was a youg kid, he sounded much, much older. He said he had been ripped off for thousands of dollars by, Midwest Exotics, California Reptile ?, Invertepets and ramble a bunch of other names. He said he cannot pay until he receives and verifies what I sent. This is a copy of the e-mail he sent me;

When they come to me with your packages before I can even open tehm they require the $2000 check written out to you.
Within in 10 business days (usually less) you recieve your payment.
The reason it takes so long is when I hand UPS a check, they deposit it into their account, and it takes 3-days for the check to clear their account then they mail you an offical UPS check cashable anywhere...it still takes 10 business days to receieve.

OR,

You mail the shipment not COD and I mail you a Cashiers check immediately upon receipt....I am a verified distributor...I have a store front, two full time employees, many part time employees, have been in this business for over 5 years...sell to the top distributors in the country, etc etc...can supply you with many many refrences.

Please let me know how you'd like to conduct this transaction as I would like to close this deal out by the end of the week.

I am in no way defending Pat kanes behavoir but the reality is Pat Kanes age is irrelevant. If Pat is under 18 or over 18 it is still like getting blood from a stone when someone rips you off. He promised to pay but just doesn't have the money so now it is a civil matter not a criminal matter.

He didn't give you a bad check or a stolen credit card etc. so there is no crime. He said he would pay you, you sent the animals, suddenly he has hardship and can't pay so you will just have to wait. (An honest person might have offered to send them back but ........)

It IS a lot like a cell phone bill. If you don't pay they cut your service off and nag you about paying your bill. They don't send the police after you! There is no debtors prison anymore.

You could pursue this matter through small claims court etc. but even if you win, if he has no money they will let him make payments until it is paid off, they can't seize assets or put him in jail. I've been through this it took me over a year to collect $300. I

Unfortunately you got taken in by his name dropping and smooth talk. You made a mistake by sending the animals without getting any payment. Now you have to deal with this pain in the #ss. Good luck.

Why did it matter that the person selling the boas was 14 and how did you know his age?

Did they come with some type of a guarantee that you would have to hold the seller legally responsible for after the sale?
