Jack, you are hearing total LIES. We treat all our reptiles
(and other pets) very well. Marc Duhan is a liar and his
only mission is to make me look as bad as he possibly can.
Why he is doing this is beyond me. He even said our snakes
were "covered in mites" and that he had to stop and shower
and "Threw his clothes away". I haven't had a single mite
since 1989. It's all lies. If you don't believe me check
with Joe Lewis, the President of the Louisiana Herp
Society. And any nasty messes that were made here were made
by the police. Then they took pictures of the messes THEY
made and said we did it. We had one HELL of a clean up upon
finally getting out of jail.

They came in here like a commando SWAT team, about 20 deep
and all with weapons aimed at my wife and me. They
handcuffed us both and beat me up pretty bad even though I
never resisted. I only demanded to see a warrant, which I
am entitled to do so by law. They never showed me one. I
didn't get to see it until after I bailed out a week later.
I was never given my phone call either, which I am entitled
to. They also kept upping my bail so as to make it more and
more difficult for me to post bail and get out. Their whole
objective was to keep me in there as long as they could so
they coud sift through my life and try to find something
illegal to charge me with to justify coming at us the way
they did.

When I got out and read the warrant it was solely for them
to search for and locate a single dog. A week before all
this someone gave my wife a dog for free. Then a few days
later they filed a report that WE (her and I) had stolen it
from them. It was all a big set up. I never had anything to
do with the dog, but even so, it was given to my wife for
free. Nobody stole anyone's dog. They did this to set us up
for their huge invasion to look for drugs.

When they came in here and took us down they had multiple
agencies involved. The D.E.A., Homeland Security, The
Narcotics Squad and the Sheriff's Department. They
obviously thought they were going to find a huge drug bust.
Needless to say they found nothing illegal AT ALL. So they
had to trump up bogus charges so as to justify taking us
dow the way they did.

They found the allegedly "stolen dog" within 2 minutes.
They were authorized by the warrant ONLY to search for this
dog, seize this dog and leave with the dog. Instead they
arrested both my wife on totally false "Resisting Arrest"
and "Obstructing Justice" charges and remained on my
property for three days sifting through all our stuff
trying in vain to find something illegal. They ran all my
tools, my generator, the air compressor, both the V.I.N.'s
on the trucks, desperately trying to find something stolen.
When they found nothing they hit us with manufactured
"Animal Abuse" charges. They actually allowed for time to
pass and poops to accumulate in our outdoor kennals and
they photographed our indoor dogs in the now dirty outdoor
kennals. It's all totally manufactured and it's all total
lies. Which will easily be proven in court.

They confiscated all our computers and files and cameras
and other electronic equipment. They were not authorized by
a court to do this. They were only authorized to search for
and seize a single dog. Which they found in 2 minutes.
Everything else they did was TOTALLY illegal and entirely
unconstitutional.

They then told a bunch of lies to the Media which then
immediately reported the lies and were were therefore tried
and found guilty in the press.

They will all be held accountable for what they have done
to us.

P.S. Please also tell everyone that the police tried in
VAIN to find ANY evidence that we were feeding dogs and
cats to our snakes and they found NOTHING. Because we would
NEVER DO THAT. It's all lies. What happened to this
country? It used to be "Innocent until proven guilty in a

heresay, conjecture, lies and bad rumors.

WOW.... This guy has some nerve!! I would love to see a copy of so called warrant to just search for a single DOG!! I can't believe that this guy would try to weasle his way back into the community after what was shown on that video and all the pictures that were taken... there is NO WAY that they made that mess in a day or even three if that is what he's claiming.... The way that yard and the building is... it's apparent to me that it would take months for it to get that bad!!

If this isn't so then say... someone had a warrant to search my house for a stolen gun (specified caliber) when they get there.. they search and find several stolen guns of different calibers... are they not clearly in their rights to seize these other stolen guns or can I sue them for taking what they weren't "Authorized" to search for even though they are illegal?

What I find odd during this whole charade is that after repeated attempts, by several people asking "David" whether or not he and Damon Heynen (among other names) were in fact the same person he refused to answer that (as well as several other direct questions), and now that it has been proven, still chooses to deny and/or ignore that one simple fact.I don't understand the concept behind that at this point. The cat is obviously out of the bag, why not just come clean and move forward? It's obvious that even being wanted under the other names shouldn't be a hindrance, seeing as how even the states where he's "wanted", in fact....don't want him at all.

OK... so they were able to have access to search for said dog... They get there... looking for the dog they notice several snakes that are over the size limit there in the State and seize them... Not illegal at all... They are clearly in their rights to take property that is illegal in the State!!

If this isn't so then say... someone had a warrant to search my house for a stolen gun (specified caliber) when they get there.. they search and find several stolen guns of different calibers... are they not clearly in their rights to seize these other stolen guns or can I sue them for taking what they weren't "Authorized" to search for even though they are illegal?

In your scenario, the search would be illegal, as the identification of stolen firearms would require that they run the serial numbers, which qualifies as a separate search in and of itself. Reasonable suspicion or merely just curiosity wouldn't serve as a valid reason to check the serial numbers without consent.

For purposes of the subject matter of this thread, the evidence of a second crime seized during execution of the warrant falls under the plain sight exception. It's much the same as if a kilo of cocaine were sitting out on the dining room table while officers were there. Whereas it is not mentioned specifically in the warrant, seizure of such evidence is perfectly legal so long as the officer has a lawful right to be there and has probable cause to believe that the item seized is associated with criminal activity.
