After looking at the pics...I can see what you're referring to. I forwarded the pics and email as is, to Anthony Caponetto and described the situation. His reply was that there was no way to tell for sure but he'd have to be "5X closer" to be able tell from the pics. He felt sex was undetermined. I've attached a link to the same add that I have up on a different forum (yet to be deleted). There has been no changes and you can see early on that is states clearly that "I can not gaurantee sex" and that the price is based on "color and size". Please read the add carefully...
If you want me to be honest, I don't feel like I owe you anything. I feel like you misread my post and assumed that because I felt they were "probable" but not "gauranteed", they were defanantely female. Perception is reality and your perception was that they were both female. I feel like you looked at the deal and price before reading my add and or looking at my website to read my terms.
The geckos are a steel for what you got them for. It is not my fault that you don't have room for another male. I was as honest as I could be with you. I even stated more than once over the phone that I could not gaurantee sex and was not selling them due to that. I tried my best to guestimate their sex and priced them as such. In my opinion, they were underpriced. I turned down two offers that would have been paid up front to accomidate your situation. I didn't have to do that. I actually turned them down before recieving any money from you and one of the persons interested, contacted me recently to see if they had sold.
Unfortunately, I don't feel like I owe you anything. I am sorry for the misunderstanding and I would never lead a potential buyer astray when representing my animals. I take pride in what I sell and represent them accordingly. After reading this email, sleeping on the situation, and reading my add; you feel that you deserve the 50.00.......then I'll send it to you to further accomidate you, but I don't feel that I should have to compensate for your misunderstanding.
The animal is what it is and is a beautiful specimen regardless of the sex. You are holding me accountable for your circumstances which I've tried my best to accomidate. The geckos even if one is a male with the other gecko is a steel!! For future purchases, maybe you should thoroughly read a sellers terms and add before make the purchase. Also if sex is such an important factor, buy adults.

Ok man, I was going to let this be and let it die down! But I got ripped
off and you didn't use lube, They have BOTH turned out to be MALES!!!!!!
I feel as though you miss lead me totaly, instead of saying they were
UNSEXED, you claimed 95% positive they were FEMALE??? You have got to
figure something out as I am prepared to send you the animals back for a
full refund at this time, there is no way I will be able to make 300
bucks on two males and you know as I said before, I don't need males!
Had no intention of buying males in the first place. I hope you can
understand my aggravation and the fact of the matter is, if this issue
isn't fixed, I will post these facts on every forum I am a member of and
there are allot of them. I don't mean to be this way, but I feel you
could have been honest at the start of the transaction and said that
they were unsexed instead of trying to make you decision without knowing
what you are doing. you can talk to Anthony or who ever you feel you
need to, but I would like this issue to be resolved ASAP before the
weather is to cold to ship them back to you if that is the route you
want to go.

You have got to be kidding me. I apologize for your aggravation in that they are both males; in which I'm giving you the benefit of the doubt because of this email. I am going to make this short and sweet for you:
1. Do NOT threaten me....I don't take to it well and it shows your lack of maturity and character, not to mention the fact that you're doing it through an email. I bet you feel real tough don't you...
2. The deal is done, I haven't heard from you in months and so you feel that you have the right to email me out of the blue and demand your money back because you didn't get what you wanted? I don't think so, it doesn't work like that...and just for future records, threatening people is not the best way to work out an issue. I told you months ago I'd be willing to reimburse you partially for the first animal, even though it was clear that I didn't owe you anything. But that was then, and too much time has gone by...and frankly, I have better things to do then listen to you ramble on about something that has no viable arguement.
3. The add which I attached to a previous email said that I did not guarantee sex, nor could I. If you'd like I can re-send it because you've apparently forgotten it.....again. It also states that "the price is based on color and size", not the sex of the animals. I don't owe you a dime and you won't get anything from me. Not now, nor ever! You've handled this like a real "piece of work" and I'm not going to go round and round about it with you any longer.
4. Go ahead with your threat and post all you want. I've been in the hobby long enough to develop a good reputation and friendships with many herpers......so if you want to waste your time by bad mouthing someone behind their back, be my guest. Not to mention, it's going to make you look bad. And on a side note, I could do the same to you but I don't feel I need to, nor would I stoop to your level.
You're letting this eat you up inside and some species of animals are not able for sex to be guaranteed as young, and this is one of those species which I stated in my add. Do not threaten me or anything of the sort.....I do apologize once again for everything and the entire experience....most people would be thrilled with those animals regardless of sex. I turned down offers to accommodate your payment plan so its time you moved on and gotten over it!
I'm done talking to you. You are wasting my time and yours and there is no need for us to communicate any longer...

Regardless of what the add said, on the PHONE, you said that you where
95% positive they were both females! This coming from someone I thought
knew WTF they were talking about, obviously I was dead wrong. You are a
piece of work yourself and a great sales man. Tell me any lie you can
think of as long as you make the sale huh? Learn what you are doing
dude, you're a ridiculous example of a hobbyist of any sort. You should
learn your animals and their behaviors before you make guarantees of any
sort what so ever and I would like at least 100 bucks back as I would
never pay anything more then 100 bucks for any male. You can check
kingsnake.com, I am giving you the benefit of the doubt, most males on
there are around like 40 bucks, some are free you pay shipping. You lied
to me on the phone regardless of what you ad said and you should be held
accountable for it. If I had lied to you then I could see how you would
want to just write it off and tell me to eat shit, but I haven't and nor
would I. I know that you think you have a good reputation, in which you
might with snakes. Crested Gecko you will never which has became very
obvious to me as to why you where getting rid of these animals. I don't
know man, if it makes you sleep well at night knowing you ripped me off,
more power to you. I wish I could be manly like that. To rip off someone
2500 miles away. Then I could be cool and say my as said this my ad said
that and disregard all phone conversations I ever had with you. I hope
you are better with snakes then you are with crested geckos I honestly do.

This is my final email to you. Your response actually made me chuckle. You said that I "guaranteed" you. I did, I guaranteed that they were healthy and feeding and that the colors had not been altered in any way through deceptive photography. That is it James!!!!
There was NO GUARANTEE OF SEX! Which is what this issue is about. Read the add man. I find it funny that you expect a seller to accommodate your terms "regardless of what the add said". That's the reason people post terms of service in adds and on their websites is to protect themselves from ridiculous and false accusations from people like you!
I never guaranteed sex over the phone or in an email! The only liar is you. Lets not "be the pot and call the kettle black"! You lied to yourself, created a false guarantee that I never said and now you're trying to pawn it off on me months after the sale with no correspondence.
Dude, go take a hike and grow up! If you think for a second, I'm going to buy into your claim, then your kidding yourself. But you don't check those because you can't handle the truth it seems. And another thing, the distance of 2,500 miles means nothing. I'd tell you the same thing if you were my neighbor. Think about the way your acting for a sec. All the facts are on paper (which would totally discredit any post you ever made on a forum to bash me, regardless of my reputation). As for Cresteds and snakes........don't think I got out of cresteds for lack of success. I enjoyed them and still do. Snakes have been a passion for me for as long as I can remember, but to be honest, you don't even deserve an explanation of were my passion lies in reptiles.

Ok, just remember then when everything is said and done, the 100 bucks
would have been allot better off for you Jeff. You are a liar and you
will be proven as such man. Me girlfriend was here when you where on
speaker and said that you were "Positive they are both females" but you
can deny it all you want you expert sales man you! If you wouldn't have
said that you were positive they were females I would have never bought
them as I already had 5 males at the time and more unsexed crested
geckos then I know what to do with ( figuratively speaking. ) I will
also contact Anthony just to justify your claim of getting in contact
with him to show him the photo's and get his opinion like you said you
had. Other people are suggesting to take it to BOI which I am not
prepared to do as of this time. Once everything checks out and I trace
your stories and get the results from them, I will then proceed from
there as to what I see fit some you don't take advantage of someone
else as you have me in the future. You can keep calling me as young as
you would like as it shows your level of professionalism or lack there of.
And you know, I have yet to receive the 50 bucks you said you would
refund. I guess that is just another example of your sales man abilities
to tell one what you think they want to hear and never follow threw with
it. Which I would have looked over it if the second one had turned out
to be female as you told me on the phone you were so positive they were
both female. Then I seen the pores on the second one and knew I had
gotten hosed and I am going to do whatever it takes to make it so
someone else doesn't have to deal with a situation such as this.
Frankly, I could care less if you are done responding to my emails to. I
know it gets hard to say the same thing time and time again.
About talking behind your back, just let me know if you want the
addresses to the posts on the forums, I have nothing to hide and I will
gladly send them to you, thats no problem Jeff.
Personally I don't think a 100 bucks is even worth it to me anymore
either. This has become something much bigger then I had intended and I
