OK, here we go.  Has anyone dealt with this individual?  He sent me an "adult" female Red Blood Python from Washington to Colorado.  No heat pack even after he asked me if it needed a heat or cold pack.  No insulation in the box.  The temperatures were in the 40s at that time.  

The snake is dehydrated.  She is very thin, and has tons of stuck shed on her.  She has dirt packed into her belly scales and vent.  She has scale rot on her stomach.  

She is no longer covered in mites at least...  I did not notice the mites until I had warmed her up sufficiently.  She had SO MANY mites it would have been IMPOSSIBLE to miss it.  I spent 4 days getting her rid of mites, and now I am working on the rest of my house, since I am SURE they have spread.  Like I said...  Didn't see the mites until she warmed up.

Now - Ryan Smith or whatever his name actually is got pretty defensive when I emailed him with the problems.  He claimed I was threatening him, and he was going to do nothing for me.  Eventually he admitted that he never looked at her belly for scale rot, knew she was covered in mites, and agreed to refund me the purchase price minus shipping.  

Where is he now??  He has not responded to my emails, and I have no refund.  He said 3 days, it has been a week.

So...  Has anyone else dealt with this guy?  If you haven't, now is NOT the time to start.  I would strongly discourage ANYONE from dealing with him.

Well, this has created quite a bit of email traffic from Ryan to me.  He has made a lot of claims, and now refuses to give me a refund.  

He has also threatened me with a lawsuit because of the information I have posted here about him.  For the record:

As we can all see, I obtained my information through legal means, and everything I have posted is PUBLIC INFORMATION available to anyone with internet access.

He has made claims that the photos I took of the snake he sent to me are not even pictures of that snake.  The odd part about this statement is that the photos were of the snake's belly (scale rot), and he has already admitted that she could have scale rot because he had not even looked at her stomach before packing her up.

He claims I am in the wrong here because I expected a perfect animal for $115 shipped.  Why would I have expected less??  He never claimed to be sending me a "less than perfect" or "B grade" animal.  

So now he does not want to refund me...  Yet he sent me a WHOLE LOT more mites than I paid for, that's for sure!

It seems RDL Herpetology does not want to tell their side of this story...  They KNOW it's here!  I guess we will just have to go on with my side...

So far I have turned them in to the National Fraud Information Center, Better Business Bureau, Scambusters,  Kingsnake.com admin...

I am now working on turning them in to Paypal, FBI Internet Fraud Complaint Center, State law enforcement, local animal control...

Any agencies I am missing?  I just want to make sure I cover all possible...

Mark I was being more than fair with you when I said I would refund your money, and I genuinly meant it.  I would rather have given your money back, AS I WOULD HAVE TO ANYBODY, who was acting respectful, and was displeased with an animal.  You sent me an e-mail on a Saturday, and on Sunday morning, you had slandered my name, not just stating facts, but being accusatory of ridiculous allegations.  Darren Venhuis is my business partner,not my AKA, and his name is on our business liscense, as well as my girlfriends. Why would having 2 e-mail addresses (sales@rdlherpetology is linked to my [email protected] account, through kingsnake.), make you suspiscious?  ESPESCIALLY WHEN YOU HAVE AT LEAST TWO?!?!?!

I sent you an email on Wednesday, October 16th, less than an hour after recieving this snake.  On Wednesday evening, you emailed me telling me you would refund me the price of the snake minus the shipping.  This is what we agreed upon.  On Saturday evening, I had not recieved a refund yet.  You told me you would have the money together in a few days.  You also told me you would stay in touch.  You did neither.  THIS is why I emailed you looking for action, and THIS is why I posted this story here.  

Ryan, I ask you again - Stand behind your sales, and make this right.  I have NO PROBLEM retracting EVERY statement I have made about you, but not as long as you do not follow through with your agreement to refund me.  At no time have I been unreasonable.  A little angry?  YES!  Who wouldn't be??  You've jeapordized a large part of my collection by sending me an animal with mites.  You've cost me valuable time nursing a sickly snake back to health.  I still battle with this snake, and I still have treatments due for the mites.  If you had sent me what you advertised, we would have not had any of these problems.

If you flat-out refuse to do the right thing and refund me for the price of this snake, the LEAST you could do is explain yourself here.  Tell everyone why you sent me a snake with stuck shed, scale rot, and mites.  Tell everyone why you did not put a heat pack in the box when you ASKED me if it needed one.  Tell everyone why you did not even insulate the box.  These are all questions I would love to see answered.

Lastly - Please let me know what "rediculous allegations" I have made.  I have not been lying, or even bending the truth a little.  I have told it exactly how it is.  I do not hold a grudge against you, and I am not "out to get you".  I want my money back, and I want for you to be honest in your sales.  If you cannot do this, I will continue to pursue other avenues.

Which all these people who've been speaking with lawyers would know IF they'd been telling the truth about discussing possible legal action against their accusor. Of course, in most instances, the statements made are justifiable based on facts (Except that strange little man who made about 8 names  and just kept saying Rob Trenor had somehow wronged him out of the blue) and wouldn't count as libel or slander (if spoken) anyway.

It is also of note that in true cases of libel, the potential consequenses are greater than those for cases of slander because of the lasting nature of the comments. Which is a bit backwards since slander can take place in a crowded room at the top of your lungs and libel in a private written communication that nobody else sees... But that's the way it is.

You might notice that the definition of Libel came from a  source other than the original poster.

Specifically, it came from me. I am in no  way attempting to "twist words" as I've got nothing whatsoever to do with this issue, it simply has been slowly irking me that very few people seem to be using the term slander properly.

You may be an "ebglish wiz" but in this instance, unless he was speaking the words to you, it is not slander. Since it was written, it is libel. The two terms are related but seperate and the nuance is important from a legal standpoint.

Above is the picture of the snake that Ryan sent to me.  It is also still posted on his web site.  I am only posting this to show people the bad pic and angle...  It is very difficult to decide exactly how long or how heavy this snake is.  You cannot see it's belly, so you would never know the condition of the scales.  

This has been since taken back to email, as per Ryan's request.

Still no refund...

I've tried to keep this off the BOI, really. I even told Ryan I would get rid of this whole thread if he would just do what he said he was going to do - Refund me the money. Well, I'm sure you can guess why I am here...

On Sunday, October 27th, an excerpt from an email from Ryan:

you will have your refund by the 1st, you can say whatever you want after that, but my conscience will be clean. DEAL?????

Well, guess what. No money showed up on the 1st.

SO... On Saturday, November 2nd, I recieve this:

I am going to send your refund, which will probably be there by the time you read this.

Guess what. I read it, and did not recieve any money.

About half an hour later, I sent a Paypal request to Ryan, to make it easier for him to send the money to me. But still no money.

So this is what I recieved about an hour after that:

Believe it or not, I'm having a problem with my bank account.... (misc text deleted) ...Just want to keep you posted, and I'm sure I can figure it out by tonight.

Two days passed, and yet still no money. On November 4th, I recieved the next email:

s'ok, my girlfriend got home this morning, so i'll just use her atm card after I deposit the money.

OK! This could only take another day or two, right? Right.... Here's the message from Thursday, November 7th:

Okay, I have a definite date and time for you. Monday the 11th by noon. Is that soon enough, or should I just send it MO?

Yes! That's wonderful. Send it by Monday at noon.

Well folks, here I am. No money. I emailed Ryan at 12:30 to let him know I was still waiting on him. I told him he had until 8:00 to get my money to him, or I would be back here again, telling our story.

I called Ryan this evening, and spoke with his girlfriend briefly. I asked for Ryan, and she told me he was home, and asked who was calling. It took a good 3-4 minutes for her to get him... But when a man's voice came on to the phone - He said he was NOT RYAN. Well... Where did Ryan go, and why did someone else take the phone for him?? I guess this guy's name was Don, and he doesn't have anything to do with RDL Herpetology. He's just a friend. He took my message, with my phone number, and guess what - NEVER CALLED ME BACK!!

Would anyone like to guess who Don is? Would anyone like to guess why RYAN would not answer the phone??

I was fully prepared to take this to a whole new level tonight, but for now, I am going to leave it at this. I'll be EXTRA nice, and give Ryan another day to get his act together. Maybe since it was Veteran's Day and all, he had a tough time. I dont know, maybe I am just way too nice. In any even, Ryan has one more day to make this right.

I totally forgot to mention! www.rdlherpetology.com has mysteriously disappeared... I'm sure glad I copied all the contact information off the website before it was pulled, otherwise I would not have all these wonderful phone numbers and addresses to contact Ryan at. He was even nice enough to list his home phone on his Paypal account... Cool!
 
Big surprise

Heard back from Ryan again. I guess I was talking to his business parter Darren. That's funny... The individual on the phone told me he had nothing to do with RDL Herpetology. Now what kind of business parter is that??

And... To everyone's surprise, Ryan once again is NOT giving me a refund. He feels I have been too hard on him. *sniff*

I would like for anyone reading this to please let me know if I am being unreasonable, too harsh, or out of line.

What would YOU do if a "business" sent you an emaciated, dehydrated, mite infested snake with scale rot (in a box with no insulation or heat pack when the weather was dropping into the low 40's)??

But then, I didn't think you were gonna get your money back four or five posts back....whenever it was he said he wouldn't give you your money until you were nice. Well, you tried being nice then, and I gotta hand it to you, maybe thats why my credit cards are maxed out, for $75 bucks I wouldn't have been able to do it, his whole attitude that you have to be nice to him to get YOUR money back......I'd have blown my top.

I suggest you go back to flaming, harrassing, "Slandering" or "Libel"ing him, at least that got a rise out of him, maybe you can get $75 worth of amusement out of pissing him off now.

Just my opinion, before you take it, remember.....my mother always accused me of "Cutting off my nose to spite my face"....funny, I see a nose in the mirror every morning....but I have burned a lot of bridges in the past. I don't think your gonna get your money, but being "Nice" a little longer may work, but I wouldn't be able to do it!!!
 
If the snake really arrived in the condition you described I don't see why you should be responsible for shipping costs. If Ryan had a shred of decency, he would give you a full refund including shipping and pay for shipping the snake back to him.
He should follow that up with an apology for sending you a snake in poor health and subjecting the rest of your collection to mite infestation. (Hopefully, you had the snake quarantined).
Ryan, If Mark agreed to a refund of the cost of the snake only and not shipping...you got off easy!
Guess what? Mark has a right to be angry. You should refund his money because it's the right thing to do, not because he was nice to you. Did you expect to receive compliments for the snake you sent him?

The twist...

I flat out told Ryan the day I recieved the snake that there was no way I would send the snake back to him... I just couldn't put an animal back into those kind of conditions. I felt me sending it back to him would certainly lead to the death of this animal. I just couldn't do it.

Maybe that's where I went wrong... Then again, maybe I just have too many morals. I WILL NOT contribute to the abuse, torture, and eventual death of any animal.

That's cool...I respect that you're looking out for the animal's welfare. Unfortunately, I know where you're coming from because I've had two very sick reptiles shipped to me in the past few months.

6 months ago, I would trust anyone until they gave me a reason not to. Some of the reptiles I'm interested in are rarely available from well known breeders so I made the mistake of buying from unknowns. From now on I will only buy from well known reputable sources. It's unfortunate, because I'm sure there are honest small time private breeders out there but there are just too many dirt bags in this hobby to take the risk.

If you're looking for another blood python,spend the extra cash and get it from Pro Exotics or another reputable breeder. It's well worth the extra money in the long run.
