The e-mails say it all, but in a nutshell, I agreed to buy a group of geckos (0.0.2 US CB G.orrientalis, and 2.3 WC P.masobe) from Jason Perillo of JP imports and paid for them between 12/17/06 and 01/17/07. Partial payments were made during this time for a total payment of $3200. The animals were supposedly shipped on 01/21/07; however, on 01/22/07 I received a call from Jason whereupon he claimed to have shipped the geckos to the wrong address and upon arrival to that address, the orrientalis had not survived ($2000 worth of geckos). According to the guy who received them the masobe were still alive but came in “frozen” and 2 looked really bad. NO HEAT packs were used by the way and we are talking about NY weather in January. I requested a refund but Jason explained that he had spent the money I sent him prior to shipping the animals and therefore he can’t repay me for the animals I bought and did not receive. Jason also stated that he would not repay me for the masobes if they died while being cared for by the guy in NY (Jason thought it was best if the guy in NY held on to the masobe for 2 weeks). Jason had agreed to a live arrival guarantee both in e-mail and over the phone and is now going to go back on his word. I told him I wanted a full refund for all the animals and that the masobe can be shipped back to him assuming the survived. Jason agreed at one point to pay me back for all the animals within two months (which I find to be unacceptable). A refund for the masobes ($1200) was sent to me on 01/30/07 and Jason is now saying that he will not refund me for the orrientalis. I was offered animals I am not interested in and explained that I only want my money back. Once again at no point in time did I receive any of the animals I paid for (alive or dead).
Below you will find the e-mails we have exchanged over the past few days. A few phone calls were made in between, but everything said in those phone calls can be found in the e-mails. I tried to bold some of the more important information. Jason is not very well known at this point because he is just starting out his reptile (mostly geckos and forgs) and Cage Building business, however, I still feel it is important to get the word out about this deal, and how it was handled.

As we discussed on the phone, I also told him that you are taking responsibility for them and that you think this is the best course of action to take. I stated that if any of the masobe die during this time, you will not hold them accountable for the loss.
I am sure you haven't gotten back to me because you are busy, but about those other 4 orrientalis you brought back from Germany.

I spoke with Brian last night and asked him not to ship them as well. He was ok with my decision when i spoke with him.
As with the nature of Masobe, they are difficult animals. I did not guarantee them before to you, and will not now. This is because the nature of the species and I am not going to be pushed into a corner because you do not want to accept that masobe are prone to dying. And first off, they are alive. Forcing me to make a decision before showing a loss is rude.
As for the orrientalis, I will replace the animals as stated in phone conversations and by email. I will not refund your payment for them as I am out the animals and have extended replacements, which is a fair offer. Demanding me to replace the lost offspring with german bloodline is not appropriate and you are not in the position to give me such disrespect. I have offered freely to extend replacement animals as per the situation without your prompting, taking my offer and responding as you have only insults me. I am not going out of my way to belittle you as a customer and have not run off with your money. It is industry standard to not gaurantee live arrival, I offered that on the orrientalis but not on the Masobe. You did not question this before and have no position to do so now. Also, it is not appropriate for you to corner me into a position to accomodate you considering I am not doing anything to screw you over. I have not given you any reason that I am doing anything against you, I have offered replacement animals on those that I can replace. My way of handling this is quite fair considering how much in animals I am replacing without hesitation and without your prompting.

Jason do not try and tell what the industry standards are. Live arrival is a standard and the fact that you extended a live arrival guarantee on the shipment is all that counts anyways. So we can sit here and argue all day what the standards are, but in the end it is moot.
Since it is apparent I need to point out how cooperative I have been lets begin by pointing out the mistakes you have made.
1) You shipped on the wrong day.
2) You shipped my package to someone else.
3) You didn’t place heat packs in the box. BTW it was 29 degrees in SC the night you shipped to me. So even if the package was shipped correctly and I received my animals there is a chance the orrientalis would have been dead anyways.
4) YOU SPENT MY $3200 BEFORE PROVIDING ME WITH THE PRODUCT I PURCHASED.
5) You can only compensate me with the following: illegal orrientalis in 2-4 weeks (which I do not want), cb legal orrientalis in 6 months (earliest), cb masobe in September of NEXT year, or uroplatus which haven’t even reached the states yet. As you said on the phone “you are SOL no matter what you tell me”.
6) I had to drive out to UPS (30 min drive one way), repack dominick’s animals, and ship them to him. Mind you, you could have called UPS, explained the mistake and had them change the address on the forum and have them reship the animals. I did the shipping so that the animals could be repacked. Had I not done this those animals would be dead as well.
Since you can not guarantee the animals while they are in Dominack/Brian’s care and their eventual shipment to me I do not want them. Dominick and Brian are complete strangers to me. I do not know their care techniques nor their quarantine procedures. Brian will be shipping the masobe back to you. Simply telling me on the phone that you will “take care of me” will not get the job done. I want a full refund for $3200 and if you plan to send the refund through paypal you need to tac on 3% for the fee I will be hit with. You should just be able to hit the refund button but since you spent the money I do not know if that is a option. Either way, put the money on a CC, sell some animals, borrow it, do what ever you need to do I honestly do not care. I want the money by 5:00 PM PT tomorrow (01/30/07).

And if the orrientalis were deceased when received, I would have replaced them as I had said in previous conversations with you. You wanted young animals shipped, I did hold onto them until I saw fit with age.
4) I used the money given as payment for reinvestment in my company, a usual practice in business. you paid over time as well, since my living is based on animal sales, it was a justified use of funds rendered for the products.
5) you are the owner of animals produced from german bloodlines and were to receive animals produced by offspring of Hong Kong bloodlines. If you would like to play an illegal card, you knowingly purchased Paredura masobe after they were placed on a Madagascan National Ban October 31 2006 from Marcus Quesada and myself. You have violated the lacy act, any sales of these species without proof of legal importation are considered illegal transactions. I have legal import documentation of my Goniurosaurus being legitimately imported into the US. CB status does not free them from violation, same applies to all diplodactylus, strophurus and nephrurus geckos.
I offered adults, you refused and then I stated again I had the remaining CB animal. You mentioned the German bloodline animals as well and I still have not ignored that. And if you remember correctly, you did not want adults because of age given that you had a bad experience with Kevin Dunne at Dragon's Den.
I emailed back as I did because of your tone, you do not need to get rude with me or demanding as you know from our emails and conversations what kind of person I am. I am not rude or difficult to work with, i am quite flexible. And still you do not need to get rude with me now. I have been trying to fix this situation based on what I have available. And considering the circumstances, 5 of 7 animals are alive and doing well, based on our communication when I requested they stay with Brian and Dominick, you voiced your concerns, I voiced mine and you accepted and agreed with my decision therefore accepting the circumstances.
Considering the circumstances, in email and by phone I have not backed down whatsoever from my position, I will not now. I have not failed to provide the product nor will I.
Take some time to think and calm down. I have not been unreasonable with you, there is no reason for you to be with me.

I am able to pay you over the next two months, I am sorry but I am not in a position to given that I have invested everything in my upcoming imports and the pallets of glass. If you would like to dispute it thats fine. I can do 1200 now, 1000 next and then remaining 1000 the following. If income allows, I will do it faster. Seeing that I am doing this based on my living brokering animals and cage construction, I see my request as fair.
I am expecting a lot to occur in the next month and seeing how I have everything tied in two entities I am not able to do any different. You can either put me out of business or be honorable and understand my spot. If you think it is unreasonable to have invested the money paid to me back into my business, understandable but seeing how you paid me over two months and there were no issues then, I thought it safe to purchase the necessary equipment to make my business prosper. If I had not used the money as needed I would not have been able to purchase the glass to make the cages I am selling.
If you agree, No commentary on BOI or any other forums. No dispute with paypal as I am offering what is capable in my position. And certainly no threat to sue me or report me to better business bureau, one sour deal and one good deal is no reason to ruin someone who does not intend to harm you. You know the position I am in with my company, very early stage, its either nothing or everything.

Jason as I told you on the phone I will not wait 2 months for my money to be returned to me. I understand your predicament, but I am not a bank; I did not lend you money for you to invest it in your company. You were paid in increments prior to the animals being old enough to ship because you required me to prove I was serious about this deal. Otherwise you would have received one payment the week the animals were ready to be shipped. I made an exception with you because I trusted you, and you came through on our last deal. You had the legal right to spend my money only after you had completed your end of the transaction.
You have plenty of high dollar animals you can sell. There is absolutely no reason why you can not sell the animals you offered to send as a replacement. I will accept the $1200 now, but I want the rest of the money ($2000) by next Friday (02/09/07). This gives you adequate time to make the necessary sales. I am sorry Jason but I want what is rightfully mine.

It will not be two months before it is delivered. January, February, March. We are one 1 day away from February. I receive my shipments this month and am able to use what has been put forward for the purchases made when animals have been delivered. Literally, the animals have to be delivered to the US for me to make the needed payments, without that I can do nothing. You are right I required you to prove your commitment to the purchase, as you stated for expensive animals people talk big and then do nothing. You made the last two payments as you could, I did not question the request you made by phone in that respect. I am not arguing your request, just trying to work with what I have in my hands to do so. The rest will have to come as it can be offered. Otherwise, there is nothing i can do steve.
You have to think of this another way as well, if I part with the current high dollar animals I have in my collection to the general public, particularly the goniurosaurus that I have, I will in the long run ruin the market for us both. Would you prefer I do that or save us both the trouble of opening up the market for competitors? Now that you have them, you understand where I stand in that decision. I would rather not make a rapid fire sale and kill a market.

What business has absolutely no money set away, makes 0 profit during a given week, and doesn’t have access to a credit card? Regardless, you have plenty of inventory you can sell in order to come up with my money.
Whether you keep the orrientalis or not, it doesn’t affect me. Anyone selling animals similar to what I have is competition, whether it is you or a stranger. But honestly, I really don’t care about any of that. As I have told you many times, I do this as a hobby. Maybe some day I can make more of it but for now it is a hobby and it will remain that way for quite a while. I wanted a large, diverse group of orrientalis not so I could release a ton of hatchlings and own the market, but because in 10 years I still want a genetically strong group. Being one of the first people in the states to have these animals allowed me to trace back all of the bloodlines and insure there would be no inbreeding. Lastly, you and I both know that selling one pair will not kill the market.
In the end, you want to keep your glass, keep your glass cutter, keep all you breeding animals, maximize your investments (investments you made with my money) while I sit around and wait for my money to be returned. Mean while if something I want to buy pops up I have to pass up the deal because you have my money. If you were paying me interested on what has now turned into a loan it would be one thing, but in the end I am actually going to lose $80+ in paypal fees, animals I had been waiting on for 4 months, and all of the money I spend on caging for the orrientalis and masobe.

After discussing this with a lawyer and doing some research on South Carolina law, I have decided to take the risk. I have refunded the 1200 for the masobe geckos and will not refund you for the orrientalis. The option i had put forward before on the orrientalis by phone was replacement if they had perished because of their age. I offered accordingly and you refused the adults. Your only option is to take the offspring when they are available. That is industry standard. I have checked with several prominent companies and individuals in live animal trade and stand by my decision.
You take risks when purchasing animals the way you have, mistakes do occur and I have tried to rectify it as the industry would normally do. You take the risk when purchasing animals this way.
Your attempt to strong arm me into repaying you for a risk we both have taken is childish. You took a risk, it was your decision to ship during january regardless even if they had perished in South Carolina, the decision would still stand. The offer stands still, offspring when available. No other way. My offer is appropriate.
(NOTE: When available means I have to wait for the breeders the be warmed up in March, breed, lay eggs, incubate, and for the hatchlings to grow old enough to ship.)

Mean while if something I want to buy pops up I have to pass up the deal because you have my money. If you were paying me interested on what has now turned into a loan it would be one thing, but in the end I am actually going to lose $80+ in paypal fees, animals I had been waiting on for 4 months, and all of the money I spend on caging for the orrientalis and masobe.

After discussing this with a lawyer and doing some research on South Carolina law, I have decided to take the risk. I have refunded the 1200 for the masobe geckos and will not refund you for the orrientalis. The option i had put forward before on the orrientalis by phone was replacement if they had perished because of their age. I offered accordingly and you refused the adults. Your only option is to take the offspring when they are available. That is industry standard. I have checked with several prominent companies and individuals in live animal trade and stand by my decision.
You take risks when purchasing animals the way you have, mistakes do occur and I have tried to rectify it as the industry would normally do. You take the risk when purchasing animals this way.
Your attempt to strong arm me into repaying you for a risk we both have taken is childish. You took a risk, it was your decision to ship during january regardless even if they had perished in South Carolina, the decision would still stand. The offer stands still, offspring when available. No other way. My offer is appropriate.
(NOTE: When available means I have to wait for the breeders the be warmed up in March, breed, lay eggs, incubate, and for the hatchlings to grow old enough to ship.)
